DANIEL ANDREWS & LABOR

OF LIES, CONFUSION,
EXCUSES AND SPIN

100 days of lies, confusion, excuses and spin

Foreword

01

Dear Reader,
The first hundred days of the Daniel Andrews Government has been characterised by lies,
confusion, excuses and spin.
It has also shown the two faces of Daniel Andrews one prepared to say anything to win the
election and the other after the election, lying and trying to spin his way out of trouble.
Three days before the election, Daniel Andrews told Victorians that the East West Link contracts
werent worth the paper they were written on. But after the election, and under pressure, he
admitted that Victorian taxpayers would be liable for compensation because of his actions.
Also before the election, Daniel Andrews said his proposed West Gate Distributor was ready to go.
But after the election, we learn that it is probably years from ready with planning, approvals and land
acquisitions not yet finalised.
The two faces of Daniel Andrews are creating confusion not just for Victorians but also for
international investors who are now concerned about doing business in our great state. That means
we are at risk of losing out on future job-generating projects as well as much needed infrastructure.
And when Daniel Andrews isnt lying and changing his position and creating confusion, hes
making excuses.
In only his first 100 days, Daniel Andrews is already making excuses for being unable to deliver
projects that he claimed only days before the election were fully funded and costed. According to
him, the federal government must fund the promises he has made like the Metro Rail Tunnel, the
West Gate Distributor and level crossing removals.
But what Daniel Andrews and Labor dont understand is that you cannot create jobs without a strong
economy that attracts investment. You cannot create a strong economy without a strong plan.
The Opposition is united, hungry and relentless in exposing the Andrews Labor Government every
time it makes a decision that fails Victorians. Over the next 3 years and 9 months, I am determined
to prosecute the case for change with a comprehensive plan for a strong economy and a stronger
job market that provides opportunities and prosperity for all Victorians.
Yours sincerely,

Hon Matthew Guy MP

Leader of the Opposition
Leader of the Liberal Party

The Economy
What Victoria faces...

Slower economic growth

Higher unemployment
Surplus & AAA rating under threat
Daniel Andrews has done more damage to the Victorian
economy in just his first 100 days than Steve Bracks and
John Brumby did in over 11 years.
With his reckless threat to tear up the $6.8 billion East
West Link contract, Daniel Andrews has sent a message
to international investors that Victoria is a risky place
to do business. In future, major investors will baulk at
signing contracts with the Victorian Government. And if
investors and major employers do decide to sign a major
contract with the Victorian Government, there is a real
likelihood they will add a risk premium because of the
reputational damage.

Already, there are signs that business confidence is low

and our economy is slowing under Labor. In the Budget
Update released on 23 December 2014, surplus forecasts
under Daniel Andrews were estimated to be around
$1 billion less than under the Coalition and net debt
expected to rise to 4.8% to 2018. The Budget Update
also forecasted slower economic growth and higher
unemployment.
There are already signs that Victorias Triple A credit
rating is at risk, which is bad news for further investment
and jobs growth.

Restaurateurs vow to close doors

BUSINESSES are set to sign
petitions against the State
Governments new AFL public
holiday while restaurants vow
to close their doors on the
newly gazetted day off.
Former Bulldogs great and
restaurateur Paul Dimattina
has joined the chorus of
disgruntled owners, furious
over the Governments decision to make Grand Final Eve
and Easter Sunday official
public holidays.
Ive spoken to at least 10
friends who own restaurants in
the CBD and they just said
they wont open because they
cant afford the penalty rates,
Mr Dimattina said.
Theres just absolutely no
point (opening).
Its very frustrating.

