GEN. ORDINANCE NO. 01-2013

FURTHER AMENDING SOME PROVISIONS OF MUNICIPAL ORDINANCE NO. 01-2001, AS
AMENDED, OTHERWISE KNOWN AS THE TOWN FIESTA ORDINANCE OF GUINOBATAN,
ALBAY.

Be it Ordained by the Sangguniang Bayan of Guinobatan, Albay, that:
Section 1. Amendatory Provisions.
(a) Section 2 of Municipal Ordinance No. 01-2001, as amended by Municipal Ordinance
No. 05-2011, is hereby further amended to include another area or portion of public
street to be temporarily lifted from public servitude during fiesta season to be
designated as letter (f), and to read as follows:
SECTION 2. MUNICIPAL ROADS/STREETS TO BE CLOSED. The following
municipal roads and/or streets are hereby lifted from public servitude or closed
temporarily from July 20 August 20, to be utilized by transient vendors and as
area/space for feria, rides, and parlor games every fiesta celebration of the
municipality, to wit:

e. xxx; and,
f. Portion of Ola Street from corner Mabini Street to Rizal Street.
(b) Section 3, paragraph (a) is further amended by injecting the following provisions after
the second paragraph, to read as follows:

a. xxx. Provided furthermore, that the rate of those spaces to be rented out around
the town plaza, more particularly from Space No. 01 to Space No. 26, shall be higher
than the rest, considering that the area is considered prime, and therefore, shall have
an omnibus fee of P12,500.00 each and not Php 6,400.00. These spaces, numbering
about 26, shall be rented out on first come, first served basis and not by package deal
to insure fairness and equality among the applicants during the scheduled date, time
and place of awarding set by the awards committee or ordinance which in this case,
due to a very limited time, is hereby set/fixed on July 17, 2013 at 9:00 A.M. at the
Sangguniang Bayan Session Hall. Provided furthermore, that in the year 2014 and
thereafter, all the herein spaces to be rented out by the LGU during fiesta season shall
be done on first come, first served basis already and not anymore by package deal on
the date, time and place fixed/set herein by this ordinance except those areas for feria,
rides, etc. which is subject for bidding under a floor price of Php150,000.00.
(c) Section 3, paragraph (e) is hereby amended by inserting another provision/sentence
after the first sentence to read as follows:
e. xxx. However, the extension fee for the rented spaces around the Town Plaza,
more particularly from Space No. 01 to Space No. 26 shall be higher than the rest at
P200.00 per day and not Php 150.00. The term extension as used in this ordinance
shall mean, before July 20 but not earlier than the awarding date, and/or after August
20 of every year but shall in no case beyond, August 31.
(d) Section 4, paragraph (b) is hereby further amended to read as follows:
b. Starting 2014 and every year thereafter, the following shall be the date/day, time
and place for the awarding of the following spaces to be rented out by the LGU during
fiesta season, to wit:

(e) Section 4, paragraph (f) is likewise amended by adding another provision after the
first sentence to read as follows:
f. Provided however, that on the 2 nd Monday of July at 1:00 P.M. the members of the
awards committee shall already meet at the Office of the Mayor/Chairman to prepare
and thresh out all the issues and needs during the awarding process on the following
days.
(f) Section 4, paragraph (g) is likewise amended to read as follows:
g. Awarding of space/s outside the date/day, time and place fixed/set herein by the
ordinance and made without the presence of any of the member or their authorized
representatives shall be null and void and shall be a ground for dismissal or
disciplinary action of employee/s responsible therefor. Reservation of space is strictly
prohibited and declared illegal.

Section 2. Separability Clause. If, for any reason or reasons, any part or provision of this
ordinance shall be held to be unconstitutional or invalid, other part/s hereof which are
not affected thereby shall continue to be in full force and effect.
Section 3. Repealing Clause. Any ordinance or part or parts thereof which are inconsistent with
any of the provision/s of this ordinance are hereby repealed or modified accordingly.
Section 4. Effectivity. This ordinance shall take effect immediately upon its approval.
Enacted. July 16, 2013 on third/final reading.
