COLLEGE CHAPTER
(SPE ANUC) CONSTITUTION REVIEW

PREAMBLE:
Acknowledging the majesty of God and his hand in all affairs of humanity, whiles upholding the
rule of law and the right of every society to govern itself, Aware of our potential to play a
leading role and be a vehicle of progress in the search of petroleum resources and its
development for energy in Ghana and the world as a whole, Pursuing our goals of attaining the
highest standards in our social, cultural, intellectual, spiritual and political affairs, and
Endeavouring to perpetuate the ideals of our motto, RESOURCEFUL ENERGY FOR
INDUSTRIAL DEVELOPMENT, we members of the Society of petroleum engineers (ANUC)
- SPE do hereby adopt this constitution on this day of .2012.

AIMS AND ASPIRATIONS


The aims and aspirations of SPE ANUC shall be
1. To foster closer relations amongst its members and to promote their welfare,
academically, socially and morally;
2. To promote the study of Oil and Gas Engineering and its role in the development of
the country through symposia, industrial trips, seminars etc. ;
3. To promote the exploration and production industry through the research of cost
effective and environmental friendly techniques for oil and gas production

ARTICLE 1: SUPREMACY OF THE CONSTITUTION


1. This constitution shall be the highest law for the governance of SPE-ANUC, and any
other
constitution and or law found in any Society or Club in the Department of Oil
and gas Engineering found to be inconsistent with any provision in this constitution
shall to the extent of the inconsistency be null and void.

ARTICLE 2: ENFORCEMENT OF THE CONSTITUTION


1. Any student who alleges
a. An act of omission of any person
b. Any constitution, decision, resolution of anybody or society under SPE ANUC is
inconsistent or contravenes any provision in this constitution may bring an
action for a declaration to that effect.
2. The Judicial Committee for the purpose of article 2(1) shall make a declaration to that
effect.
3. Failure to obey or carry out the order or declaration made under article 2(2) constitutes a
violation of this constitution and in the case of an executive officer grounds for his
removal from office.

ARTICLE 3: NAME OF THE ASSOCIATION AND MOTTO


The name of the association shall be Society Of Petroleum Engineers ANUC, here in after
referred to as SPE-ANUC.
The motto of the association shall be Resourceful Energy for Industrial Development.

ARTICLE 4: MEMBERSHIP
1. Every student of the Oil and Gas Engineering Department ANUC is a default member of
SPE;
2. At the end of the course program, active members shall have associate membership
conferred on them;
3. Interested members of the university staff and individuals may also apply to the
Executive Committee for associate membership;
4. The Executive Committee shall confer honorary membership on individuals who have
been supportive of SPE ANUC in consultation with members of SPE.

ARTICLE 5: STRUCTURE OF SPE-ANUC


1. The structure of SPE ANUC is as below
a. The General Assembly
b. The Executive Council
c. The Executive Committee
d. The Judicial Committee
e. The Electoral Commission

ARTICLE 6: THE GENERAL ASSEMBLY


1. The General Assembly shall comprise all undergraduate students of the Department
a. The Assembly shall be the highest authority of SPE ANUC.
2. Functions
The General Assembly shall:
a. Meet at least twice a semester to discuss matters concerning the association
b. Receive and deliberate on the audit report of the association and refer all matters
arising from such deliberations to the appropriate committee for action(s) to be taken.
c. Have authority to summon any Executive Committee and or Council members to
report, explain and or inform the General Assembly on any matter concerning SPE
ANUC.
d. When in recess the Executive Committee shall act for and on its behalf.
e. Without prejudice to article 6(2) paragraph d, the General Assembly shall have the
power to approve or disapprove of a decision taken on its behalf by the Executive
Committee.

