What is modernism? The most outstanding answer surfaces Reason, then what is Reason?The
answer is a man made system, which is the indicator of modern civilization. Who is civilized? Pat
reverberates the mind-a person or group which follows certain norms of civilization .And then
Civilization?-A consensus of a majority group at a certain point of
an act or behavior of a group or person who/which has

for certain perspective. If it is

upon to follow a code, at a certain point

of time with a certain motif in mind; it is naturally an outcome of affect, because affect is contagious. If
modernism has an indicator like affect, then why come appears an artificial dichotomy between affect
and modernity .We can stretch the definition of modernity up to an extent where the relics of
romanticism also play with the reason, and it becomes

blend of emotion and reason. Reason-we can

draw, is only a surface reality .It is an imaginary membrane which needs to be broken for innovation
.Modernism has emerged from the intellectual class, who in the perspective of a binary logic has

condemned the models of non-intellectuals, and the non-followers of a set pattern in the act of an
intellectual gymnastic, and have imposed their values

those who are culturally and intellectually less

privileged. Here modernity has trampled the emotions of less modern or not modern, and their
affects get a new direction silence; be it positive by making it stronger ,or negative-by just nipping it
in the bud. When a commoner moves forward to the intellectual citadels of the modernist tradition i.e.
the established reason of the day ,which, let us say, the artifacts of supremacy, that ignores it out,
prima facie, taking it as other(of the postmodernist connotations). It all happened with the Dalit class
in India.

1 . Ram and Ghanshyam acting under statutory power, opened a manhole in a street in
order to do underground telephone repairs. Above the manhole their workmen placed a
tent, and rounded the tent they placed warning paraffin lamps. At five oclock one
winter evening all the workmen left for tea. Two boys of eight and ten years came

along, took a lamp and entered the manhole. As they emerged, the lamp was knocked
into the hole and a violent explosion took place, with flames shooting 30 feet into the
air. The boys sustained serious burns because of the explosion.
The guardians of the boys want to file a suit against Ram and Ghanshyam and have
approached you for legal advice. Provide them proper advice on the law applicable
with the help of relevant decided cases.
2 . Marie Stopes advocated the use of birth control and had established a clinic in London.
Mr. Shaw wrote a book in which he alleged that the cla
ing advantage of
the poor and he referred to her monstrous campaign. Marie Stopes files a suit of
defamation against Mr. Shaw.
Mr. Shaw comes to you for legal advice on the defences of defamation. Explain to him
all the defences of defamation, also advice him which defence he can avail and what
has to be established to get the defence.
3 . Mr. Gregory was developing a site in New York and was using a tower crane in the
construction work. The jib of the crane swung over Mr. Pipers property.
Mr. Piper wants to bring a tort case against Mr. Gregory which tort will provide remedy
to him. Elaborately explain the tort and its defences with relevant cases.
4 . Susan and her friend were looking at cassettes in a shop. They selected one and took it
to the cash desk and paid for it. She returned to the cassette counter and chatted with
her friend for a while. The store detective, Mr. Yates started observing them, and when
they left the shop with the cassette, he concluded that it had not been paid for. They
went to a caf opposite and Mr. Yates phoned for the police. He told the police of his
