wished to see the Swimming Pool continue to operate at the current loss.
Administrator Boulton also explained about
the minimum wage law changes. Once
sorted through and implemented, this

Ordinance #169 Authorizing and Regulating the Conduction of Open Burning


within the City of Wanamingo - 1st Reading - Council discussed adding language
to the Code of Ordinance for burning.
They agreed that the language was what
they were looking for. The Administrator will speak with the commercial property currently burning before consideration of the ordinance at the April City
Council Meeting.
OLD BUSINESS:
Administrator Boulton gave an update on the process for hiring new fire
department fireman. Official notices
have been posted in the Zumbrota Paper. Applications have been accepted
and are now closed as of March 4th.
The hiring committee will conduct interviews and the make recommendations
to the City Council. The Council will
consider the recommendations at the
Council meeting in April.
*Next City Council meeting on 4/13/
2015 at 7:00pm. A discussion took
place about touring City facilities in April
or May. It was decided to tour the main
well house and waste water plant. The
City Council meeting in April may start
earlier in order to accommodate the
tour.

ORDINANCE #169
AN ORDINANCE AUTHORIZING
AND REGULATING THE CONDUCT
OF OPEN BURNING WITHIN THE
CITY OF WANAMINGO, MINNESOTA
The City Council of the City of
Wanamingo, Minnesota, ordains:
That CHAPTER 95: FIRE PREVENTION AND PROTECTION is hereby fully
revoked in its entire and replaced with
CHAPTER 95: OPEN BURNING ORDINANCE as follows:
95.01. ADOPTION OF STATE LAW
BY REFERENCE.
The provisions of Minn. Stat. ch. 88,
as they may be amended from time to
time, with reference to the definition of
terms, conditions of operation, permits,
and all other matters pertaining to open
burning are hereby adopted by reference and are made a part of this ordinance as if set out in full. It is the
intention of the City Council that all future amendments of Minn. Stat. ch. 88,
are hereby adopted by reference or referenced as if they had been in existence
at the time this ordinance was adopted.
95.02. CITY MAY BE MORE RESTRICTIVE THAN STATE LAW.
The Council is authorized to impose,
and has imposed in this ordinance, additional restrictions on open burning within
its limits beyond those contained in Minn.
Stat. ch. 88, as it may be amended from
time to time.
95.03. PURPOSE.
The purpose of this ordinance is to
regulate open burning within the City of
Wanamingo, to protect the public health,
safety and welfare. Through passage of
this ordinance, the designated fire official is hereby authorized to adopt and
impose burning restrictions to aid in the
prevention of wildfire and to consult with
the Department of Natural Resources
(DNR), Division of Forestry to develop
any restrictions or other criteria.
95.04. DEFINITIONS.
For purposes of this ordinance, the
following definitions shall apply unless
the context clearly indicates or requires
a different meaning:
DESIGNATED FIRE OFFICIAL. The Fire
Chief, Fire Marshal, City Fire Warden, or
other designee who provides fire protection or public safety services to the city.
OPEN BURNING. The burning of any
matter if the resulting combustion products are emitted directly into the atmosphere without passing through a stack,
duct or chimney, except a recreational
or camp fire as defined herein. Mobile
cooking devices such as charcoal grills,
wood smokers, manufactured hibachis,
and propane or natural gas devices are
not considered open burning devices.
RECREATIONAL/CAMPFIRE. A fire set
with an approved starter fuel no more
than three (3) feet in height contained
within a recreational fire site: using dry,
clean wood, producing little detectable
smoke, odor or soot beyond the property line; conducted with an adult tending the fire at all times; for recreational,
ceremonial, or social food preparation;
extinguished completely before quitting
the occasion; and respecting weather
conditions, neighbors, burning bans, and
air quality requirements so that nuisance,
health or safety hazards will not be created. No more than one recreational fire
is allowed on any property at one time.
RECREATIONAL/CAMPFIRE SITE. An
area of no more than a three (3) foot
diameter circle (as measured from the
inside of the fire ring or border); completely surrounded by non-combustible
and non-smoke or odor producing material, either natural rock, cement, brick,
tile, blocks or ferrous metal. Burning
barrels are not a recreational fire site as
defined herein. Recreational fire sites
shall not be located closer than 25 feet
to any structure or combustible material.
RUNNING FIRE. An attended fire allowed to spread through surface vegetative matter under controlled conditions
for the purpose of vegetative management, forest management, game habitat management, or agricultural improvement.
STARTER FUELS. Dry, untreated, or
unpainted kindling, branches, or charcoal fire starter. Paraffin candles and
alcohols are permitted as starter fuels
and as aids to ignition only. Propane gas
torches or other clean gas burning devices causing minimal pollution may be
used to start an open burn.
VEGETATIVE MATERIALS. Dry leaves,
dry grass clippings, twigs, branches, tree
limbs, untreated or unpainted wood that
contains no glues or resins, and other
similar materials. Paper and cardboard
are not considered vegetative materials.
WOOD. Dry, clean fuels, such twigs,
branches, limbs, manufactured fireplace
logs, charcoal, cord wood, or untreated
dimensional lumber. Wood does not
include wood that is green with leaves
or needles, rotten, wet, oil soaked, or
treated with paint, glue or preservatives.
Clean pallets may be used for recre-

