FYR, Michael,
Attached is a Screencheck Draft of your projects CEQA analysis staff just received the Wind
Study today.
Please review and let us know if you have any comments/questions. City staff are also reviewing
this draft and we are aiming to get our comments back to LSA by Dec 29th or soon after.
The next version from LSA will incorporate these last round of comments and will be Final.
Hopefully, the Final CE Memo can be delivered the first full week of January, depending on when
City is able to get our last round of comments to LSA.

Hi Neal and Hui

The Screencheck Draft CE Memo is attached, including a clean PDF version, Word version and a

compare version that shows the changes made since Admin #2.
Appendix C, which is the wind study, is not included however. CPP, the wind consultant, wants to be
sure that they receive payment before finalizing their study (we need 8-10 business days to pay our
subconsultants after receiving payment from the applicant). I have been trying to work that out with
them but my main contact there has been traveling. I am attaching the table they created to insert
into the report, per your comments. I hope to be able to have the next draft from them by the end
of this week. I will keep you updated.

Hi Dan,
Couple of other things:
Have you looked at Ed Manasses recommendations for the North and South facades? Michael
heard the recommendations at a meeting a few weeks ago. Also, please study increasing the
ground floor grade separation of the unit that is out of compliance with the 2.5 ft requirement.

Neil,
In response to your phone call yesterday, please see the points below.

1. Average per story lot coverage, above base (level 3 and above) 34.53% - this includes the
wing buildings. Without the wings, the tower itself, level 8 and above, we are at 31.73%.
2. Average floor area, above base (level 3 and above) 13,904 sf. The tower itself is really
12,776 sf, and this is true for levels 8 through 24. Overall, the average floor area is greater
due to the two wing buildings at base, which increase the floor area at levels 3-7. The tower
itself, without the wings, is really under 13,000sf.
3. Average set back from the estuary The part of the building that is nearest to the estuary is
set back 192, per survey.
4. Bike Parking (as designed by AVRP, consulting architect)
a. Total 84 Spaces
b. Dimensions
i. 3 x 66 (rectangular footprint) 42 spaces
ii. 3 x 66 (Triangular footprint) 44 spaces
5. Regarding the 26 vertical separation between street and townhouses. We do comply with
all townhouses, except one, at the corner of East 12 th and 2nd Avenue. And After talking to
Mike Pyatok, we need to emphasize the fact that we have a 10 setback from the sidewalk
and planting will be protecting those windows. Additionally, there are not sleeping areas at
street level. Given the above, we believe that such a requirement should be lessened in this
one case.
6. Regarding the required 15 vertical separation between the commercial spaces at ground
floor and the residential units above we do provide a 29 floor to floor separation from
commercial space to the residential space above in the lobby and cafe. Along 12 th Street
and along the park we provide townhouses with 13 floor to floor separation, but we dont
see how this residential use should be affected by the 15 vertical separation required at
commercial spaces.
If there is anything else you might need, please let me know,
Thanks,
Dan

Michael,
Here is language acceptable to Abel, which builds on your suggestion of leaving the funding
in escrow until the skate board park project is ready to move forward. Our language removes
references to matching funding since we dont have a bid now, and it makes clear what the
back-up plan for the funding is in the event that the skate board park project doesnt move
forward.
At the time of transfer of the property, developer will fund at least $150,000 into escrow
towards the construction of a skate board park on existing publicly-owned property in
Council District 2, such as at San Antonio Park. If the remaining funds necessary for the
development of the skate board park are not available at the time of transfer, the developer's
funds will remain in escrow until all the skate board park funding is available. Should the
skate board park project not go forward during the DDA period, the $150,000 will be
distributed to organizations that already are recipients of these community benefits, as
decided by the District 2 Councilmember.

MERRITT STATION AREA PLAN AND NOTICE OF PUBLIC HEARINGS ON DEIR
TO: All Interested Parties
SUBJECT: Notice of Availability/Release of Draft Environmental Impact Report for the Lake Merritt Station
Area Plan, and Notice of Public Hearing on the same.
REVIEW PERIOD: November 1, 2013 through December 16, 2013
CASE NO.: ZS11225, ER110017, GP13287, ZT13288, RZ13289 (CEQA State Clearinghouse Number
2012033012)
PROJECT SPONSOR: City of Oakland
PROJECT LOCATION: The Lake Merritt Station Area encompasses approximately 315 acres generally bound by
14th Street to the north, I-880 to the south, Broadway to the west, and 5th Avenue to the east. The Planning
Area includes the Lake Merritt BART Station, Oakland Chinatown business and residential districts, Laney
College and Peralta facilities, the Oakland Public Library, the Oakland Museum of California, the Alameda
County Courthouse and other County offices, the building currently occupied by the Association of Bay Area
Governments (ABAG) and the Metropolitan Transportation Commission (MTC), the Lake Merritt Channel, and
a portion of the East Lake district.

PROJECT DESCRIPTION:
With a planning horizon to 2035, the Plan builds on extensive community feedback to articulate a roadmap
for future development, continued revitalization and economic growth, and community enhancement in the
Station Area. The Plan seeks to achieve the vision and goals established by the community and key
stakeholders. This vision includes several statements, which are summarized here:

Create an active, vibrant and safe district;

Encourage services and retail;

Encourage equitable, sustainable and healthy development;

Encourage non-automobile transportation;

Increase and diversify housing;

Encourage job creation and access;

Identify additional open space and recreation opportunities;

Celebrate and enhance Chinatown as an asset and a destination;

Model progressive innovations (i.e., economic, environmental, social).

