MUNICIPAL ORDINANCE NO. 06-2012

AMENDING ORDINANCE NOS. 01-2006 AND 010-2011, TO INCLUDE THEREIN
RELEVANT PROVISIONS AS TO THE RATES OF RENTAL AND GOODWILL FOR
THE NEWLY CONSTRUCTED FRUIT STANDS/STALLS AT THEGUINOBATAN
PUBLICE MARKET, GUINOBATAN, ALBAY, THEREBY CORRESPONDINGLY
AMENDING RELEVANT PROVISIONS OF ORDINANCE NO. 08-1996, AS AMENDED,
OTHERWISE KNOWN AS THE MARKET CODE OF GUINOBATAN, ALBAY.

BE IT ORDAINED, by the Sangguniang Bayan of Guinobatan, Albay in session assembled

that:
SECTION 1. Amendatory Provisions.
a. Section 1 of Ordinance No. 01-2006 is hereby amended by including the following
provisions, and thus to read as follows:
24. GOODWILL PAYMENT x x x e.) others. Provided, however, that the
performance bond for the applicants of the newly constructed Fruit
Stands/Stalls located at the Bayan Muna Building of the Guinobatan Public
Market, Guinobatan, Albay, shall be fixed at Five Thousand Pesos
(PhP5,000.00) per stall, and thus, shall no longer be subject to bidding. This
performance bond shall be due and demandable from the qualified new
applicants upon approval of the Award and from the occupants of the stalls
near the Guinobatan Sports Center upon approval of this Ordinance.
b. Section 2 of Ordinance No. 01-2006 is also hereby amended by including the following
provision, and thus to read as follows:
E. x x x The proceeds of this goodwill payment shall accrue to the following: 50%
to the General Fund and 50% for the operation of the Guinobatan Public Market.
Provided, that proceeds of the goodwill payment for Fruit Stands/Stalls shall
accrue entirely for the operation of the Guinobatan Public Market.

In the case of the losing bidders, their performance bond shall be returned a week
after a winner has been declared, except for new applicants for Fruit
Stands/Stalls where bidding is not required.
c. Section 7 of Ordinance No. 010-2011, is also hereby amended to read as follows:
Rental Fee. The rental per month for the existing occupants from the stalls
near the Guinobatan Sports Center shall be Four Hundred Pesos (PhP400.00)
per space/stall with a grace period of one (1) month from the date of official
transfer last August 25, 2012. For the new applicants, payment of the same
shall start a month after the award of the stall. Provided, that starting January
1, 2013, the rental per month shall be fixed at Five Hundred Pesos (PhP500.00)
per space/stall.
SECTION 2. Separability Clause. If, for any reason or reasons, any part or provision of this
Ordinance shall be held to be unconstitutional or invalid, other parts or provisions
hereof which are not affected thereby shall continue to be in full force and effect.
SECTION 3. Repealing Clause. Municipal Ordinance No. 08-1996 and any other ordinances or
part or parts thereof which are inconsistent with any of the provisions of this
Ordinance are hereby amended or modified accordingly.
SECTION 4. Effectivity. This ordinance shall take effect immediately upon its approval.