ational fires when cut into less than


three foot lengths.
95.05. PROHIBITED MATERIALS.
(A) No person shall conduct, cause or
permit the open burning of oils, petroleum fuels, rubber, plastic, chemically
treated materials, or other materials that
produce excessive or noxious smoke such
as, but not limited to: tires; railroad ties;
treated, painted or glued wood composite shingles; tar paper; insulation; composition board; sheet rock; wiring; or
paint and paint filters.
(B) No person shall conduct, cause
or permit the open burning of: hazardous waste or materials from salvage
operations; solid waste generated from
an industrial or manufactured process;
materials from a service or commercial
establishment; or building materials
generated from demolition of commercial or institutional structures.
(C) No person shall conduct, cause
or permit the open burning of discarded
materials resulting from the handling,
processing, storage, preparation, serving or consumption of food.
(D) No person shall conduct, cause
or permit the open burning of any leaves
or grass clippings.
(E) No person shall conduct, cause or
permit the open burning of any wood or
other vegetative materials through the
use of a burner, as described in Minn.
Stat. 88.16, within the citys jurisdiction.
95.06. OPEN BURNING PROHIBITED EXCEPT BY PERMIT.
No person shall start or allow any
open burning on any property in the city
without first having obtained an open
burning permit. A permit is not required
for any fire which is a recreational/campfire
as defined in Section 4.
95.07. PERMITTED OPEN BURNING; SPECIAL CIRCUMSTANCES.
(A) Under special or extraordinary circumstances, open burning permits may
be issued by the city or by a DNR forestry official for:
(1) Elimination of health hazard that
cannot be abated by other practical means,
as
determined by the commissioner of health
or the local health authority.
(2) Ground thawing for utility repair
and construction.
(3) Running fires.
(4) Disposal of vegetative matter for
managing forest, prairie or wildlife habitat,and in the development and maintenance of land and rights-of-way where
chipping, composting, land-spreading or
other alternative methods are not practical.
(5) Disposal of diseased trees generated on-site, diseased or infected nursery stock, or diseased bee hives.
(6) Disposal of unpainted, untreated,
non-glued lumber and wood shakes generated from construction, where recycling, reuse, removal or other alternative disposal methods are not practical.
(B) Fire training permits may only be
issued by the Minnesota Department of
Natural Resources (DNR).
(C) Permits for the operation of a
permanent tree and brush burning sites
may only be issued by the Minnesota
Department of Natural Resources (DNR).
95.08. PERMIT APPLICATION AND
FEES.
(A) Open burning permits shall be
obtained by making application on a
form prescribed by the DNR and adopted
by the Fire Department. The permit application shall be presented to the designated fire official for review.
(B) An open burning permit shall require the payment of a fee. Permit fees
shall be in an amount established by the
Council.
95.09. PERMIT PROCESS.
(A) The applicant shall demonstrate
to the designated fire official the ability
to comply with the applicable state statutes, this ordinance, or any additional
guidelines as may be adopted.
(B) Upon receipt of the completed
open burning permit application and fee,
the designated fire official may, if he or
she believes necessary, require a preliminary site inspection to locate the
proposed burn site, note special conditions, and set dates and times of permitted burn and review fire safety considerations, including the preparation of a
detailed burn event safety plan with the
designated fire official, when conditions
require.
95.10. DENIAL OF PERMIT.
(A) If the established criteria for the
issuance of an open burning permit are
not met, the application will be denied.
(B) Even if the established criteria for
the issuance of an open burning permit
are met, if it is determined that a practical alternative method for disposal exists, a pollution or nuisance condition
would result, or if a burn event safety
plan cannot be drafted to the satisfaction of the designated fire official, the
application may be denied.
95.11. PERMIT HOLDER RESPONSIBILITY.
(A) Prior to starting an open burn, the
permit holder shall be responsible for
confirming that no burning ban or air
quality alert is in effect.
(B) The open burning site shall have
appropriate communication and fire
suppression equipment available.
(C) The open burn shall be attended
to at all times. No fire may ever be
allowed to smolder. The fire shall be
completely extinguished before the permit holder or his or her representative
leaves the site. It is the responsibility of
the permit holder to have a valid permit,
as required by this ordinance, available
for inspection on site by law enforcement, the Fire Department, a Minnesota Pollution Control Agency (MPCA)
representative or DNR officer.
(D) The permit holder is responsible
for compliance and implementation of
all general conditions, special conditions,
and guidelines as established in the permit
issued. The permit holder shall be responsible for all costs incurred as a
result of the burn, including but not
limited to fire suppression and administrative fees.
95.12. REVOCATION OF PERMIT.
An open burning permit is subject to
revocation at the discretion of a DNR
officer or the designated fire official.
Reasons for revocation include but are
not limited to: a fire hazard existing or
developing during the course of the burn;
any permit conditions being violated during
the course of the burn; pollution or nuisance conditions developing during the
course of the burn; or a fire smoldering
with no flame, or attendant, present.
95.13. BURNING BAN OR AIR QUALITY ALERT.
(A) The designated fire official is au-