ARTICLE 7: THE EXECUTIVE COUNCIL


1. There shall be an executive council comprising the following officers of SPE-ANUC
a. The Executive Committee members
b. Patrons
c. Class Representatives
2. Functions
a. Meet at least twice a semester to discuss matters concerning SPE-ANUC and other
matters referred to it by the Executive Committee
b. Approve budgets and other major contributions proposed by the Executive
Committee
c. Discuss projects, seminars etc. to be undertaken

ARTICLE 8: THE EXECUTIVE COMMITTEE


1. It shall comprise:
a. The President
b. The Vice President
c. The General Secretary
d. The Financial Secretary
e. The Organising Secretary
f. The Public Relations Officer/Editor-in-Chief
2. Functions:
a. The Executive Committee shall be responsible for the day to day administration of
SPE.
b. Executive meeting shall be convened by the General Secretary in consultation with
the President
c. The quorum for an Executive Committee meeting is four(4)
d. The following officers of the executive council shall, however, be appointed by the
executive committee:
i. The Judicial Committee Chairman
ii. Electoral Commissioner
iii.
Audit Committee Chairman
iv. Sports Committee Chairman
v. Entertainment Committee Chairman

ARTICLE 9: THE PRESIDENT


1.

He shall be elected by the general student body in an organised election

2.

Duties:
a. He shall head all SPE ANUC delegations as well as the chief spokesperson of SPEANUC in all matters coming under his jurisdiction
b. He shall preside over SPE-ANUC meetings
c. He shall be a signatory to the bank account of the association
d. He shall in consultation with the other Executive Officers unless otherwise stated in
this constitution, appoint chairperson(s) or other members of SPE-ANUC
Committees
e. He shall countersign all vouchers and money bills issued in the name of SPE-ANUC

ARTICLE 10: THE VICE PRESIDENT


1. He shall be elected by the student body in an organised election
2. Duties:
a. He shall assume the office of the president when the President is
i. Incapacitated
ii. By reason of resignation/removal from office or other permanent reasons
that renders the office of the Presidency vacant
iii.
He shall receive guest on behalf of the association
b. He shall act as ex-officio member of all committees of SPE-ANUC with the
exception of the independent committees
c. He shall assist the President in the discharge of his duties
d. He shall also perform any other functions assigned to him by SPE-ANUC and or
the President.

ARTICLE 11: THE GENERAL SECRETARY


1. He shall be elected by the student body in an organised election
2. Duties:
a. He shall under the direction of the president or executive meeting summon
meetings stating the agenda
b. He shall keep records of all proceedings at such meetings
c. He shall be in charge of correspondence of the association
d. He shall be a signatory to the bank accounts of the association;

ARTICLE 12: THE FINANCIAL SECRETARY


1. He shall be elected by the student body in an organised election
2. Duties:
a. He shall keep true and proper records of all the associations financial dealings
and shall be authorised to collect dues from all members of the association

b. He shall render accounts to the association whenever required and at the end of
each semester;
c. He shall deposit all monies collected in the associations account
d. He shall be custodian of all SPE-ANUC cheque and cash books
e. He shall publish the financial statement of the association on the departments
notice boards at least two weeks into each semester and a month to vacation
f. Inability to fulfil article 12(2) paragraph e, for legitimate reasons shall do so
within fourteen days (14) of the next semester, provided the academic year would
not have ended by then.
g. He in conjunction with the finance committee set up by the executive committee
shall come out with plans on how to solicit for funds.

ARTICLE 13: THE ORGANISING SECRETARY


1. He shall be elected by the student body in an organised election
2. Duties:
a. He shall be responsible for the organisation of SPE-ANUC functions, meetings,
field trips and all other general programs of SPE-ANUC
b. He shall liaise between the Organising, Sports Committee, Entertainment
Committee and the Executive Committee
c. He shall keep account of the assets of the association.

ARTICLE 14: THE PUBLIC RELATIONS OFFICER/EDITOR-INCHIEF


1. He shall be elected by the student body in an organised election
2. Duties:
a. He shall be the Chairman of the Editorial Board
b. He shall appoint an editorial board of four (4) members comprising a member
each from the various classes and himself, subject to the approval of the
Executive Committee
c. He shall be responsible for all SPE-ANUC publications i.e. Newsletters,
magazines etc.
d. He shall in conjunction with the General Secretary work to publicize all SPEANUC activities
e. In the absence of the secretary he shall act as the secretary.

ARTICLE 15: OTHER EXECUTIVE COUNCIL MEMBERS


1. Class Representatives
a. They shall serve on the executive council of SPE-ANUC and represent the
supreme interest of the members of their year group.
2. Sports Committee Chairman
a. He shall form a 5-member sports committee comprising of a member from each
class and be the head of this committee;
b. He, together with the organizing secretary shall organize sporting activities for
SPE-ANUC members.

