MISSION STATEMENT
WHO WE ARE
We are a non-profit organization of motorcycle
enthusiasts from all walks of life. We lobby and
educate the government and the general public
to promote motorcycling in a safe and positive
image. We endeavor to enlist the cooperation and
participation of all organizations and individuals
that share a similar interest in preserving our
American tradition of FREEDOM. We promote
motorcycle safety, training, & political awareness.
We ARE NOT A CLUB OR A GANG. We
fund our work through toy runs, poker runs,
campouts, and other motorcycle activities. We
are your neighbors & friends who work, pay
taxes, and get involved with our community. We
serve and support our country and believe in
freedom. We use all legal means to protect our
rights without infringing on the rights of others.
OUR GOALS
To become a powerful and viable political force in
legislative matters concerning the motorcyclist.
To promote the safe riding habits without infringing
on individual freedoms.
To motivate the bikers to write letters to their
legislators before, during, and after the legislative
session.
To furnish our members with a newsletter to
keep all bikers informed in regards to upcoming
legislation.

Christmas time is here. We are meeting Dec 7th,


Cape Coral bike night, state meeting on the 13th, and
Christmas run on the 21st.

can be picked up at local motorcycle shops throughout Lee County and
many offer discounts to ABATE Members (just show your card) and at our
Tuesday Bike Night at The Joint in Cape Harbor from 6p-9p.
Membership Is $20.00 per year or a life membership for $150.00.
Membership includes a $4,000.00 accidental death or dismemberment
policy, local discount with participating businesses and a VOICE to be
counted as a member of a Motorcycle Rights Organization (MRO) to
make roads safer and drivers accountable for their actions.

Our fellow ABATE Brothers and Sisters of the West


Coast Chapter will be having their 34th annual Toy Run
on Sunday, December 7. Registration at Ken Thompson
Park in Sarasota (1700 Ken Thompson Parkway) at 10:00.
Kickstands up at 11am. This will end at Tarpon Pointe
Grill in Bradenton (801 Riverside Drive E). Bring an
unwrapped toy or clothing for children (infants to teens).

NORTH PORT AMERICAN


LEGION RIDERS EVENT
The American Legion Riders, post 254, Taneytown Street,
North Port, will be having a rally for veterans and families
on Sunday, December 7. This starts at noon and ends at
6pm. EVERYONE is welcome - either by bike, 4-wheeler,
or two legs! Anyone bringing a new, unwrapped toy will
receive a beverage from the Legion Riders.
This event will feature games, food, raffle, silent auction,
lotto vest, music, 50/50, and more! For more information,

IS IT THANKSGIVING or BLACK FRIDAY ?


You may certainly agree that Christmas is losing its real meaning, obscured in commercialism and Santa Claus (the
most common character of Santa Claus was a 1931 invention of artist/illustrator Haddon Sundblom, commissioned by
Coca-Cola).
Now, commercialism is trying to have us look more forward to Black Friday, than to spending time with our dear friends
and family, giving thanks to God for all He has provided.
Wikipedia tells us that the term Black Friday originally comes from Philadelphia, where the day after Thanksgiving
there is so much traffic from vehicles and people. The day after Thanksgiving is the busiest shopping day of the year,
where many commercial operations will begin to operate in the black for the current year. Stores would open very
early in the morning to handle the numbers of shoppers. However, in 2012, stores began opening in the last hours of
Thanksgiving. How sad that workers spending time with friends and family, with many thanking God for His provisions
on Thanksgiving, now have to spend a portion of the Holiday, getting ready for/and having to work.
The Scriptures tell us that, in Matthew 6:24 (NIV) No one can serve two masters. Either you will hate the one and love
the other, or you will be devoted to the one and despise the other. You cannot serve both God and money. Also, 1
Timothy 6:10 (NIV) For the love of money is a root of all kinds of evil. Some people, eager for money, have wandered
from the faith and pierced themselves with many griefs. We are not saying that money itself is evil. However, it is the
love of money and that itself can become an idol in peoples lives that takes us away from God. Anything can become an
idol, including our prized possessions. What ever satan can use, he will use.
Can we as Americans, get back to what some of our Forefathers envisioned as Thanksgiving?
WHEREAS it is the duty of all nations to acknowledge the providence of Almighty God, to obey His will, to be
grateful for His benefits, and humbly to implore His protection and favour; and Whereas both Houses of Congress
have, by their joint committee, requested me to recommend to the people of the United States a DAY OF PUBLICK
THANKSGIVING and PRAYER, to be observed by acknowledging with grateful hearts the many and signal favors
of Almighty God, especially by affording them an opportunity peaceably to establish a form of government for
their safety and happiness: NOW THEREFORE, I do recommend and assign THURSDAY, the TWENTY-SIXTH
DAY of NOVEMBER next, to be devoted by the people of these States to the service of that great and glorious Being
who is the beneficent author of all the good that was, that is, or that will be; that we may then all unite in rendering
unto Him our sincere and humble thanks for His kind care and protection of the people of this country previous
to their becoming a nation; for the signal and manifold mercies and the favorable interpositions of His providence
in the course and conclusion of the late war; for the great degree of tranquility, union, and plenty which we have
since enjoyed; for the peaceable and rational manner in which we have been enable to establish Constitutions of
government for our safety and happiness, and particularly the national one now lately instituted; for the civil and

