We to you in connection with the above-captioned matter.
On ______________, you submitted to our company,
MIROBENI PROPERTY HOLDINGS, INC., a Reservation
Application for Units No. 1519 and 1521 of the Birch Tower (Subject
Property) located at Jorge Bocobo St., Malate, Manila. The Subject
Property were likewise the subject of a Contract to Sell dated
_______________ executed between you and our company.
According to said Reservation Application and Contract to Sell, the
agreed contract price for the Subject Property was Three Million Eight
Hundred Eighty Thousand Seven Hundred Seventy Six and
60/100 Pesos (PhP 3,880,776.60), net of the 5% discount, to be paid
under the following terms:

44/100 Pesos (PhP 216,215.44).
You are well reminded that under the Contract to Sell executed for
the purchase of the Subject Property, your failure to make payment of your
monthly amortization entitles our company to charge a penalty interest of
two percent (2%) per month, without prejudice to other remedies available
to our company. (par. 2, Contract to Sell)

Further, default on your part in the payment of any installment


due, entitles our company to cause the cancellation or rescission of the
Contract to Sell in accordance with the provision of the Contract and
applicable laws. In the event of such cancellation, all your paid
installments shall be deemed waived and/or ceded in favor of our
company, as liquidated damages. (par. 8, Contract to Sell)
We are now giving you an opportunity to settle your outstanding
accountabilities to avoid the consequences of default. You are given a
grace period of sixty (60) days from receipt hereof to settle your monthly
amortizations in arrears plus the penalty interest of 2% per month for each

According to said Reservation Application and Contract to Sell, the
agreed contract price for the Subject Property was One Million Seven
Hundred Thirty One Thousand Three Hundred Seventy Five
(PhP 1,731,375.00), net of the 5% discount, to be paid under the

You are well reminded that under the Contract to Sell executed for
the purchase of the Subject Property, your failure to make payment of your

monthly amortization entitles our company to charge a penalty interest of


two percent (2%) per month, without prejudice to other remedies available

Further, default on your part in the payment of any installment
due, entitles our company to cause the cancellation or rescission of the