ARTICLE 16: THE JUDICIAL COMMITTEE


1. This will be an independent body of four (4), the chairperson inclusive
2. The Chairperson will be appointed by the President with approval by the Executive
Committee who shall then appoint other three members preferably one from each class:
a. He shall be Head of the Judicial Committee
b. He shall reserve the right to empanel members of the Committee to hear cases
c. He shall perform other duties provided for under this constitution

3. DUTIES:
a. Shall have the original jurisdiction in every matter relating to the interpretation
and enforcement of any provision in this constitution
b. Shall have appellate power in every issue relating to resolving of conflicts
between students or group of student of the association.
c. The committee shall have jurisdiction over all impeachment procedures initiated
against any executive member
d. The committee shall have the power to prescribe punitive measures based on the
constitution against any dissenting member of the association provided the
measure so prescribe is enforceable
e. The committee shall have sovereign power over all election petitions lodged with
the Electoral commission and all constitutional matters.
f. Committee rulings must be published within 14 days of hearing.

ARTICLE 17: THE ELECTORAL COMMISSION


1. This will be an independent body of five with the chairman inclusive.

2. There shall be an electoral commission who shall be appointed by the president with
approval from the executive committee
3. All other member of the electoral committee shall also be appointed and approved by the
executive committee
4. DUTIES
a. It shall run and oversee all SPE-ANUC elections
b. Without prejudice to any provision in this constitution, the electoral commission
in consultation with the judicial commissioner may draft rules and regulations to
cover all SPE-ANUC elections.
c. It shall publish on all notice boards the rules and regulations governing the
conduct of all SPE-ANUC Elections.

ARTICLE 18: OTHER BOARDS/COMMITTEES


1. Finance Committee
a. The finance committee shall be appointed by the executive committee
b. The finance secretary shall be the chairperson of the committee
c. It shall be a four-member committee, the financial secretary inclusive
2. Audit Committee
a. There shall be an audit committee each year comprising at least three members of
SPE-ANUC who shall audit the account of SPE-ANUC chapter before the end of
the tenure of office of a batch of executives
b. Members of the Audit committee shall be appointed by the Executive Council.
3. Editorial Board
a. The Editor-in-Chief shall be the chairperson
b. The Board shall be responsible for the publication of articles and magazines and
also be responsible for the writing, collection and editing of articles for the annual
magazine
c. The Board is to come up with a name for the freshman class
d. Each annual magazine shall carry the name of the senior class
4. Ad-hoc Committee
a. The executive committee shall have the power to create an ad-hoc committee to
deal with any matter in pursuance of its aim

ARTICLE 19: CONDUCT OF ELECTIONS


1. Eligibility:
a. Any student who will be eligible for election must have been in the Oil and Gas
Engineering Department for at least one (1) academic year. Final year students
are not eligible;

b. Any student who has been found guilty of embezzlement and or misappropriation
of students or university funds shall not qualify to stand and contest elections
c. Any student who has once been voted out of office in this university shall not
qualify to stand and contest elections.
d. Any student who qualify to contest elections and intend to contest any position
shall make available two (2) recent passport sized photographs for himself
accompanied with duly filed nomination form and CV to the Electoral
Commissioner not later than the specified date and time by the Electoral
Commissioner
e. Candidates shall pick up a form and be seconded by two (2) other students of the
department;
f. The candidate shall acquiesce to his nomination by appending his signature on
the nomination forms received from the electoral commissioner.
g. In the case of an Executive Officer, he/she shall resign his/her position
permanently at least 24 hours before filing of nomination.
2. Screening:
a. Any student who wishes to stand and contest elections shall submit himself to the
electoral commission for thorough screening
b. The Electoral Commissioner shall be required to publish on all notice boards, full
report for all candidates so screened at least three days before elections day, such
a report shall not give the ranking for the candidates
c. The Screening Committee shall have the power to recommend or otherwise any
candidates so screened.
3. Elections:
a. All officers shall be elected by a simple majority vote unless otherwise stated in
this constitution.
b. Election of officers shall take place after the SRC elections;
c. Outgoing officers shall be eligible for re-election except final year students;
d. Each officer shall hold one office alone in SPE-ANUC for one academic year
after which fresh elections shall be held.
e. Each year group shall elect their class representatives
f. At the close of nominations, where only one candidate has been duly nominated
for a particular office he/she shall be declared elected after obtaining fifty per
cent (50%) plus one (+1) of the valid vote cast during a general or bye-elections.
g. Where candidate who stands unopposed fails to achieve the required percentage,
fresh nominations shall be opened within two days after the final declaration of
results by the Electoral Commissioner
h. If no nominations are received after opening of fresh nominations, the electoral
commissioner will declare the unopposed candidate as having won the election.

