TOPIC: OCCUPATIONAL SAFETY AND HEALTH ACT (OSHA 514)

OBJECTIVE:
The objective of this topic is to provide basic understanding and appreciation of OSHA
(Act 514) and relevant acts, which include Act 139 (Factory & Machinery Act), Act 5178/85
(Building By-Laws).

1. INSTRUCTION:
a)

An appreciation of the relevant Acts, (514, 139, 5178/85) have to be given to


trainees and the relevant contents, as suggested in this Information Sheet.
(i) ACT (514) 1994 Occupational Safety and Health Act : An Act for securing
the safety, health and welfare of persons at work, for protecting others
against risks to safety or health in connection with the activities of persons at
work. (OSHA 1994 (Act 514), page 5 ILBS).
(ii) ACT (139) 1967 Factories and Machinery Act 1967: An Act to provide for
the control of factories with respect to matters relating to the safety, health
and welfare and inspection of machinery and for matters connected
therewith. ( F&M 1967 (Act 139), page 1, ILBS)

b)

For the purpose of this module, the ACTs mentioned above have to be readily
available for the trainees. The publisher is International Law Book ServicesILBS and the titles are as described above. The information in the subsequent
topics are referred to the ACTs, where relevant clauses of the Acts are inserted
in this IS. Please note that, the clauses of the ACTs inserted are for reference
purposes, hence please refer to the ACT booklet for detail and completeness.

c)

The relevant clauses are, Part VI, (Section 24), Part VII (Section 29, 30, 31).
This clauses are referring to General Duties of an employee, Health and Safety
Officer and Setting up of Safety and Health Committee.

2. EMPLOYEE RESPONSIBILTIES, HEALTH & SAFETY OFFICER (SHO) AND


HEALTH & SAFETY COMMITTEE
2.1 OBJECTIVE
This topic is to describe the employees responsibilities, in particular with
respect to the understanding of function of Safety & Health Committee and
Safety & Health Officer. (Refer to ACT 514, Part VI, Section 24(1)
a) General Duties Of Employees At Work.
It shall be the duty of every employee while at work to :(i)

To take reasonable care for the safety and health of himself


and of other persons who may be affected by his acts or omissions at
work.

(ii)

To co-operate with his employer or any other person in the


discharge of any duty or requirement imposed on the employer or that
other person by this Act or any regulation made there under.

(iii)

To wear or use at all times any protective equipment or clothing


provided by the employer for the purpose of preventing risks to his
safety and health

(iv)

To comply with any instruction or measure on occupational


safety and health instituted by his employer or any other person by
or under this Act or any regulation made there under.

An occupier who contravenes the provisions of this section shall be


guilty of an offence and shall, on conviction, be liable to a fine not
exceeding five thousand ringgit or to a term of imprisonment not
exceeding six months or to both.

Establishment Of Safety And Health Committee At Place Of Work


(i)

Every employer shall establish a safety and health committee at


the place of work in accordance with this section if ;
there are forty or more persons employed at the place of work or,
the Director General directs the establishment of such a
committee at the place of work.

(ii)

The composition of a safety and health committee established


under subsection (1) of Act 514, the election or appointment of
persons to the committee, the powers of the members of the
committee and any other matter relating to the establishment or
procedure of the committee shall be as prescribed.

(iii)

Every employer shall consult the safety and health committee with
a view to the making and maintenance of arrangements which will
enable him and his employees to co-operate effectively in promoting
and developing measures to ensure the safety and health at the
place of work of the employees and in checking the effectiveness of
such measures.

(iv)

A person who contravenes the provisions of this section shall be


guilty of an offence and shall, on thousand ringgit or to imprisonment
for a term not exceeding six months or to both.
The safety & health committee established at a place of work
pursuant to ACT 514, Section 30.

(v)

Shall keep under review the measures taken to ensure the safety and
health of persons.

(vi)

Shall investigate any matter at the place of work : Which a member of the committee or a person employed threat
considers is not safe or is a risk to health.

(vii)

Which has been brought to the attention of the employer.