religious liberty with which we are blessed, and the means we have of acquiring and diffusing useful knowledge;
and, in general, for all the great and various favours which He has been pleased to confer upon us.
And also, that we may then unite in most humbly offering our prayers and supplications to the great Lord and
Ruler of Nations and beseech Him to pardon our national and other transgressions; to enable us all, whether in
publick or private stations, to perform our several and relative duties properly and punctually; to render our National
Government a blessing to all the people by constantly being a Government of wise, just, and constitutional laws,
discreetly and faithfully executed and obeyed; to protect and guide all sovereigns and nations (especially such as have
shewn kindness unto us); and to bless them with good governments, peace, and concord; to promote the knowledge
and practice of true religion and virtue, and the increase of science among them and us; and, generally to grant unto
all mankind such a degree of temporal prosperity as he alone knows to be best.

Pontus Back

ontus Back from Finland, will be with us again for


our Sunday morning service on December 7th. Pontus toured the world with many rock bands featuring
members from bands like Whitesnake, Lynyrd Skynyrd, Molly Hatchet, Status Quo and Cinderella. After being radically
saved, he now leads biker outreach ministries and travels performing music, ministering, and sharing his testimony. Make
sure you mark this date to hear his awesome story!

Legislative Report
Good Morning Freedom Fighters:

Whew! The elections are over, and the dust has
finally settled on what the Florida landscape will look like
for the next two and, in some cases, four years.

Voter turnout was heavy, 57.9 percent in Lee and
66.2 percent in Collier Counties alone, with 48.2 percent
statewide.

The big one that everyone was watching was the
Governors race. Voters turned out in droves to help Gov.
Rick Scott defeat challenger Charlie Crist.

Frankly, Charlie did a lot better, vote-wise, as a
Republican when he ran for Governor in 2006 against
Dem. Jim Davis. Even with the lower voter turnout at the
time, he garnered over 62 percent of the vote. This time he
only managed to get 47.1 percent of the vote statewide.

In the only federal race on the ballot, Republican
Curt Clawson, for the third time in eight months, won
the District 19 congressional seat by defeating Democrat
April Freeman and Libertarian Ray Netherwood.

There were no surprises in the District 19 race. It is
one of the safest GOP seats in the country. A Republican
has won every race for four decades.

Freeman has raised more in donations than any
previous Democrat aiming for the seat, but doesnt have
the registered Democrats in the area to get a real boost at
the polls.

In the Florida House District 76 race, Ray
Rodrigues won with 68 percent of the vote.

Democrat Charles Messina was the only opponent
Rodrigues faced in the race to return to Tallahassee for his
second term. Neither had opponents in the primary. In
2012, Rodrigues was elected with half the vote over two
Republican opponents in the primary and had no general
election opponents.

The District 76 race had no surprises. Rodrigues
had name recognition and a district dominated by GOP
voters. He also had a huge fundraising advantage as the
incumbent.

In the Florida House District 77 race, Dane Eagle
wins. Eagle, whose district includes Cape Coral, received
100 percent of the vote.

Eagles real race was his four-way bid to keep his
seat against three Republican candidates in the Aug. 26
primary, which he won handily. His write-in candidate

has not even been a blip on the radar.



Florida House District 78: Heather Fitzenhagen
is the winner. Fitzenhagen, whose district includes Fort
Myers, received 100 percent of the vote.

Fitzenhagen had no challengers in the primary
and faced only a write-in candidate. Her seat was never in
question.

In the local elections, Brian Hamman won the Lee
County Commission, District 4 seat.

Hamman won a contentious race against Coy and
Smith in August.

Jordan has also been campaigning for the seat
since around the same time as Hamman, when both were
vying for the appointment to replace the resigning Tammy
Hall.

