Hopefully, the Final CE Memo can be delivered the first full week of January, depending on when

Appendix C, which is the wind study, is not included however. CPP, the wind consultant, wants to be
sure that they receive payment before finalizing their study (we need 8-10 business days to pay our
subconsultants after receiving payment from the applicant). I have been trying to work that out with
them but my main contact there has been traveling. I am attaching the table they created to insert
into the report, per your comments. I hope to be able to have the next draft from them by the end
of this week. I will keep you updated.

In response to your phone call yesterday, please see the points below.
1. Average per story lot coverage, above base (level 3 and above) 34.53% - this includes the
wing buildings. Without the wings, the tower itself, level 8 and above, we are at 31.73%.
2. Average floor area, above base (level 3 and above) 13,904 sf. The tower itself is really
12,776 sf, and this is true for levels 8 through 24. Overall, the average floor area is greater
due to the two wing buildings at base, which increase the floor area at levels 3-7. The tower
itself, without the wings, is really under 13,000sf.
3. Average set back from the estuary The part of the building that is nearest to the estuary is
set back 192, per survey.
4. Bike Parking (as designed by AVRP, consulting architect)
a. Total 84 Spaces
b. Dimensions
i. 3 x 66 (rectangular footprint) 42 spaces
ii. 3 x 66 (Triangular footprint) 44 spaces
5. Regarding the 26 vertical separation between street and townhouses. We do comply with
all townhouses, except one, at the corner of East 12 th and 2nd Avenue. And After talking to
Mike Pyatok, we need to emphasize the fact that we have a 10 setback from the sidewalk
and planting will be protecting those windows. Additionally, there are not sleeping areas at
street level. Given the above, we believe that such a requirement should be lessened in this
one case.
6. Regarding the required 15 vertical separation between the commercial spaces at ground
floor and the residential units above we do provide a 29 floor to floor separation from
commercial space to the residential space above in the lobby and cafe. Along 12 th Street
and along the park we provide townhouses with 13 floor to floor separation, but we dont
see how this residential use should be affected by the 15 vertical separation required at
commercial spaces.

Here is language acceptable to Abel, which builds on your suggestion of leaving the funding
in escrow until the skate board park project is ready to move forward. Our language removes
references to matching funding since we dont have a bid now, and it makes clear what the
back-up plan for the funding is in the event that the skate board park project doesnt move
forward.
At the time of transfer of the property, developer will fund at least $150,000 into escrow
towards the construction of a skate board park on existing publicly-owned property in
Council District 2, such as at San Antonio Park. If the remaining funds necessary for the
development of the skate board park are not available at the time of transfer, the developer's
funds will remain in escrow until all the skate board park funding is available. Should the
skate board park project not go forward during the DDA period, the $150,000 will be
distributed to organizations that already are recipients of these community benefits, as
decided by the District 2 Councilmember.

PROJECT SPONSOR: City of Oakland
PROJECT LOCATION: The Lake Merritt Station Area encompasses approximately 315 acres generally bound by
14th Street to the north, I-880 to the south, Broadway to the west, and 5th Avenue to the east. The Planning
Area includes the Lake Merritt BART Station, Oakland Chinatown business and residential districts, Laney
College and Peralta facilities, the Oakland Public Library, the Oakland Museum of California, the Alameda
County Courthouse and other County offices, the building currently occupied by the Association of Bay Area
Governments (ABAG) and the Metropolitan Transportation Commission (MTC), the Lake Merritt Channel, and
a portion of the East Lake district.
PROJECT DESCRIPTION:
With a planning horizon to 2035, the Plan builds on extensive community feedback to articulate a roadmap
for future development, continued revitalization and economic growth, and community enhancement in the
Station Area. The Plan seeks to achieve the vision and goals established by the community and key
stakeholders. This vision includes several statements, which are summarized here:
The distribution, location, and extent of the uses of land, including open space, within the area
covered by the plan;
The distribution, location, and extent and intensity of major components of public and private
transportation, sewage, water, drainage, solid waste disposal, energy, and other essential
facilities;
The Plan includes land use changes that will reduce the barriers to increased transit use from both the
immediate area and surrounding neighborhoods. The Plan seeks to create an activity core around a
rejuvenated transit station. Simultaneously, the Plan seeks to reinforce and integrate the cultural and
recreational resources that make this transit station unique. The Plan identifies ways in which streets, open
spaces, and other infrastructure in the area can be improved, and establishes regulations for development
projects that further the areas vitality and safety.
The Station Area Plan requires General Plan and Planning Code amendments (text and map changes) along
with Design Guidelines to achieve the Plans goals. For more information on the project, including draft