i. Voters shall come along with a valid students ID card or SPE ID card.
4. Other:
a. In case of a tie, new elections shall be held for those candidates involved, within
forty-eight (48) hours from the time of the first elections;
b. Any candidate(s) who shall be guilty of an electoral malpractice shall be asked to
withdraw from the elections by the electoral commissioner;
c. The electoral commission shall conduct thorough screening for the candidates
who are nominated;
d. The electoral commission shall present a report of the screening exercise to SPEANUC (displayed on the notice board).

ARTICLE 20: BYE-ELECTIONS


1. In the case of an elected position becoming vacant the electoral commission shall
immediately upon acknowledging such a situation start a process to provide the
association with a replacement for the vacant position as per the statutes of this
constitution for the election officers
2. Such bye-elections shall however not occur when the position become vacant a month to
a general election. Under such circumstances the particular body within which the
vacancy has occurred is given the mandate to appoint in consultation with the executive
committee on of their own members to assume responsibility for the vacancy so created.
3. Any executive member who wishes to contest in a bye-election will have to permanently
relinquish his status as an executive member

ARTICLE 21: VOTE OF NO CONFIDENCE


1. Any officer shall cease to be a member of the executive committee if a vote of no
confidence is passed on him by 60% of the membership of a general assembly meeting or
if adverse findings are made against him by the judicial commission
2. The officer so affected in clause (1) supra has 3 days upon receipt of the verdict to appeal
to the judicial commission
3. The finding of the judicial commission under clause (3) supra will be deemed final

ARTICLE 22: IMPEACHMENT


1. Any student may by notice in writing addressed to the judicial commission start
impeachment proceeding against all or any member of the executive committee such a
notice shall be authenticated by at least 3 students from each class

2. The judicial committee shall within 14 days of receipt of such a notice investigate and
display its finding on all notice boards
3. Any officer against whom impeachment charges has been preferred shall be removed
officially from office after two-thirds majority of the general assembly present at a
meeting called for such purpose has voted in favour of impeachment charges
4. Committee members without prejudice to the provision above can be removed from
office by the chairperson in consultation with the executive council

ARTICLE 23; RESIGNATION


1. Any officer elected by the general assembly shall communicate his resignation to the
executive committee in writing 7 clear days before such an action takes place
2. Any officer of the association except those elected by the general assembly may resign
their position voluntarily. Any such resignation shall be communicated to the President at
least 7 days
3. When an officer resigns his/her position, the President in consultation with the body
within which the vacancy has occurred will appoint a member to man the position
temporarily until fresh elections are held
4. In the case of en-block resignation of the executive committee the executive council shall
select three (3) members from among them to temporarily run the association until fresh
election are held
5. All officers who resign will within three (3) days after their resignations have taken effect
hand over all the associations properties and documents in their possession to the
President in the case of an en-block resignation of the executive committee same will be
handed over to the Executive Council.

ARTICLES 24: AMENDMENTS


1. Any notice for amendment or revision for any part of this constitution shall be made to
the Judicial Committee who shall debate the merit and demerits of the said notice with
the executive council. In the case of a total review a committee shall be setup by the
judicial committee to collate the views of students and hence come out with a new
document
2. Notice for revision or amendment can be made by the judicial commission or any student
and submitted to the judicial committee in writing. Such a notice shall be supported by a
least seventy (50) students whose signatures shall also be appended thereto.
3. The judicial commission shall within fourteen days of such a valid notice sit to access it
4. In the case of an amendment the executive council in consultation, with the judicial
commission will deliberate on the issues and a report sent to the General Assembly and a
decision take on the proposed amendment. A decision will be taken based on two-thirds
majority of the membership presents agreement

5. For a total review the judicial committee shall organize a referendum


6. The new document will be accepted only after sixty per cent of the valid votes cast are in
agreement with its content.
7. The promulgation of the document will automatically take place three working days after
the referendum.

