MUNICIPAL ORDINANCE NO. 014-2014


AUTHORIZING THE TRAFFIC LAW ENFORCERS OF THE MUNICIPALITY OF
GUINOBATAN, ALBAY TO DETACH THE TRICYCLE PLATE ISSUED BY THE
MUNICIPALITY FROM THE TRICYCLE UNIT WHOSE DRIVERS CONTINOUSLY
LOAD PASSENGERS NOT FROM THE OFFICIALLY DESIGNATED PARADA/
PARKING AREA.

WHEREAS, many drivers of tricycle for hire were clamouring that while they
faithfully follow the Parada Ordinance, still many others do not pick-up passengers on
the legitimate parade/parking area;
WHEREAS, this practice by erring drivers put the income of drivers who
religiously park and wait passengers at the officially designated parada at a
disadvantage or losing position thereby earning less or unfairly as compared to those
who engage themselves in a manner called layog-layog;
WHEREAS, it was noted that some drivers deliberately or maliciously violate the
law so that the very purpose of the ordinance to have an orderly parada in Guinobatan
is frustrated;
WHEREAS, to put an end to this unfair and unjust practice of some, withdrawal
of the issued tricycle plates to operate from the violators is perceived to be an effective
means to ensure compliance by all drivers of the mandate of the ordinance.
WHEREFORE, in view of the foregoing premises,
BE IT ORDAINED BY THE SANGGUNIANG BAYAN IN SESSION
ASSEMBLED, THAT:
SECTION 1. AUTHORITY OF TRAFFIC LAW ENFORCERS TO DETACH
TRICYCLE PLATES. All traffic law enforcers of Guinobatan, Albay, including the
members of the Philippine National Police are hereby authorized to detach tricycle
plates issued by the Municipal Government from the tricycle units whose drivers are
caught loading passengers not from their officially designated parade or parking area.

SECTION 2. DISPOSITION OF DETACHED TRICYCLE PLATES AND


PENALTIES.
a. All tricycle plates detached by any of the authorized personnel shall be
deposited at the Treasurers Office together with the citation ticket for
safekeeping until claimed by the legitimate operator and/or driver by paying
the following fines as penalties:
First Offense
- Php 200.00
Second Offense
- Php 500.00
Third Offense
- Php 1,000.00
Succeeding Offenses
- Php 1,500.00
b. Failure on the part of the tricycle operator and/or driver to claim the tricycle
plate within 30 days from the date it was withdrawn or detached shall be
ground for the cancellation of the tricycle franchise.
SECTION 3. SEPARABILTY CLAUSE. If, for any reason/s, any part/s of this
Ordinance shall be held to be unconstitutional or invalid, other parts or provisions hereof
which are not affected thereby shall continue to be in full force and effect.
SECTION 4. REPEALING CLAUSE. Any ordinance or part/s thereof which are
inconsistent with any of the provisions of this ordinance are hereby repealed, amended
or modified accordingly.
SECTION 5. EFFECTIVITY. This ordinance shall take effect upon its approval.