But just a few Democrats have sat on the board
in its history, and Hamman has widespread support essentially, winning the Republican primary was, for him,
the difficult part.

In the Lee County School Board district 4 race
(nonpartisan) race, Steve Teuber is the winner with 51
percent of the vote.

This school board race has been a tight one
because both candidates have served on the school board
and campaigned against each other.

Teuber served on the board for eight years until
Armstrong narrowly stole his seat in 2010.

The two candidates appeal to different
demographics. Armstrong, a plumber by trade, has gained
support for his anti-testing stances and prominently
libertarian roots. Those who support Teuber cite the
professional lawyers business background and education
as qualifications for the job.
STATE BALLOT INITIATIVES

Amendment 1 passes. Would designate 1/3
of documentary stamp taxes - collected on home and
property sales - for land and water conservation projects.

The two sides: This has been an amendment
championed by ecological groups and those who want to
see Florida stay green. In Southwest Florida, hundreds
of thousands of residents signed on to get the amendment
on the ballot.

Opponents - who at least publicly were
outnumbered by supporters - were concerned designating
a third of the money for conservation would mean the

other issues helped with those taxes, such as affordable
housing, would suffer.
Amendment 2 fails, falls less than 3 percentage points
short of 60% needed to pass. Would legalize medical
marijuana in Florida.

The two sides: Supporters say this is a
compassionate measure that would provide relief for
those suffering from serious diseases and symptoms,
provide another option to pharmaceuticals, and be stateregulated.

Opponents say the amendment language is too
broad, anyone will be able to get it and the measure will
lead to general legalization of marijuana for adult use.

Amendment 3 fails. Would give governors the
power to fill judge vacancies through appointment,
including as they are exiting from office, and to
prospectively fill seats before judges have vacated them.

The two sides: Proponents believe this would keep
judgeships from being vacant during the search for a new
person in the roll.

But opponents believe it gives governors exiting
their office too much power to affect appointments that
would otherwise have gone to the incoming governor.
LOCAL BALLOT INITIATIVES
Estero incorporation. Voters approved incorporation.

The two sides: The measure was widely expected
to pass after an Estero group collected more than 10,000
signatures for an incorporation petition.

Estero has 28,000 full-time residents. The
grassroots, voluntary Estero Council of Community
Leaders spearheaded and funded the incorporation effort
over the past 18 months. The ECCL, which represents
35 gated communities, spent $10,000 on attorneys
and incorporation feasibility studies, campaigned in
Tallahassee and created flyers and postcards.

No organized group stepped forward
against incorporation. Some residents spoke against
incorporation, saying Lee County was serving Estero fine
and the community didnt need to add another layer of
government.

The Village of Estero will be created on Dec. 31,
according to the citys charter. Council candidates can
qualify from Jan. 12-16. Elections for Esteros sevenperson council will be held March 3, and the first Village
Council meeting will be March 17.
LEE COUNTY SCHOOL BOARD AMENDMENT:
This amendment would expand the Lee County School

board from five to seven members, with five being elected


from single-member voting districts and two at large.
Results: Amendment passes

The two sides: The issue has not been
controversial or even a focus of much discussion. Singlemember districts would allow only residents living in a
geographical area to vote for a representative, a restriction
that some believe would give minorities a better chance
of being represented. No minority has ever served on the
Lee school board.
Lee County Charter amendment to limit
commissioners to three four-year terms: Results:
Amendment passes, 88 percent in favor.

The two sides: Commissioner Brian Hamman
spearheaded the effort to get term limits on the ballot
earlier, and succeeded where commissioners had failed
twice before.

The vast majority of the speakers at the Lee
County Board of Commissioners and at the polls Tuesday
supported the measure.

Those against the amendment feel voters impose
their own term limits by not re-electing officials.

A state appeals court Wednesday ordered a new trial for
a man convicted of sexually abusing his former stepdaughter because of the possible influence on jurors of
people wearing leather jackets emblazoned with the name
Bikers Against Child Abuse.

In a 2-1 decision, the 1st District Court of Appeal
said the bikers were seen sitting in a hallway with jurors
on the morning that the trial of Brian Scott Long was
scheduled to start in Duval County. The majority of
the appeals court agreed with Longs attorney that an
unacceptable risk was created that the verdict reached
was, at least in part, a result of the pre-trial encounter with
the insignia-laden bikers.

While we would not describe the bikers with a
pejorative term such as mob, it is nevertheless the case that
these individuals appeared at trial with the announced
purpose of remonstrating against child abuse. said the
majority opinion, written by appeals-court Judge William
Van Nortwick and joined by Judge Philip Padovano. The

bikers, then, sought to send an implied message to the


jury that Long should be found guilty. Such a message has
no part in a trial.