His four restaurants in Carlton, Melbourne and Southbank DiMattinas, Il

Gambero, Society Restaurant
and Blue Train will close on
both of the newly gazetted
public holidays, putting 50
staff out of work for the day.
His decision comes after his
restaurants lost money on
Australia Day, a day the city
turned into a ghost town.
Restaurants and Catering
Australia predicted half of
Melbournes
restaurants
would close on Grand Final
Eve on October 2 because of
penalties at double time and a
half, leaving tourists with few
options to eat out.
Mr Dimattina said he was

surprised the Government followed through with its preelection Grand Final Friday
promise.
I had (Opposition Leader)
Matthew Guy the other day
dining at one of the restaurants
and we were actually having a
laugh (about Grand Final Friday), he said.
I just cant believe theyre
bringing it in. Its frustrating
because it feels like these forces are working against you.
Australian Industry Group
Victorian director Tim Piper
said he would continue to
lobby the Government in a bid
to reverse its decision.
This is an issue that has
galvanised employers, he said.

Real people, losing real jobs is one of the human costs to Daniel
Andrews decision to recklessly tear up the East West Link contract.

East West Link

2/19/2015

Now it emerges that the Andrews Labor

Government could have to pay up to
$1.2 billion in compensation to the
consortia that is contracted to build
the Link.
Daniel Andrews likes to claim that the
East West Link contract should not have
been signed because he had opposed
the project before the election. But
the fact is, Daniel Andrews decision to
openly oppose the EWL project was
only done at the 11th hour. For years
before that announcement, Labor had
effectively supported stages 1 and 2 of
the East West Link project and indeed
the Brumby Government of which
Daniel Andrews was a senior member
commissioned the Eddington review
which recommended the East West Link.
And when then Treasurer Michael
OBrien announced the EWL in the May
2013 budget, Daniel Andrews did not
say he would tear up the East West Link
project. Indeed, for the next 16 months,
Daniel Andrews said that the Labor Party
wouldnt oppose the East West Link.

The Age 04/02/15

Herald Sun 19/02/15

On the Neil Mitchell program, three days

before the election, Daniel Andrews said
that the East West Link contract was
not worth the paper it was written on
and that no compensation was payable.

a
complex legal plan to render the
East West Link contract unenforceable and will instead rely on
a potentially expensive settlement
deal with the consortium to extricate itself from the project.
In the lead-up to last years state
election, Labor repeatedly claimed
the contract to build the road was
not worth the paper it is written
on and could not be entered into
safely.
To make the case, the then opposition relied on advice from former Federal Court judge Ray Finkelstein and administrative law expert Richard Niall, QC. It concluded that if Supreme Court action against the project by Moreland and Yarra councils were successful, the contract would be
unenforceable.
Labors plan at the time was to
support the councils case if it won
the election, rather than defend the
project. Under those circumstances, Labor believed the councils legal challenge would be likely
to succeed.
But since winning the election,
Labor appears to have backed
away from the bold plan. It is believed this followed advice from the
Department of Treasury and Finance conrming the former government did in fact have inherent
powers to enter into the contract.
As revealed in The Age, Treasury
also facilitated a separate side letter, providing the consortium

Treasurer Tim Pallas did not address a series of questions from

The Age, including whether it remained Labors intention to rely on
the councils court action to render
the contracts invalid by not ghting the case, and whether Labor
stood by its original legal advice.
Instead a spokeswoman said:
The government is currently
working with the East West Connect consortium towards a fair and
appropriate outcome for Victorian
taxpayers.
The councils court case was
scheduled to be heard about two
weeks after the state election. But
the looming battle was deferred
after lawyers acting for the Andrews government asked for more
time. A new hearing date has not
been set.
Moreland City Council chief executive Nerina Di Lorenzo said the
council had a standing resolution
to proceed with the legal action.

That hasnt changed, she said.

A Yarra City Council spokeswoman said the matter was currently adjourned. We havent
heard from the state government
at this stage, she said.
Mr Andrews said Labor would
honour its commitment not to proceed with the contract.
But as you know were in the
middle of important discussions
with the winning bidders, he said
And were just working through
this with much more care to get
Victorians out of this mess than
the previous government took getting us all into it.
Opposition Leader Matthew
Guy said Mr Andrews needed to be
up front with Victorians about
whether he was lying when he told
voters he believed the contract was
not worth the paper it was written
on. Clearly Labors decision to engage in negotiations shows what he
said before the election and what
he is doing after the election are
two different things, Mr Guy said.

