Tony,
As a CONSTITUTIONALIST my first concern always is the true meaning and
application of the constitution.
As you are aware Hayat Boumeddine the girlfriend of the dead terrorist Amedy Coulibaly
involved in the killing of hostages in France, as well as a policewoman.

Yet, this woman is also shown with a Burqa when using firearms. As I have previously eluded to
the Burqa has been used by both men and women to commit terrorist attacks and now this
woman using a burqa could be standing next to the police and they wouldnt know she was so.

In my view, both the States and the Commonwealth should have legislation in place that where
there is a requirement or deemed need by the authorities to demand facial identities then all
people using head/facial cover shall be required to remove them or not use them for such period
of time the authorities have declared this to be required, albeit on medical grounds a specialist
may excuse a person to wear a medically required face/head cover. Currently, I view if the same
situation were to occur in the Commonwealth of Australia it would take significant time to get
such kind of legislation in place law enforcement authorities have no time to waste till politicians
say finally come back from their overseas trips to attend to parliament and then having to wait
for the second reading before it can be passed to become legislation.

Recognising that some people may require for medical reasons a face/head cover, such as
bandage ass result of injuries of an accident, etc, what however would be possible is for the law
enforcement authorities to immediately declare say a 48 hour period, upon a terrorist act having
eventuated, so as to avoid any men or woman using the Burqa or similar garb as a way to escape.

In my view the Commonwealth of Australia would be entitled to provide for such legislation for
national security purposes and the 48 hours may be extended by 48 hours period for such time as
the authorities may deem appropriate for search for any terrorist.
Obviously the face/head cover wouldnt be restricted to the usage of a Burqa but would include
any other clothing used to prevent identification. It would also give the law enforcement
authorities to stop vehicles and as any of the occupants to reveal their faces.
Because of laws regarding helmets, it should be provided for that the motorist or other traveller
using a helmet for safety reasons as required by law cannot be deemed to be in breach of such 48
hour requirements provided such a person only uses the helmet while actually by law so required
to use it and when requested to remove the helmet does so.
In my view the above being for security reasons would therefore not be by the Commonwealth of
Australia (as the States are not bound by s116) a violation of s116 of the constitution.
What is however noticeable is that Cherif and Said Kouachi as well as Amedy Coulibaly were
not only known to the USA but also to the French authorities as suspected terrorist, in fact one
was convicted already for it. It seems that like in the Commonwealth of Australia with Monis
(Lindt caf) the security authorities simply failed to do their job and innocent people died as a
result. Throwing more monies to the security organisations isnt going to resolve the sheer
incompetence in fact we saw since the alleged WMD (Weapons of mass Destruction) that the
security organisation either failed or deliberately ignored to act appropriately. We had an
avalanche of legislation upon ordinary citizens and yet the real culprits the security organisations
are perhaps deliberately such horrific events to go on so that they might be able to elicit more
funding for themselves. This kind of so to say white flag operation was often used by many
countries, and realistically seems to be what is happening in the Commonwealth of Australia.
And one may ask why do we need security forces when somehow terrorist are leaving their ID
(Identification) at the scene of the crime? Perhaps because they know security organisations are
mere political tools for the government and nothing to do with security of the People, and so
knowing how incompetent they are and remain to be they assist by leaving their identification
behind. Like, catch me if you can? Then again, could it be that too often identification are
strangely located at the scene of the crime so perhaps after the criminals are silenced they cannot
really state if they were put up to it by some, well perhaps security organisation? Can you really
trust those security people as once you are dead only your family might realise you were not that
safe yourself? Time to consider how secure are you with your security staff, while you still can!
