111 families in area


enjoy Christmas dinner

More than 100 families
in the Clearwater and Clear
Lake area had a Merry
Christmas thanks to the
generosity of people and
businesses in their community and the help of lots of
dedicated volunteers.
The Clearwater/Clear
Lake Food Shelf distributed Christmas meals
Monday and Tuesday to
families who needed some
help getting through this
Holiday season.
Its
our
annual
Christmas basket, said
Karie Gohman of the food
shelf. Basically, it provides a family with a meal
for Christmas.
In addition to a gift card

to purchase a ham, families


received vegetables, milk,
eggs, margarine, fresh
potatoes, bread, rice, cereal, pasta and a specialty
potato, like scalloped or au
gratin.
And we try keep in
mind that the kids are
going to be off from
school, so we know theyre
going to need some extra
assistance, said Gohman.
So pasta is always good,
and macaroni & cheese.
There was also a selection of cake, cookies and
variety of sweets. How
much each received was
determined by the size of
the family. Gohman said
the families ranged in size
from one to nine, with most
in the four to five range.

The kids also had a


chance to meet with Santa
and get a gift. One generous local merchant purchased all the toys. When
families signed up for their
basket, they included the
ages of their children. All
kids 17 and under got a
gift, handed out by Santa
and his elves.
The food shelf distributed 111 meals for
Christmas compared to
about
100
on
Thanksgiving. Gohman
said the numbers are usually higher at Christmas.

Young artist
blooms at Clearview

The dictionary defines
the term prodigy as follows: A person, especially a child or young person,
having extraordinary talent
or ability. That word
jumps to mind after viewing some of the paintings
created by artist Elizabeth
Anderstedt, an 11-year-old
sixth-grader at Clearview
Elementary School with a
rapidly-developing set of
skills and some very clear
ideas as to her future.
Her art teacher, Kathy
Gerdts-Senger, put it this
way: In over 40 years of
teaching art, she may be
the most talented child Ive
ever worked with.
The artist, known as
Lizzy to her friends, was
engaged in multiple projects last week, drawing
and painting as she
thoughtfully
answered
questions about her life in

No new city administrator yet

The search continues for
a new Clearwater city
administrator.
Last week, members the
Clearwater City Council
believed they were just a
few days away from selecting a new administrator.
But that changed last
Thursday when two of the
citys top candidates decided not to accept an offer
from the city.
The city has been searching for an administrator
since early October when
the council voted not to
keep Heidi Eckerman as
administrator. After adver-

tising the position, about


20 applicants responded by
the late November deadline. Of those, Interim
Administrator Bob Derus
had telephone interviews
with 12 and narrowed the
finalists down to four candidates.
Last Monday afternoon,
Derus and Mayor Pete
Edmonson interviewed all
four finalists and picked
two for follow-up meetings
on
Tuesday
and
Wednesday with staff and
any council members who
could attend.
The council also called a
special
meeting
for
Thursday evening with the

intent of offering a contract


to their top choice between
those two candidates.
At that time, Derus urged
the council to move as
quickly as possible, since
there were other cities that
were aggressively trying to
recruit the same candidates.
That prediction turned
out to be true, because by
the time the council met
Thursday evening, one of
the candidates had already
decided to accept an offer
from another city.
Derus told the council
that candidate received a
salary offer about 10 percent
higher
than

was unlikely the city
would have been able to
recruit that person without
a big increase.
During
Thursdays
meeting, Derus told the
council the second candidate had already received
an offer from another city.
But he did not know the
salary or the terms being
offered.
As a way to improve the
citys chances, Derus proposed making an offer
slightly above the citys
minimum, with adjustments for increases, vacation time and other incentives.
I cant stress how
important this position is
for our success in lots of
things, including the city
moving forward, he said.
Developers are going to
want a good spokesperson.

existing staff would react
to the council increasing
the salary range for a new
member.
What does it say to our
current employees? he
asked.
I understand this is
going to upset the apple
cart or however you want
to look at it, said Derus.
But theyre going to want
a good leader.

