8. Rajiv sees a book displayed in a shelf of a renowned bookshop with a price tag of
Rs. 1000/-. Rajiv tenders Rs. 1000/- on the counter and asks for the book. The
shopkeeper refuses to sell saying that the book has already been sold to
someone else and the shop does not have another copy of the book in stock.
Rajiv insists that the displayed book be sold to him. What is your advice to Rajiv?
9. Subhash writes to Sapana saying I offer my lap-top to you for Rs. 20,000/-. If
you do not reply me refusing my offer by 31 st July, I shall assume that you have
accepted my offer. Sapana did not reply. Subhash insists that since Sapana did
not reject his proposal she is now bound by the contract. What is your advice to
Subhash?

Arvind applied to a banker for a loan of Rs. 20 lac at a time when there is
stringency in the money market. The banker declined to give the loan except at
an unusually high rate of interest. Arvind accepted the loan on those terms. Now
Arvind wants to avoid the contract on the ground of Undue Influence. What
would be your advice to Arvind?

Smita, a minor, requests Mr. Kapur for a loan of Rs. 50,000/-. Mr. Kapur gave
her the loan on 1st July, 2010 and Smita agreed to repay the same after two
years. Smita attained majority on 15th August. 2011. Smita also possesses
properties worth Rs. 2 lac. Smita failed to repay the debt as promised and Mr.
Kapur wants to recover the loan from the properties of Smita. What is your
advice to Mr. Kapur?

Mahesh offered a reward of Rs. 1 lac to anyone who would rescue his wife
alive from a burning building. Naresh, a fireman risking his own life brought out
Maheshs wife, though she was seriously injured. Whether Naresh is entitled for
the reward?

Hemant says in conversation to his friend Manju that he will give Rs. 2 lac to
a person who marries his daughter. Satish marries Hemants daughter. Satish
files a suit against Hemant to recover Rs. 2 lac. What would be your advice to
Satish.

Hasan offers to sell to Abdul a painting which Hasan knows is a copy of a well
known masterpiece. The price quoted is Rs. 5,000/-. Abdul, thinking that the
painting is an original one and that Hasan must be unaware of this fact,
immediately accepts Hasans offer. Whether the contract between Hasan and
Abdul is a valid contract?

Sunita, a minor gave a loan of Rs. 10,000/- to Harish on 1 st April, 2011 for a
period of 1 year @ 12% p.a. Sunita attained majority on 30 th August, 2011.
Harish refuses to pay the loan as promised and claims that the contract is not
valid as Sunita was a minor and not competent to enter into the contract. What
is your advice to Sunita?

Mohan took care of Sohans infant son for about six months in 2008, without
being asked to do so. Now in January 2012, Sohan promises to pay to Mohan Rs.
50,000/- for taking care of his son. Later on Sohan changes his mind and refuses
to pay saying that his efforts were not worth Rs. 50,000/-. Mohan is seeking your
advice as he wants to recover the promised amount from Sohan.

A, a minor representing to be a major, mortgages his house in favor of B, a
money-lender, to secure a loan of Rs. 5 lac. Out of this amount a loan of Rs. 2
lac was actually advanced to A by B. Later on B wishes to cancel the
mortgage on the plea that A misrepresented himself as a major and now wants
his money (Rs. 2 lac) back. On the other hand A wants B to lend him further
money of Rs. 3 lac and once again agrees to repay the entire loan as per the
terms of the mortgage. What is your advice to B?

A and B believing themselves married made a separation agreement under
which the husband agreed to pay a monthly allowance of Rs. 5,000/- to the wife.
Later on it transpired that they were not married. The wife filed a suit for
arrears of allowance. What is your advice to the husband?

Vinay offered to sell his Maruti Zen to Vivek for Rs. 150,000/-. Vivek accepted
the offer but requested him to consider giving a discount of at least 5% in the
price. Vinay did not reply to Vivek. Subsequently Vivek said he would buy the car
for Rs. 150,000/- but now Vinay refuses to sell his car. What right Vivek has?

Venkatesh, a philanthropist agreed to build a prayer hall for Sarvadharma
Sabha at an estimated cost of about Rs. 20 lac. But later he refused to do so.
Sarvadharma Sabha, a religious organization wants to file a suit against
Venkatesh. What is your advice?

John invited tender for the sale of his house but did not undertake to sell the
house to the highest bidder. Ram sent an offer expressing his willingness to buy
the house for Rs. 10 lac. Similarly, Ratan and Rohan also conveyed their offers to
pay Rs. 11 and Rs. 12 lac respectively for the house. Later on John refused to sell
his house to anyone. What right Ram, Ratan and Rohan have against John?

Suresh purchased furniture from FURNITIA, a well-known furniture show
room, for his drawing room and issued a cheque for the full price of the furniture.
The furniture was to be polished as per the choice and direction of Suresh and
FURNITIA agreed to give delivery of the furniture after four days. In the
meanwhile the cheque issued by Suresh was dishonoured and now FURNITIA is
refusing to deliver the furniture until full payment is made. Do you justify the
stand taken by FURNITIA ?

Do you think that a valid contract is formed between Mahendra and Habib?

of Incorporation to the company. Later it came to the knowledge of the Registrar
that two of the seven members who signed the Memorandum of Association of
the company were minor. Can the registration certificate be withdrawn as the
documents were signed by only five eligible persons as the other two were not
qualified to sign the Memorandum?

advertisement had described the car as Maruti Zen, 2003 model, silver pearl,
price Rs. 240,000/-. Rashi examined the car and took it for a test drive. Being

pearl but white. What is your advice to Rashi?
30. Poonam bought synthetic pearls from a shop, Aesthetics: A Womans Shop
thinking that they were natural pearls. The pearls were hung on stands with
price tag attached. The customer could choose whatever she wanted. Now,
realizing that the pearls are not natural, Poonam wants to return the pearls and
claims the refund of her money. What is the liability of the shop-keeper in this
situation?