ARTICLE 25: VACATION OF OFFICE


The office of any member of the Executive Committee shall become vacant:
1.
When he/she resigns from office or is any way incapacitated from performing the
functions of his office;
2.
When a vote of no confidence has been passed by at least sixty per cent (60%) of the
students in the department;
3.
In the event of a vacancy in the Executive Committee an acting officer shall be
appointed by the Executive Committee to fill the vacancy until a by-election is held.

ARTICLE 26: MEETINGS


1. Executive Committee Meetings
a. There shall be a meeting of the Executive Committee within seven (7) days from
the beginning of each semester to draw an agenda for the first general meeting of
SPE-ANUC.
b. They shall plan their meetings to suit them.
2. General Meetings
a. Notices of all general meetings together with their agenda shall be published at
least forty-eight (48) hours before the effective day of the meetings.
b. The President shall have the right to call off a meeting if a quorum is not formed
within a reasonable time limit.
3. Emergency Meetings
a. 30 members of the General Assembly can request an emergency meeting. The
President shall convey such a meeting depending on the issue of emergency by at
least a 24 hour notice is given.
b. The matter to be discussed at such a meeting shall be explicitly stated
c. No other business shall be discussed
4. Quorum
a. The quorum for the general meeting shall consist of fifteen (15) members of SPEANUC excluding executives.

5. Conduct of Meetings
a. A speaker shall direct his speech to the issue under discussion if called upon.
Every member shall address himself to the chair.
b. No member shall be allowed to speak for more than once on a motion, as long as
a member who has not spoken on the motion desires the floor. No member shall
speak for more than three (3) minutes on an issue.
c. The Chairman shall interpret the standing orders. He shall be free to take part in
all discussions.
d. Any more standing orders may, in case of urgency or after notice duly give, be
suspended or changed to another meeting provided that there is a two-thirds
majority in the favour.

ARTICLE 27: STANDING ORDERS FOR MEETINGS


1. Voting
a. Voting shall be by all members of SPE-ANUC
b. Voting privileges shall include the right of members or second motions or
nominations.
c. In voting, motions shall be carried by a simple majority, unless otherwise
provided for by the constitution or the standing orders. The counting of votes shall
be done in the following order; Vote for, Vote against and abstentions. If votes for
and votes against are equal in number, the chairman shall exercise casting.
Members abstaining shall be considered as non-voting.
d. Voting shall be by a show of hands or as determined by the chairman, unless
otherwise stated by the constitution.
2. Motions
a. All members have the right to file motions or proposals.
b. All motions must be submitted in writing and must be handed over to the
chairman.
c. No motion or amendment shall be open for discussion until has been seconded;
but the proposer shall have the right to speak on the motion in order to find a
seconder
d. No matter shall be discussed until it concerns an approved subject to the agenda,
except with permission of the house.
e. A motion shall only be open for discussion or amendment after the proposer and
seconder have had the opportunity to speak in support of the motion.
f. The debate must be limited to the immediately pending question by the Chair. The
Chairman shall rule out of order any speaker failing to adhere to the subject of
discussion.

g. No motion or amendments, which have been accepted by the meeting, shall be


withdrawn without the consent of the meeting neither shall any addendum be
added to a motion once it has been accepted.
h. Discussion of motion (or amendment) may be curtailed in time by a procedural
motion from the floor by the Chair, with the approval of the meeting. If the Chair
intends to curtail discussion, however, he shall be allowed, provided that the
mover and one speaker against such motions in all cases have the right to speak if
wishing to do so.