future. A child of an electronic age, she adds video
games and the possibility
of doing graphic designing
in that area to her future
life choices. Pokemon
is one of her favorite
games at the moment, and
she enjoys the genre
because anything can
happen in the video
world, providing an escape
from the everyday for a
very curious young mind.
Among the items on display in the Clearview art
room last week were a vertical landscape she had
painted in about four
hours, her work-inprogress for the Anti-Drug
poster contest at the school
and photos of earlier
acrylic and three-dimensional paintings she had
created earlier in the year.
Her dragon sculpture, a
favorite theme in her art
works, was in baking in the
kiln at the time of the interview, and so was unavailable for viewing by press
time. The pre-sculpture
drawing, however, showed
an elaborate winged creature balancing a chalice on
its tail.
Lizzy has an older sister,
Terra, with whom she
maintains a sibling artistic
rivalry, though it has to be
a long-distance contest
since the sisters are currently living in different
countries. Lizzy lives here
with her Mom while her
sister is currently attending
school in Manitoba, living
with her Dad who is currently working in the

Winnipeg, MN area. The


two share a strong artistic
streak, with Lizzy saying
that her older sister is especially skillful in drawing
hands, a sticking point for
many portrait artists, she
said.
Much of Lizzys art
work is done during the
Kid Stop after school program at Clearview, a program under the auspices of
the Boys and Girls Cubs in
the St. Cloud School
District.
The program
gives her ample time to
draw and sketch her
beloved dragons, as well as
the flowers, animals and
landscapes that she loves
to create.
She has a wide variety of
other interests, including
the scientific aspects of
chemistry and the possibilities of outer space exploration, including the possibility of someday discovering life on alien worlds.
She is a writer as well, concentrating on fantasy stories such as her Inferno,
in which kids find themselves in another dimension for a series of adventures with, of course, dragons, among other things.
She is also working on
The Five Disasters,
which will include characters experiencing a volcano, a tsunami, a hurricane, a blizzard and an
earthquake. Lizzy was
also the editor of a fictional newspaper for a school
project, a task which she
diplomatically described as
fun.

many disciplines, Lizzy
also plays the clarinet,
which she enjoys but classifies that as just a hobby
in contrast with her other
artistic endeavors. A selfdescribed cat person, she
is also fond of her tropical
fish.
New projects are always
on the horizon for her,
including landscapes of a
volcano and a glacier in a
fire and ice theme that
she hopes to enter in a contest next year, and working
in a Chinese-Japanese
illustrative style that has
recently caught her eye.

they were a recipient of an
award

Intergenerational Program
with Clearview Elementary
school. Both St. Benedict's
Senior Community and
Mrs.
Coulter
from
Clearview
Elementary
school were recognized at
Care
Providers
of
Minnesotas annual convention, held earlier this
month in Minneapolis.
Community
The
Partnership Award recog-

nizes the efforts of a Care


Providers of Minnesota
member to create a partnership with a community
group or organization that
is outside of the care profession, which improves
the quality of life for residents and tenants.
For the past four years,
Mrs. Andrea Coulter, a
teacher at Clearview
Elementary School, and her
4th grade students have
been coming to St.
Benedicts Senior Community (SBSC) to visit
with residents. Twice a

month, the 4th graders are


paired with a resident, and
they spend time together
reading books, doing arts
and crafts, and sharing stories. The program has made
a tremendous impact on the
residents and the students.
Last year, when funding
for the intergenerational
program ended, SBSC
reached out to its donors to
help support the transportation costs. The response
was overwhelming, and
resulted in enough funds to
support this program for
another four years!

Sheriff Hagerty reports
that Sun., Dec. 21, at
approximately 12:51 am
Wright
County
the
Sheriffs Office communications center received a
call of a snowmobile accident with injuries on
Lake.
Upon
Ramsey
arrival deputies found that
the accident occurred along
the shoreline near 5626
33rd St NW in Maple Lake
Township.
The accident involved a
single Polaris 800 Edge
snowmobile being driven
by Charles Webb, 20
Maple Lake, and his passenger Reid Ferguson, 21

St. Francis.
Deputies observed that
parties at the scene had
begun CPR on Ferguson,
who was unresponsive and
not breathing. Deputies
assisted with CPR and
administered an AED
(automated external defibrillator).
Maple Lake Rescue and
Allina Ambulance arrived
on scene and took over
medical treatment. Shortly
thereafter Reid Ferguson
was pronounced deceased
at the scene. Charles Webb
was treated for unknown
internal injuries and transported by Allina to Buffalo
Hospital. Webb was later
transferred
to
North
Memorial Hospital and
arrested for Criminal

