    OnJanuary13,2015,theChulaVistaCityCouncilappointedSteveMiesentofilla2yearvacancyonthe

    council.Theproblemis,forthepast10+years,Miesenhasbeenthechiefofficeratapublicprivate
    partnershipwiththecity.HeisthedivisionmanagerforRepublicWaste(formerlyAlliedWaste/Pacific
    Waste).TrashcollectionismandatorywithRepublicforeverypropertyowner.Thecitynegotiatestherates
    andtermswithRepublic,andifpropertyownersdonotpaytheirtrashbill,thecitybeginscollection
    proceedings,holdshearings,andplacesliensondelinquentproperties.Miesenandtopmanagersofhis
    companyhavedonatedheavilytothecampaignsofthecityattorney,themayor,andallofthe
    Councilmembers.Hehasdonatedtoregionalandstateofficialsaswell.InSeptember2014,hesatacross
    thetablefromthecitycouncilandnegotiatedanew5year,solesourcecontract.Then,lessthanthree
    monthslater,inDecember2014,heappliedtofillacitycouncilvacancy,alongwith43otherhighly
    qualifiedapplicants(aformermayor,formerportcommissioner,formerplanningcommissioners,former
    chamberofcommercedirectors,etc.).Hewasvettedalongwiththeothersbasedoninformationprovided
    onhis1090disclosure,whichstatedthatheownedbetween$2K$10KofRepublicstock.Thecity
    attorneypubliclyadmittedthatheonlyvettedMiesenfor1090violationsandnotincompatibleoffice,
    CommonLawDoctrine,nordidhedoathoroughreviewofallCOIissues.TwoCouncilmembersraised
    theissuesthattheappointmentwouldn'tsitwellwiththegeneralpublic,buttheyvotedyesonMiesen
    becausetheycouldn'tagreeonanyoneelseamongstthe44applicants.
    If.Miesenvotestoincreasedensityinacondocomplex,howwillresidentsknowheisn'tadvocatingfor
    moreRepubliccustomers?IfMiesendeclinesacitizenrequestfornewtrafficsignals,howwillresidents
    knowheisn'ttryingtosavefuelforhisfleetoftrucks?IfMiesenvotesonroadconstruction,orvotesto
    approveorchangetheGrowthManagementOversightthreshholds(traffic,police/fireresponse,etc.)will
    hebeadvocatingforthecitizensofChulaVistaorRepublicWaste?Infact,ifacitizenhasissueswithtrash
    collection,garbagespillsfromRepublictrucksthatblowthroughoutthecity,etc.,iftheycallSteveMiesen
    forhelp,willtheybecallingtheheadofRepublicortheircitycouncilpersonwhooverseesthatcontract
    directly?
    WeneedtheAG'shelpinChulaVista.Wehavetriedtoresolvethislocallywiththecityattorney,butare
    awarethatthisissueneedstobevettedbytheAGandtheAGONLY.Miesenhasreadlocalnewsstories,
    editorials,comments,etc.abouthisappointmentandhasapparentlyspokentothecityattorneyabouthow
    hewilltransitiontoadifferentrolewithinRepublic,butthatisnotgoodenough,astheappointmentand
    histimeoncouncilshouldbereversedbasedonhisobviousCOIandincompatibleofficeissues.
    Finally,aboutadecadeago,aformerportcommissioner,DavidMalcolm,alsodidconsultingworkfor
    DukeEnergy.Malcolmconductedhisbusinessintheopen,andattorneysfortheportdistrictallowedhim
    toservebothroles.MalcolmendedupgoingtojailforCOI.Citizensbelievethatourlocalelectricutility
    assistedintheprosecutionofMalcolm,asMalcolmwasadvocatingagainsttheminfavorofDukeEnergy.
    HereinChulaVista,therewasn'tanothertrashhaulerthatbidonthewastecontractwiththecity.Republic
    isnotonlythesolesourcecontractor,butalsoappearsnottohaveanycompetitionthatcouldaidthe
    citizensinChulaVistabyadvocatingforfairnessandimpartialityonourCityCouncil.
    Thankyouforyourtimeandconsideration.Wedearlyneedyourhelp.AsIinterpretedtherulesintheCOI
    manual,anydecisionthatismadewhileMiesenisoncitycouncilcanbechallengedatalaterdate.Ourcity
    cannotaffordthisliability.