3. Amendments
a. An amendment, like a main motion, must be moved, seconded and discussed in
accordance with the procedure for the motions outlined above.
b. No amendments shall be moved which, by the Chairmans ruling rescinds,
negates or destroys the original motion.
c. The mover and seconder of a substantive motion shall have the right to accept an
amendment and if accepted, shall become part of the substantive motion.
d. A rejected amendment shall be discussed until the amendment under
consideration has been disposed off. It is, however, permissible for notice of
further amendments to be given during discussion of the original amendment.
e. If an amendment is rejected, other amendments may be moved on the original
motion. If an amendment be carried, the motion as amended shall become the
motion and shall be the question to which any further discussion may be
addressed or upon which the final vote is taken.
4. Order Precedence
a. The Chairman shall allow the following procedural motions to be put when there
is already a proposition on the table, in the following order of precedence:
i. Motion to withdraw motion
ii. Motion to recess
iii. Motion to reverse the decision of the Chair
iv. Motion that a question or proposal not be put
v. Motion to limit or expand debate to a certain specified period of time
vi. Motion to refer the matter to a committee or sub-committee for
investigation and for report
vii. Motion to postpone or adjourn the matter to a later specific meeting time
viii. Motion to close debate
ix. Motion that the motion now be voted on
b. If the motion that the motion now be voted has been seconded, no further
discussion of the original question will be allowed. If the motion is carried, only
the proposer of the original question under discussion shall be allowed to speak
before the original question is put to vote.

c. If the motion to limit the debate to a certain specified period of time is carried,
the chairman shall draw up a list of three (3) members wishing to make their first
speech on the subject and allow each one an equal proportion of the specified
period. The proposer shall be allowed a maximum of two (2) minutes to sum up
before the original motion is put to vote.
d. Should any procedural motion be defeated, minutes shall elapse before such a
motion can be accepted again by the Chair, unless the Chair is of the opinion that
the circumstances have materially altered in the meantime.

5. Other Interventions
a. In an addition to discussion on an issue the Chairman shall recognise those
requesting the floor by the following order of precedence.
i. Point of order
ii. Point of information
iii. Point of correction
b. A point of order which must be heard at all times except during the act of voting,
must deal with the conduct of procedure of the meeting and concern only such
matters as indecorum transgressions of the standing orders, transgression of the
constitution, calling attention to the introduction of a matter not relevant to the
question under consideration and use of improper language.
c. If information is desired from or ordered to a person holding the floor, he may
decide whether or not he wishes to be interrupted at that time.

ARTICLE 28: FINANCE


1. All students of the department shall each pay SPE-ANUC dues per academic year as
approved from time to time by the executive council.
2. SPE-ANUC shall open a current account with a recognised bank where all monies of the
association shall be deposited.
3. The disbursement of SPE-ANUC funds shall be limited to:
a. The provision for such activities the executive committee together with PESA
may approve of
b. Administrative expenditure.
4. Signatories
a. The signatories to the SPE-ANUC bank accounts shall be the president, the
financial secretary/Treasurer and the secretary
b. The association shall cause its amounts to be submitted for auditing by an audit
committee, which shall be formed by the association if the need arises.
5. Accounts

a. Proper statement of account shall be laid before the members when required and
at the end of each term of office

ARTICLE 29: HONORARIA


Certificates of office shall be presented to the officers of SPE-ANUC on the day of handing over
Certificates of honour shall be given to members of the various committees and any outstanding
members of the association that the executive committee deems worthy.

ARTICLE 30: HANDING OVER


All officers or members keeping documents and assets of SPE-ANUC shall hand them over to
their successors on the day of handing over

ARTICLE 31: INTERPRETATION


1. He , His , him , chairman used in this document shall be a generic term referring
to any student male or female
2. The Judicial Commission shall be the only institution that has the jurisdiction and
mandate to interpret any portion of this document. Similarly in the case of matters on
which this document may be silent or ambiguous the same bodys ruling shall be prcised
terms and shall become a precedent or persuasive authority on the entire association, until
amended or revoked in consonance with article 24 of this constitution

Judicial Oath
I ........................ having been appointed/nominated as the commissioner of the judicial
commission do hereby swear to abide by the tenets and principles of the rule of law and natural
justice at all times. I further affirm that I perform the functions of my office without fear or
favour, affection or ill-will, and that I will at all times uphold, preserve, protect and defend the
constitution and laws of SPE-ANUC, so help me God(to be sworn by the judicial commissioner
in front of the general assembly, swearing in to be done by the President)