Vehicular Homicide. Webb


will be booked into the
Wright County Jail after
being released from the
hospital.
Preliminary investigation reveals that Webb and
Ferguson were traveling at
a high rate of speed on
Ramsey Lake approaching
the shoreline, when Webb
attempted to stop suddenly,
throwing both Webb and
Ferguson from the sled.
Neither
Webb
nor
Ferguson were wearing
helmets. It is also believed
that alcohol was a factor in
the accident. An investigation is being conducted by
the
Wright
County
Investigations Unit and
Recreational Services Unit.

Frivolous lawsuits and awards of attorneys fees

We hear about them all of
the time, usually on TMZ
or Entertainment Tonight:
seemingly-frivolous lawsuits. I just read that a
model-contestant who lost
on a reality tv show sued
one of the shows judges
who found out she had
been employed by an
escort service. We all
oppose frivolous lawsuits.
They waste the litigants
time and money. They
waste judicial resources, so
they waste your tax dollars.
But one persons frivolous
lawsuit is another persons access to justice. The
U.S. Constitution provides
the right of citizens to petition for a redress of grievances which has origins in
the Magna Carta in
England in 1215 A.D., and
is referred to in the
Declaration of Independence.
The widely-discussed
example of a frivolous lawsuit is the woman who
spilled hot coffee in her lap
at the McDonalds drive-up
window. But was it as frivolous as everyone seems to
have concluded?
Here are the facts as
reported in The Wall Street
Journal: the plaintiff in this
matter was an 81-year-old
woman. She spent seven
days in the hospital treating
the third-degree burns and
having skin grafts. It was
the policy of McDonalds
to brew the coffee at 195 to
205 degrees and hold the

degrees. Additionally, in
the ten years prior to this
case, McDonalds had
received 700 reports of
coffee burns and had settled some for more than
$500,000. The plaintiff
stated that the reason why
she brought the suit was
that McDonalds dismissed
her requests for compensation for medical bills with
an offer of $800. Plaintiff
continued to try to settle
the case, but McDonalds
did not accept the offers,
including the recommendation of the mediator, so the
case went to a jury trial.
The jurors eventually
found that the plaintiff was
20% negligent for opening
the coffee on her lap and
McDonalds was 80% negligent. The jury awarded
the plaintiff $160,000 in
compensatory
damages
and $2.7 million in punitive damages. The judge
reduced the punitive damages to $480,000, and the
parties eventually settled
on a sum less than
$600,000.
Under our American system of justice the ability to
collect attorneys fees if
you win your case and are
the prevailing party is
severely limited, considerably more so than under the
British system, from which
our common law is
derived.
Under the
English rule, the prevailing partys attorneys fees
are largely paid by the
loser. This rule has been
adopted by the State of
Alaska.

In Minnesota, by comparison, the winning party


in a lawsuit generally can
only obtain an award of
their attorneys fees against
the losing party if such an
award is allowed either in a
written contract between
the parties or by a statute.
For example, the court may
award attorneys fees to a
party in a divorce case
because it is allowed by
statute. Attorneys fees
may be awarded based on
the inequality of the
incomes of the parties
(income-based fees) or
based upon misconduct by
one against the other in the
litigation itself (conductbased fees). Misconduct
could include failure to
timely pay court-ordered
child support or spousal
maintenance, failure to
comply with court-ordered
child visitation, or failure
to answer an attorneys discovery requests about
income, property, debts
and other aspects of the
partys circumstances.
Contract-based attorneys
fee awards are based upon
a breach of a written contract providing for an
award of attorneys fees
and costs if a lawsuit is
necessary.
Common
examples include lawsuits
to collect unpaid rent under
a house or apartment lease,
to collect a down payment
on a contract to purchase
real estate, and to collect an
unpaid credit card debt.
Awards of attorneys fees
must be reasonable and
based upon the amount of
legal services provided to

to complete her service
learning hours as she
worked towards her degree
in community psychology.

after graduation, Jessica

care unit. Jessica went
back to school to obtain her
masters degree in gerontology and became certified in dementia care; she
