MUNICIPAL RESOLUTION NO. 027-2014

GRANTING AUTHORITY TO THE HIGHEST RANKING MEMBER OF THE SANGGUNIANG
BAYAN OF GUINOBATAN, ALBAY, HONORABLE COUNCILOR CARLOMAGNO P. FLORES,
TO SIGN WARRANTS, CHECKS DISBURSEMENT VOUCHERS AND ALL OTHER OFFICIAL
TRANSACTIONS INTENDED FOR THE OPERATION OF THE SANGGUNIANG BAYAN, IN
VIEW OF THE LEAVE OF ABSENCE OF THE HONORABLE VICE-MAYOR JULIO S. TINGZON
IV EFFECTIVE TODAY UNTIL HIS RESUMPTION TO OFFICE.

WHEREAS,
the Honorable Vice-Mayor Julio S. Tingzon IV has filed his Leave of
Absence (Annex A) due to physical reasons, i.e. medical condition ,effective today, February 24,
2014, thus, there exists a temporary vacancy in the Office of the Vice Mayor;
WHEREAS,
the Department of the Interior and Local Government (DILG) has issued
DILG Opinion No. 8, S. 2006, where it applied the case of Menzon vs. Petilla (19 SCRA 25), in a
similar situation, where the Supreme Court enunciated, that: x x x to obviate the dilemma resulting
from an interregnum created by the temporary vacancy in (said office), the mode of succession for
permanent vacancy in the Office of the Vice (Governor) may be analogously applied. Accordingly
the highest ranking sanggunian member shall now assume temporarily as Acting Vice (Governor);
WHEREAS,
due to the importance, necessity and indispensability of the position of
Vice-Mayor in the Offices of the Sangguniang Bayan and the SB Secretariat and Vice-Mayor,
among others, granting authority to the appropriate official to sign for and in behalf of the ViceMayor such documents and all other official transactions above-mentioned pertaining to the Office
of the Sangguniang Bayan, is necessary and appropriate for the continuance of the transactions
therein;
WHEREFORE, in view of the foregoing premises, be it now:

RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in

session assembled, to grant as it hereby grants Authority to the Highest Ranking Member of the
Sangguniang Bayan of Guinobatan, Albay, Honorable Councilor Carlomagno P. Flores, to sign
warrants, checks, disbursement vouchers and all other official transactions intended for the
operation of the Sangguniang Bayan, in view of the Leave of Absence of the Honorable Vice-Mayor
Julio S. Tingzon IV effective today until his resumption to office.
RESOLVED FURHER, that the authority herein granted shall automatically cease upon a
declaration by the Vice-Mayor, Hon. Julio S. Tingzon IV, that he has reported back to office.
RESOLVED FURTHERMORE, that a copy of this resolution be furnished all concerned
offices/agencies, for their information and guidance.
APPROVED UNANIMOUSLY on motion of the Majority Floor Leader, Honorable Councilor
Frances John M. Oxales and duly seconded by the members present this 24 th day of February,
2014 during their 8th Regular Session.
