Judicial developments
Ayyash et al. case

in the

This case relates to the attack of 14


February 2005 in Beirut.
Trial Preparation:
On 24 January, the Defence Counsel filed a
Joint Motion to vacate the trial date of 25
March citing a number of reasons. The
Prosecution did not object to vacate this
trial date. However, the decision to change
the tentative date of trial is the prerogative
of the Pre Trial Judge after taking into
consideration the motions of the parties,
the Victims Legal Representatives and the
rights of the accused. He is considering this
motion and will make a decision in due
course.

New Appeals Judge Sworn-in:


Judge Ivana Hrdlikov, appointed by the
United Nations Secretary General to
the Appeals Chamber of the Special Tribunal
for Lebanon (STL), has been sworn-in during
a public hearing on 16 January. The hearing
was attended by a number of diplomats and
members of the public. Judge Hrdlikov,
from the Czech Republic, has replaced Judge
Kjell Erik Bjrnberg, who retired.
Status Conference 30 January
The Pre-Trial Judge, Daniel Fransen, held a
Status Conference on 30 January as part of
his duties to ensure preparation for trial.
The Prosecution said disclosure of all the
material to the Defence will be completed
by 11 March.

On 9 January, Defence counsel for the four


accused filed their Pre-Trial Briefs,
challenging the Prosecutions account of the
attack and the alleged involvement of the
four accused.

Registrar in Beirut

Defence counsel for Assad Hassan Sabra


criticise in their brief the Prosecution for
what they describe as a failure to disclose
documents that will be used in trial. They
also noted their inability to conduct
meaningful investigations due to a lack of
cooperation from the Lebanese authorities.

During his stay, the Registrar met with the


Prime Minister and other Lebanese officials.
The Registrar also met with various
representatives
of
the
diplomatic
community in Lebanon and the STL staff in
Beirut.

The STL Registrar, Herman von Hebel,


visited Lebanon in the last week of January
on an official visit.

Baragwanath, the Tribunals President, addressed the questions of whether the Tribunal will
fulfil its mandate within the next three years.