The West Gate Distributor (WGD) is estimated to
take only 5,000 trucks a day off the road and will
now cost $680 million to build.
By comparison, the East West Link is estimated to
take 50,000 vehicles a day off the road and will
cost Victorian taxpayers $2 billion.
And what was trumpeted by Daniel Andrews in 2014
as a shovel-ready project, has now been found
to be anything but shovel-ready with planning

What Daniel Andrews
says and what are the
facts on Melbourne
Metro Rail Tunnel:
Labors $300 million Melbourne Metro
commitment in the 2015-16 budget will:

complete the planning, design

and early works of Melbourne
Metro Rail.
Yet, Labor promised to budget only $3 billion out
of the $9 billion total cost for Melbourne Metro.
Februarys $40 million announcement is just 0.4%
of the total $9,000 million cost of the project.
The tunnel is proposed to be 8.5km in length.
So 0.4% of this length would be just 38 metres
of tunnel length.

What Matthew Guy

said on Labors
announcement:
This is just more Labor media
stuntocracy from Daniel Andrews.
Hes announced 0.4% of the funding,
thats enough for 38 metres of track.
Daniel Andrews is really setting a record in
Australian politics as being the first Government to
not only spend two months re-announcing projects
of the former Coalition Government but now he
chooses to re-announcing announcements made by
the Brumby Government. Its really quite bizarre.
Daniel Andrews announcement today is a hoax. To
provide fast tracking works of $40m that was already
budgeted in the last budget, for a project that wont
commence for another few years and to establish yet
another Government authority, really just shows to
Victorians that hes all smoke and mirrors.

This announcement (Metro Rail) is a hoax.

Metro Rail Project

Some key facts on MRT:

Claim: Daniel Andrews criticised the Coalition for
cutting four new stations on the Melbourne
Rail Link route.
Labor has cut three of the Coalitions funded
new metro stations. Now, it will not be possible
to interchange from South Yarra Station to
Labors Melbourne Metro route. The Coalitions
Melbourne Rail Link included an underground
station interchange at South Yarra.
Claim: Labor say MRT will have five new stations.
It will only have three new stations. CBD
North is an extension of Melbourne Central
Station, and CBD South is an extension of
Flinders St Station. Arden Station is proposed
to be in the middle of an industrial area.
Claim: Labor promised a new station at the Royal
Childrens Hospital.
The Melbourne Metro does not provide for a
station at the Royal Childrens Hospital. The
planned Parkville Station is nearly 1km away
from the RCH, and Labors proposed Arden
Station is 1.2km away.
Claim: Labor says an EOI for Melbourne Metro will
start in 2016, and has committed only $40
million thus far.
The Coalitions Melbourne Rail Link was
funded with $830m in the 2014-15 budget,
with construction starting in 2016.
Claim: Labor says it needs two years to do
immediate planning works, complete
development of the Reference Design and
undertake detailed site investigations.
This project has been planned and designed
in detail already.
Claim: D
 aniel Andrews criticised the Coalitions
Melbourne Rail Link, because Pakenham and
Cranbourne trains will no longer run through

Labors Melbourne Metro will have
Cranbourne and Pakenham trains only
stopping at Flinders St and Melbourne

Health
What Victoria faces...

In his first 100 days, Daniel Andrews has been

caught with his hand in the cookie jar pinching
money out of the health and hospital budgets.
Hes also been caught out as a hypocrite. Before
the election, Daniel Andrews when asked about a
helipad for Monash Childrens Hospital, said:

Herald Sun 19/01/15

of the local area.
11 November 2014:

Herald Sun 26/02/15

Andrews also said that removing the helipad

amounted to:

Budget blunder

And the Andrews Labor Government

announcement that Easter Sunday will be declared
a public holiday also threatens to effectively leave
a hole in Victorian hospital budgets.
The effect of declaring Easter Sunday a public
holiday will mean that all nurses and other hospital
workers who are rostered that day will receive
higher penalty rates. That means a large financial
cost that is unbudgeted for these hospitals.
This is just another example of Daniel Andrews not
thinking things through before he does something.
Daniel Andrews has cut a life-saving helipad for the Monash.

and new benefits like 8 hours pay for 21 minutes overtime.
All up, the new deal reportedly equals $1.6 billion.
And in January, in a press release on whooping cough,
the Andrews Government announced in the final
sentence that they were abolishing the Construction
Code Compliance Unit which ensures worker safety and
the rule of law on building sites.