But Judge Lori Rowe, in a dissenting opinion, wrote
that the trial judge questioned the jurors and determined
that they could be impartial. The trial judge, who denied a
motion for mistrial, also told the bikers not to wear their
insignia in the courtroom and not to congregate around
the jurors. Several bikers were spectators in the courtroom
during the trial.

Simply put, there is absolutely no evidence in
the record that the jurors in this matter were in any way
influenced by the presence of the bikers before and during
the trial, Lowe wrote. Indeed, the trial court, who was
in the best position to monitor the atmosphere of the
courtroom, found no actual or inherent prejudice as a
result of the presence of the bikers in the hallway.

Long was charged with multiple counts of lewd
and lascivious molestation and sexual battery of his
former step-daughter, according to Tuesdays ruling. The
crimes were alleged to have taken place over several years,
and the victim did not report them until years after she
said they happened.

The jury ultimately convicted Long of two counts
of lewd and lascivious molestation and one count of sexual
battery by a person in familial or custodial authority, the
ruling said. Department of Corrections records indicate
Long, 44, was sentenced in 2012 to 30 years in prison.

Lowes dissent said the case is the first time that
the Tallahassee-based appeals court has ruled on the
question of whether conduct by a private spectator at
trial can be found inherently prejudicial. But she pointed,
in part, to the Florida Supreme Courts handling of issues
involving spectator conduct, including a case in which a
spectator during jury selection wore a shirt memorializing
a murder victim.

The Florida Supreme Court has never held or
implied that a defendant has been deprived of the right
to a fair trial by private spectators displaying buttons,
pictures, or other insignia inside the courtroom, Rowe
wrote. And, it has certainly never attempted to regulate
the conduct of spectators outside the courtroom, in
regards to the wearing of buttons, pictures, or other
insignia.

But the appeals courts majority wrote that the
bikers knew the victim and could have shown support for
her without the garb. The ruling said the bikers chose to
wear clothing to send a message.

That message was the appellant (Long) was a

sexual abuser and that sexual abuse was to be condemned


by a guilty verdict, the ruling said.

2014 Elections and Beyond

Now that the dust has settled on the 2014 election,
the Motorcycle Riders Foundation issues its reflections on
what just happened. As you probably already know, it was
a good night for Republican candidates with the pick up
of some unlikely Gubernatorial, Senate and House seats.
The election ultimately gave the Republicans a Senate
majority and the largest Republican House majority since
1929.

Some say that the Republicans received a mandate
from the country on their conservative platform: that
is a little far fetched, considering the Presidents dismal
approval ratings and the tradition of a second term
presidents party receiving a walloping at the polls in the
midterm elections. President Obama has also inserted
himself and his policies into the fabric of peoples daily
lives, and that has not had the desired effect-just the
opposite actually.

The Republicans managed to capture seven
additional Senate seats and possibly more, as Virginia is
still too close to call. The Louisiana Senate race, according
to state election law, must go to a run off in the coming
weeks with polls identifying the Republican candidate
with a healthy lead over the incumbent. The Republicans
will have a slight majority with less than the 60 votes
needed for full control. Mitch McConnell is apparently
the heir to the Majority Leader position after handily
defending his seat against a worthy adversary.

The Republicans also held onto and even expanded
their robust control of the U.S. House of Representatives.
They padded their majority, elected the first black
Republican woman, and are set to re-elect speaker
Boehner. Speaking of women, this Congress is now the
first to elect 100 women to the House and Senate.

Longtime motorcycle champion and House
transportation committee member Nick Nicky Joe
Rahall (D-WV) lost his bid for a 20th term in the
House. We are sad to see him go, and his loyalty to the

motorcycling community will be missed.

Republicans also won some very unforeseen
Governors races, most notably in Massachusetts and
Maryland: both were stunning upsets in solid blue states.
Whether the Republicans had a great midterm because of
there policies, President Obamas unpopularity, or if the
Democrats just had bad candidates is up to you to decide.

Now Congress must come back to work and finish
the must pass spending bills as well as any last minute
business that the lame duck session will accommodate.
After that, anything is possible. The next Congress will
see lots of veto threats from the White House and lots of
complaining from the Republicans. We will also see how
the Republicans run the Senate with razor thin majority.
Expect lots of partisan theatre, showdowns, and maybe
even another government shut down.

The Motorcycle Riders Foundation will keep you
informed on this issue, and every other matter affecting
motorcyclists in Washington, D.C.
