    FilingforanH1Bvisapetitionisnotsimplyamatteroffindingajobandasponsoringemployer.Thereismuch
    moretotheprocessanditisnotone,whichshouldbetakenlightlybytheprospectiveemployeeoremployer.

    Evenifafullydocumentedandextensivelydetailedcaseisprepared,USCIS(previouslyINS)mayhavequestions
    aboutthenatureoftheduties,thetitleandthedesignationofaspecialtyoccupationworkertitle.F1visastudents
    andH1Bworkersareconsidered professionals.

    Assuch,theforeseeablequestionaboutaleapfromanF1studentwithlimitedpracticaltrainingexperienceto
    thatofaseasonedprofessionalwithaminimumoftwoyearsofexperienceinthefieldmayresultinquestionsand
    dialoguebetweenthepetitionerandthegovernment.

    Thesequestionsareusuallyaddressedina RequestforEvidence (RFE)andcanbeextensive.Dependingonthe


    ServiceCenterandanumberofotherfactors,anRFEcanbeonerous.Onesuchresponsetoaninitialfilingmay

    requestevidenceoftheemployer sabilitytohireandpaythewagesofanH1Bworker.Itmayalsoaskfor
    evidencethattheofferedjobis,indeed,aspecialtyoccupationworker.

    Ifthecompanyisrelativelynewandhasfewemployees,USCISmaywantevidencethatthecompanyispresently
    engagedintheregular,systematicandcontinuousprovisionofgoodsandservices andthattheemployerhas
    sufficientworkandresourcesavailabletoprovethatthebeneficiarywillbe performingservicesinaspecialty
    occupation fortherequestedperiodoftime.
    Inresponsetosucharequest,anemployermayberequiredtofurnishincometaxreturns,quarterlytaxreturns,
    copiesofpurchasecontractsand/orpurchaseordersandinvoices.Anannualreportmayberequestedaswellasa
    companybrochuredescribingtheproductsandservicesthecompanyprovides.

    Afewyearsago,many boilerplate RFE'salsorequestedphotographsofthepremisestoestablishthelegitimacy


    oftheorganization.ThistypeofRFEis backinaction andarequestmaycontainthistypeofintrusive
    documentationtoestablishtheveracityofthefiling.

    Anemployermaybeaskedhowmanyotheremployeesholdsimilarpositionswithintheorganizationandthe
    numberofthosewhoholdbachelorsdegrees.BCISmayaskforabreakdownofthefieldsofstudyofsuch
    individualsandrequestanotherdetailedstatementofthebeneficiary sproposeddutiesandresponsibilities.

    Anotherkeyquestionmayreferencedetailingtheeducationalrequirementsforthejobofferedandastatement
    regardingthebeneficiary seducationandhowitrelatesspecificallytothepositionoffered.

    TheaboveinformationisbasedonyearsofexperienceandknowledgeoftheprioritiesofUSCISandDOL.The
    inquiriesmayormaynotappearinyourparticularcase;theimportantthingtorememberisto doyour