Victorian taxpayers are also already losing out because

Daniel Andrews has started to return his union favours.
He has already settled with the Ambulance union with
an offer that on the face of it matched the former
Coalition Governments offer but it also included a
number of secret side deals.

One of the effects of Daniel Andrews decision to

abolish the Construction Code Compliance Unit is that
workers are no longer required to be drug tested on
worksites. So, on the one hand Daniel Andrews says that
there is an Ice epidemic, but on the other hand he is
failing to protect the safety of workers on construction
sites who may be at risk from fellow workers who are
under the influence.

And now, other unions such as the notorious HSU and

the CFMEU are preparing to list their demands to Daniel
Andrews for hefty pay rises and special benefits. This
will cost Victorians money and jobs.

Work sites drug danger

Builders warn scrapping tests will risk workers

STEPHEN DRILL
VICTORIAN building sites
will be more dangerous when
mandatory drug and alcohol
testing is removed under a
Labor Government plan,
builders say.
The Master Builders Association says safety will be
compromised when the State
Government rips up rules that
helped rid the industry of illicit
drugs and booze.
The removal of testing
comes as the Andrews Government brings in new rules to
breathalyse parliamentarians
returning from long lunches.
Radley de Silva, the associations executive director, said
drug and alcohol abuse was a
significant problem in the construction industry.
Removing mandatory drug
and alcohol testing jeopardises
the safety of every construction
worker on every building site
across the state, Mr de Silva
said. If the State Government
is going to boot out boozy MPs
from parliament, it should certainly weed out intoxicated,
stoned or high workers from
at-risk building sites.

Blanket drug testing on

building sites was introduced
in July last year.
The code was one of the former Liberal Governments signature policies and was aimed
at improving safety and reducing building costs.
Shadow minister for industrial relations Robert Clark
said it was disgraceful that
Daniel Andrews was prepared
to put the wishes of his
CFMEU mates ahead of the
safety of ordinary workers.
By scrapping drug and alcohol screening, Labor is undermining the fight against the
spread of ice and other drugs
on building sites and is putting
workers at increased risk of injury or death, Mr Clark said.
A 2012 study by the Sustainable Built Environment National Research Centre found
11 per cent of building workers
had used cannabis and 4.6 per
cent had used ecstasy or methamphetamine in the previous
24 hours.
The Construction, Forestry,
Mining and Energy Union, the

building
company
John
Holland, and Master Builders
were among the reports project partners.
But the CFMEU has consistently rejected mandatory
drug testing, fighting against it
at Fair Work Australia and in
the Federal Court.
Mr Andrews pledged before
the election to introduce
breath testing for MPs when
they sit in parliament. A parliamentary committee is considering the plan.
Helen
McInerney,
a
spokeswoman for Finance
Minister Robin Scott, said:
While the Victorian Codes
drug and alcohol testing requirements no longer apply,
contractors must have occupational health and safety
policies and procedures to
meet legislative and regulatory
requirements.
A CFMEU spokesman said:
The CFMEU does not believe
that drug and alcohol policies
should be developed on an ad
hoc basis nor should this safety
issue be a political football.

Promised no compensation for EWL cancellation - now planning up to $1.2 billion compensation.

Continue with the EWL legal case, to ensure the government loses the case to render the project invalid Broken: government instead asked the local councils to adjourn the case.

as valid as they have not continued with the Supreme Court case they said would render it invalid).

Abolished Linking Melbourne Authority - after promising to keep it.

Andrews promised he would do before Christmas.
