DECISION.

Pleas were presented in relation to these two lots, No 783 Exp 16 and 784 Exp 13.
Margarita Espina ne R., widow claims portions in both lots while siblings Felisa, Rosario
and Jose Fortich claim the entirety of both lots.

There is a question on the boundary between these two lots and the evidence
presented clearly show that the claimant Margarita Espina ne R., widow is the proprietor
and is in possession of portions in both lots, corresponding to the land she, about 13 years
ago, had acquired by inheritance from her deceased mother Basilia Gene de Jesus. The
portion of Margarita Espina ne R., widow in lot 783 is shown as Portion B in the sketch
marked Exhibit A prepared by the surveyor of the Bureau of Lands for this court to make
the record corresponding to lot 783 as well as the portion corresponding to the same claim in
lot 784 of Exp. 13 labelled as Portion B in the same Exhibit A.

The two parts identified as Portion A in both lots in the sketch marked Exhibit A
belong to the Fortich siblings who inherited these from their deceased parents many years
ago.

Court Decision

The Director of Lands is hereby ordered, upon payment of corresponding fees by the
claimant Margarita Espina ne R., widow, to subdivide lot 783 Exp. 16 into two portions
illustrated in the sketch Exhibit A. Portion B will be determined by drawing a line from
Point No. 1 of Lot 783 until it reaches line or side 2-3 of the same lot, at a point that is more
or less 20 meters away from Point No.3 or the line that is made by a wire fence currently
present in the area.

The Director of Lands is hereby ordered, upon payment of corresponding fees by the
claimant Margarita Espina ne R., widow, to subdivde Lot No. 784 Exp 13 into to two
portions as per the sketch in Exhibit A. Portion B of Lot No. 784 will be determined by
drawing a curved line from the point where the line that subdivides Lot 783 ends as
described above, following the curve of a stream at midpoint, in a way that this curved line
encloses all of the currently present nipal field.

Portion A of Lot No. 783 is awarded and to be registered as co-owned, in equal parts
by FelisaFortich, of legal age, married to NarcisoOberjes, Rosario Fortich, of legal age,
married to AnastacioEncarnacion, and Jose Fortich, of Legal age and married to
LibradaCesta, all residents of the Municipality of Surigao, Surigao.

Portion B of Lot 783 is to awarded and to be registered in favor of Margarita Espina,

ne R., widow, of legal and and a resident of the Municipality of Surigao, Surigao

Portion A of Lot No. 784 is awarded and to be registered as co-owned, in equal parts
by siblings Felisa, Rosario and Jose Fortich as their private property, and, Portion B of Lot
No. 784 is awarded and to be registered in favor of Margarita Espina, ne R, widow, of legal
age and a resident of the Municipality of Surigao, Surigao.