thorized to determine when conditions


make open burning potentially hazardous and declare a burning ban within
the city.
(B) No recreational fire or open burn
will be permitted when the city or the
DNR has officially declared a burning
ban due to potential hazardous fire conditions or when the MPCA has declared
an air quality alert.
95.14. SEVERABILITY.
If any provision of this ordinance is
found to be invalid for any reason by a
court of competent jurisdiction, the validity of the remaining provisions shall
not be affected.
95.16. EFFECTIVE DATE.
This ordinance becomes effective on
the date of its publication, or upon the
publication of a summary of the ordinance as provided by Minn. Stat.
412.191, subd. 4, as it may be amended
from time to time, which meets the requirements of Minn. Stat. 331A.01,
subd. 10, as it may be amended from
time to time.
95.99. PENALTY.
Any person convicted of violating any
provision of this ordinance is guilty of a
misdemeanor and shall be punished by
a fine not to exceed one thousand dollars ($1,000.00) or imprisonment for
not more than ninety (90) days.

There will be three sessions of lessons for Levels 1-6. Session I will
be June 15-June 26. Session II will be July 13-July 24. Session III will be
August 3- August 14. Class times are 9:00-9:40 a.m., 9:45-10:25 a.m. and
10:30-11:10 a.m. for all three sessions. Class times will also be offered
from Noon-12:40 p.m. for Sessions I and II only.
If you are involved in Cougar Care, your lesson time will be Session
I, June 15-26 from 9:00-9:40 or Noon-12:40 p.m. We are offering 2
different class times for Cougar Care this year to avoid the large classes
in level 1 and 2. You MUST sign up for one of these times if involved in
Cougar Care.
There will be a Mazeppa bus again for lessons. Mazeppa class time is
Session II, July 13-24 from Noon-12:40 p.m.only. There is no bus fee.
Tiny Tots : 11:15-11:45 a.m. Sessions I and II only. One adult must
accompany the child at all times. Class is held primarily in big pool. Class
is 30 minutes. Same cost as lessons.
Pre-School Classes: Sessions I and II only. 9:00-9:30 a.m., 9:45-10:15
a.m. and 10:30-11 a.m. Class is 30 minutes. Held primarily in baby pool.
Same cost as lessons.
Lap Swim offered from 5:00-6:30 p.m. daily.
Pool parties are offered from 7:15-8:45 p.m. Monday, Wednesday,
Friday and Saturday and from 8:15-9:45 p.m.on Tuesday, Thursday and
Sunday. We also offer pool parties from 10:30 a.m.-Noon on Saturday
and Sunday. Cost is $85.00
Water aerobics is Tuesday, Thursday and Sunday nights from 7 -8 p.m.
Cost is $2.50 each night.
The Zumbrota Swimming Pool is open from 1:00-7:00 p.m. daily.
The pool will open on Monday, June 1 at 1 p.m. and will close on
Sunday, August 23 at 7 p.m.
