Plaintiff Jenny NoMi Shin, an individual ("JS"), for her complaint, and

20 demanding trial by jury under Rule 38, Fed. R. Civ. P., and Local Rule 38-1, alleges

that Defendant Northern Tool & Equipment Company, Inc. ("Northern Tool"), a

22 Minnesota corporation, is infringing U.S. Design Patent D604, 188 ("the ' 188
23 patent"), by making, selling, and offering to sell, in this judicial district, lightbars
24 that infringe the ' 188 patent.

This is a civil action for patent infringement and arises under, among

26 other things, the United States Patent Laws, 35 U. S.C. section 10, et seq.
27 Jurisdiction is therefore based upon 28 U.S. C. sections 1331 and 1338(a),

providing for federal question jurisdiction of patent infringement actions and


exclusive jurisdiction of patent infringement actions in the U. S. district courts.

Plaintiff JS is informed and believes, and thereon alleges, that venue in

this court is proper under 28 U.S. C. section 1391 (c) and section 1400 (b) because
the acts of patent infringement alleged herein took place, at least in part, within this
udicial district.

Plaintiff JS is an individual residing in the State of California.

Defendant Northern Tool is a Minnesota corporation, and has its

principal place of business in Burnsville, Minnesota.

On November 17, 2009, the U.S. Patent and Trademark Office duly

and lawfully issued the '188 patent under the title Mini Light Bar. A true and
correct copy of the '188 patent is attached hereto as Exhibit A.

Northern Tool has infringed the' 188 patent by making, selling, and

offering to sell, in this judicial district and elsewhere in the United States, light bars
covered by the single claim of the '188 patent. Northern Tool's manufacture and
sale, in this judicial district, of Ultra-Tow Twin Rotating Halogen Lightbar-70
Watts, 12 volts, specifically Item #40322, has infringed the '188 patent.

Upon information and belief, Northern Tool's infringement has taken

place with full knowledge of the ' 188 patent and has been intentional, deliberate,
and willful.

Upon information and belief, Northern Tool has derived, and will

continue to derive, and received from the above infringement, gains, profits, and
advantages in an amount not presently known to JS.

Northern Tool's infringement of the' 188 patent has damaged JS in an

unknown amount. These damages continue to grow as Northern Tool's infringement


continues. Under Section 284 of Title 35 of the United States Code, JS seeks

1 damages adequate to compensate for this infringement in an amount no less than a


2 reasonable royalty, together with interest and costs affixed by the Court. Under
3 Section 289 of Title 3 5 of the United States Code, JS also seeks her lost profit.

Northern Tool's continuing infringement of the' 188 patent has caused

5 and continues to cause irreparable harm to JS, including impairing the value of the
6 '188 patent in an amount yet to be determined. Pursuant to Section 283 of Title 35
7 of the United States Code, JS seeks a preliminary and a permanent injunction
8 against further infringement of the' 188 patent.

PRAYER FOR RELIEF

WHEREFORE, JS prays for the following relief from this court against

12 Defendant:

1.

An order, pursuant to 35 U.S.C. Section 271, declaring that Northern

14 Tool has infringed the single claim of the' 188 patent;

2.

A preliminary and a permanent injunction against Northern Tool,

16 prohibiting Northern Tool from further infringement of the '188 patent;

3.

An award of the actual damages JS has suffered by reason of the

18 infringement charged in this Complaint, in an amount not less than a reasonable


19 royalty on Northern Tool's sales of the products charged with infringing the' 188
20 patent;

4.

An award to Plaintiff JS of his costs of suit herein; and

22

5.

Such other and further relief as the Court may deem just and proper.