ENVIRONMENTAL REVIEW: A Notice of Preparation of an EIR was issued by the City of Oaklands Department
of Planning and Building on March 1, 2012. A Draft Environmental Impact Report (DEIR) has now been
prepared for the project under the requirements of the California Environmental Quality Act (CEQA) pursuant
to Public Resources Code Section 21000 et. seq. The DEIR analyzes the potentially significant environmental
impacts in the following environmental categories: Land Use, Planning, Population and Housing;
Transportation and Traffic; Air Quality; Climate Change and Greenhouse Gases; Parks and Recreation; Public
Services; Utilities and Service Systems; Cultural and Historic Resources; Aesthetics; Biological Resources;
Geology and Soils; Hazards and Hazardous Materials; and Hydrology and Water Quality. The Draft EIR
identifies significant and unavoidable environmental impacts related to: Transportation and Circulation; Air
Quality; and Cultural Resources.
The City of Oaklands Department of Planning and Building is hereby releasing this DEIR, finding it to be
accurate and complete and ready for public review. Starting on Friday, November 1, 2013, copies of the DEIR
are available for review or distribution to interested parties at no charge at the Department of Planning and
Building, 250 Frank Ogawa Plaza, Suite 3315, Oakland, CA 94612, Monday through Friday, 8:30 a.m. to 4:30

alternatives to the Station Area Plan in light of the EIRs purpose to provide useful and accurate information
about such factors. Comments may be made at the public hearings described above or in writing. Please

I urge the Council to approve that at least 50% of the proceeds from sale
of the 12th Street "remainder parcel" be devoted to a fund for maintenance
of Measure DD improvements at Lake Merritt.
Bond funds from the passage of Measure DD were approved to make the most significant
and broadly-recognized open space improvements around the city in decades. However,
Measure DD's capital funds cannot be used for maintenance. Care and protection of the
various improvements must be increased to match the greatly increased usage. Lake Merritt
and its adjacent parks need more service and maintenance than the current one-&-onehalf park employee positions can provide.
The "remainder parcel," created by Measure DD, resulted from realignment of the former
mini-freeway into attractive lanes, new pedestrian and bicycle paths, and landscaping
and visitor enhancements, now known as Lake Merritt Boulevard.
This recommendation deserves your support. Please take the long-term view of guardian of
these prominent Oakland assets. Please protect and safeguard the huge investment Oakland
voters made to successfully transform the Lake's environment for the 21st century.

Importance: Tidal marsh plants require full sun. The Coalition desires to be informed if the new
building's height will cast more than minimum of shadows on the Tidal Marsh. Extended lengthy

I had our 12 th street PM look a bit more closely at the site next to
the Lake Merritt channel and the school administration building (the
triangle). While an acre of the property is being sold to the
developer for a high rise, there is about 20,000 square feet left over
of an oddly shaped area that could be squeezed between the future
building and the water quality detention area. Ali has a site drawing
and our PM did a quick measurement for square feet estimate.

But my legal question for you is: please confirm there is nothing else we
need to do with the Ordinance, esp the title, in light of the fact that
staffs alternative and preferred recommendation is to NOT appropriate
funds from this one-time transaction for ongoing maintenance of Measure
DD improvements.
i.e., if Council votes to go with staffs alternative recommendation, will
another Ordinance have to be produced for the record or will they just
strike from this Ordinance those parts that are not relevant? I am not
familiar with how this normally gets handled

See below and attached. They are looking for a fund to use for the Lake
Merritt maintenance 25% that Council requested today. Patrick thought
the CAO/Finance should indicate if this action puts a hole in the
planned/proposed budget. He thought that is what the Committee was
looking to the Administration for feedback.
If the LM maintenance does go through, what fund should it be
transferred to? There seemed to be a desire for it to be non-1010. I
mentioned the LLAD is where most park maintenance resides now or
maybe a misc grant fund?
Please advise.

Hi Sarah,
CED Committee recommended an amount of 25% of net land sale
proceeds from sale of 12th St Remainder go toward a fund dedicated for
the maintenance of Measure DD improvements.
(See attached letter from Measure DD Coalition, which actually asked for
50% of the land sale proceeds go toward this purpose.)
I need to reflect this change (and others introduced today at CED) in the
Supplemental Report, due to be published this Thursday for the April 21st
City Council Meeting.
Please review attached report, especially highlighted sections, and advise
on the appropriate Oracle funding block and language.
