THEDIPLOMATICDIMENSION
Inthemid2000s,Vietnamincreaseditseffortstodevelopits
offshorepetroleumindustryincooperationwithforeignoil
companies.Between2006and2007,Chinarespondedbyissuing18
diplomaticobjectionstoforeignoilcompaniesinvolvedinthese
explorationanddevelopmentprojects
InMay2006,forexample,theIndiannationaloilcompany,Oiland
NaturalGasCompanyVidesh,signedaproductionsharingcontract
withPetroVietnamforblocksinthePhuKhanhbasin.China
claimedthatONGCsprojectfellwithinadisputedareaoftheSouth
ChinaSeaandwasthusillegal.
InJuly2008,asVietnamesedevelopmenteffortscontinued,reports
surfacedthatChinahadbeguntodirectlythreatenforeignoil
companiesinvestinginVietnam.
ChinasfirstdiplomaticnotecontestingVietnamandMalaysias
submissionsincludedamapoftheregionthatdepictedtheParacel
andSpratlyIslandsalongwiththeninedashedline.Althoughthe
Chinesenotedidnotmentiontheline,Vietnamviewedthemapas
anexpansionofChinasclaims.
COMMERCIALACTIVITYANDCIVILMARITIMELAW
ENFORCEMENT
Asstatesassertedanddefendedtheirclaimsthroughdiplomacy
since2006,theyalsosoughttodemonstrateandenforcethe
maritimerightsthattheyclaimed.Inparticular,countrieshave
soughttoexercisetheserightsthroughcommercialfishingand
hydrocarbonexplorationactivities.
Fishing
Duringthepastdecade,Chinahasstrengtheneditsabilityto
supervisefishinginthedisputedwatersandtoenforceitsdomestic
fishinglaws.TheprincipalChineseagencytaskedwiththismission
istheSouthSeaRegionFisheriesAdministrationBureauSSRFAB.
InadditiontoregulatingChinasdomesticfishingindustryinthe
SouthChinaSea,theSSRFABhastwoobjectivesthataffectthe
disputesovermaritimerights.First,SSRFABvesselsescortChinese
fishingboatswhentheyoperateindisputedwaters.Second,the
SSRFABseekstopreventforeignshipsfromoperatingwithin
ChinasclaimedEEZ.Inthepastdecade,theSSRFABhassteadily
increaseditspresenceintheSouthChinaSea.
ThecombinationofincreasedVietnamesefishingoperationsanda
strengthenedSSRFABresultedinagrowingnumberof
confrontationsatsea.In2008and2009,SSRFABvessels
confrontedandexpelledmorethan135and147foreignboats,
respectively,mostofwhichwerelikelyVietnamese.
ThepracticeofdetainingVietnamesefishingboatshaltedin2011,
butChinacontinuestoconfiscatethecatchesofshipsitclaimsare
operatinginChinesewatersaroundtheParacels.
Petroleum
Similardynamicsaffecttheexplorationactivitiesofoilcompaniesin
disputedwaters.Inthefirsthalfof2011,Chinainterferedwith
seismicsurveysconductedbyVietnamandthePhilippineswithin
theirclaimedEEZs.ChinasMarineSurveillanceForce(MSF)has
beentheprincipalChineseagencyinvolvedinthisseriesof
confrontations.
MSFistosafeguardmaritimerightsandinterests,inadditionto
enforcingChineselawsregardingmaritimeaffairs.
Inthefirsthalfof2011,however,MSFshipswereinvolvedintwo
separateincidentsinwhichtheychallengedanddisruptedseismic
surveyactivitiesbyVietnamandthePhilippines.
ThefirstincidentoccurredinMarch,whentwoMSFvessels
expelledaPhilippineseismicsurveyvesselintheReedBankarea
inthenorthwesternportionoftheSpratlyIslands.
ThesecondincidentoccurredinlateMay,whenanMSFshipcut
acrossthesternoftheseismicsurveyvesselBinhMinh2,ownedby
PetroVietnam,andsevereditstowedcable.Accordingto
Vietnamesereports,threeMSFvesselshadbeenshadowingtheBinh
Minh2,whichwasoperating120nauticalmilesoffthecoastof
centralVietnam.
Theseconfrontationsdemonstratethreeimportantpointsaboutthe
competitionovermaritimerights.
First,Chinaescalateditseffortstoexerciseandenforceitsmaritime
rightswhenitseveredthosecables.
Second,theofficialresponsetotheMayincidentfromChinas
MinistryofForeignAffairs(MFA)suggeststhatthecablecutting
wasintendedtodeterVietnamfromassertingitsclaimsandto
bolsterChinasownclaimtojurisdiction.
Third,allthreeincidentsoccurredaftersurveyactivitybyother
claimantsincreased,underscoringthedynamicnatureofthecurrent
competitionovermaritimerights.
