PLAINTIFFS SECOND SUPPLEMENTAL BRIEF IN FURTHER SUPPORT OF
THEIR MOTION FOR SUMMARY JUDGMENT AND OPPOSITION TO
DEFENDANTS MOTIONS TO DISMISS
Plaintiffs Janet E. Jorgensen and Cynthia A. Phillipss motion for summary judgment is
currently before the Court. In support of that motion, and in opposition to Defendants pending
motions to dismiss, Plaintiffs now file this second supplemental brief to alert the Court to three
recent federal court decisions that address the constitutional claims at issue in this case. See Jernigan v.
Crane, No. 4:13-cv-00410 KGB, 2014 WL 6685391 (E.D. Ark. Nov. 25, 2014); Rosenbrahn v.
Daugaard, No. 4:14-CV-04081-KES, 2014 WL 6386903 (D.S.D. Nov. 14, 2014); Lawson v. Kelly, No.
14-0622-CV-W-ODS, 2014 WL 5810215 (W.D. Mo. Nov. 7, 2014). The decision in Rosenbrahn from
neighboring South Dakota is especially instructive as the district court there reviewed, and rejected, a
number of the arguments made by Defendants in this case in support of their motion to dismiss,

including the reliance on Baker v. Nelson and Citizens for Equal Protection v. Bruning. For all of the
reasons previously cited, as bolstered by these additional recent precedents, Plaintiffs Janet E.
Jorgensen and Cynthia A. Phillips respectfully reiterate their request that the Court grant their
motion for summary judgment and deny Defendants corresponding motions to dismiss.
