Thanks for your question. I ran it by the City Attorney, who said:
If your organization has to comply with Oaklands Living Wage Ordinance, then you do need
to comply with the higher rate, which is $14.10 for non-benefited employees.

Thank you for taking the time to complete our brief survey that is assisting us in analyzing
the applicability of Measure FF to participants in your program. As you know, effective
March 2, 2015, any employee who works at least two (2) hours in a particular workweek and
in the geographic boundaries of the city of Oakland is entitled to at least the minimum wage
of $12.25/hour. These employees are similarly entitled to paid sick leave that accrues on an
hourly basis. For more information on the Citys new minimum wage, click here.
We are relying on your responses as the foundation for our analysis into your program and
Measure FF. If you responded that participants are considered employees, then contact your
program officer to negotiate an appropriate budget amendment since you will need to comply

with Measure FF if you do not already do so.


Some of you informed us that your participants are not treated as nor are they considered
employees and then subsequently, however, indicated that although the participants are not
employees, they are paid on an hourly basis and receive a Form W2 at the end of the year. It
is important that you ensure your participants are properly classified under the law, and in
turn, are compensated appropriately. Thus, you may wish to consult legal counsel to confirm
the legal accuracy of your responses. If you choose to do so, please do not hesitate in letting
us know if any of your responses differ from your initial response.
Note that grantees within similar funded strategies area may view participants differently,
leading to the possibility that participants may be paid at different rates for similar City of
Oakland funded program.