The Plan consists of written text and diagrams that express how the Planning Area should develop into the
future, and identifies key actions the City and other entities will take to improve the area. The Plan covers
land use, development density, circulation and infrastructure, and has legal authority as a regulatory
document. It contains elements required of Specific Plans, such as:

The distribution, location, and extent of the uses of land, including open space, within the area
covered by the plan;

The distribution, location, and extent and intensity of major components of public and private
transportation, sewage, water, drainage, solid waste disposal, energy, and other essential
facilities;

Standards and criteria by which development will proceed; and

A program of implementation measures including regulations, programs, public works projects,

and financing measures necessary to carry out the proposed improvements.

The Plan includes land use changes that will reduce the barriers to increased transit use from both the
immediate area and surrounding neighborhoods. The Plan seeks to create an activity core around a
rejuvenated transit station. Simultaneously, the Plan seeks to reinforce and integrate the cultural and
recreational resources that make this transit station unique. The Plan identifies ways in which streets, open
spaces, and other infrastructure in the area can be improved, and establishes regulations for development
projects that further the areas vitality and safety.
The Station Area Plan requires General Plan and Planning Code amendments (text and map changes) along
with Design Guidelines to achieve the Plans goals. For more information on the project, including draft
documents, please visit the project website at: http://www.business2oakland.com/lakemerrittsap.

ENVIRONMENTAL REVIEW: A Notice of Preparation of an EIR was issued by the City of Oaklands Department
of Planning and Building on March 1, 2012. A Draft Environmental Impact Report (DEIR) has now been
prepared for the project under the requirements of the California Environmental Quality Act (CEQA) pursuant
to Public Resources Code Section 21000 et. seq. The DEIR analyzes the potentially significant environmental
impacts in the following environmental categories: Land Use, Planning, Population and Housing;
Transportation and Traffic; Air Quality; Climate Change and Greenhouse Gases; Parks and Recreation; Public
Services; Utilities and Service Systems; Cultural and Historic Resources; Aesthetics; Biological Resources;
Geology and Soils; Hazards and Hazardous Materials; and Hydrology and Water Quality. The Draft EIR

identifies significant and unavoidable environmental impacts related to: Transportation and Circulation; Air
Quality; and Cultural Resources.
The City of Oaklands Department of Planning and Building is hereby releasing this DEIR, finding it to be
accurate and complete and ready for public review. Starting on Friday, November 1, 2013, copies of the DEIR
are available for review or distribution to interested parties at no charge at the Department of Planning and
Building, 250 Frank Ogawa Plaza, Suite 3315, Oakland, CA 94612, Monday through Friday, 8:30 a.m. to 4:30
p.m. Additional copies are available for review at the Oakland Public Library, Social Science and Documents,
125 14th Street, Oakland, CA 94612 and at the Oakland Asian Cultural Center, 388 9th Street #290, Oakland,
CA 94607. The Draft EIR may also be reviewed on the Citys Current Environmental Review Documents
webpage: http://www2.oaklandnet.com/Government/o/PBN/OurServices/Application/DOWD009157
The City has scheduled two public hearings on the DEIR:
Landmarks Preservation Advisory Board
Monday, November 18, 2013
6:00 p.m.
Oakland City Hall, Hearing Room 1
One Frank H. Ogawa Plaza
Oakland, CA 94612
City Planning Commission
Wednesday, November 20, 2013
6:00 p.m.
Oakland City Hall, Council Chambers
One Frank H. Ogawa Plaza
Oakland, CA 94612
Members of the public are welcome to attend these hearings and provide comments. Comments on the DEIR
should focus on whether the DEIR is sufficient in discussing possible impacts to the physical environmental,

Subject: Please authorize at least 50% of property sale proceeds to maintain Measure DD
improvements at Lake Merritt

Dear Oakland City Council members,

As a member of CALM (Coalition of Advocates for Lake Merritt) and an Oakland native
who looks at an Oakland park every day, I invite you to pay attention to one at the heart of
Oakland. CALM is the organization that envisioned Lake Merritt Boulevard and related
improvements at the south end of the Lake, and whose proposal was selected by the City
Council in 2001, leading to the $198 million Measure DD bond program, and the 56
improvement projects around Oakland that are now completed or nearing final stages of
implementation. The foremost project was the expansion and enhancement of the greenbelt
around Lake Merritt, and the enchanting Lakeside Park.

I urge the Council to approve that at least 50% of the proceeds from sale
of the 12th Street "remainder parcel" be devoted to a fund for maintenance
of Measure DD improvements at Lake Merritt.
Bond funds from the passage of Measure DD were approved to make the most significant
and broadly-recognized open space improvements around the city in decades. However,
Measure DD's capital funds cannot be used for maintenance. Care and protection of the
various improvements must be increased to match the greatly increased usage. Lake Merritt
and its adjacent parks need more service and maintenance than the current one-&-onehalf park employee positions can provide.
The "remainder parcel," created by Measure DD, resulted from realignment of the former
mini-freeway into attractive lanes, new pedestrian and bicycle paths, and landscaping
and visitor enhancements, now known as Lake Merritt Boulevard.

This recommendation deserves your support. Please take the long-term view of guardian of
these prominent Oakland assets. Please protect and safeguard the huge investment Oakland
voters made to successfully transform the Lake's environment for the 21st century.
Thank you!
Aileen Frankel

Good morning, Hui,
Your reply and the attached letter of Director Flynn are received and are much appreciated on
conveying the desired outcome relating to our varied requests.

Especial thanks and appreciation to Director Flynn and Planning Manager Patrick Lane for their
cooperative consideration.
Director Flynn's 30 October letter is addressed to Oakland Tenants Union, certainly one of the
concerned and requesting organizations. The initial requests, however, relating to the "remainder
parcel" were submitted 21 May & 21 July by the Measure DD Community Coalition, the City-ordained
organization charged with monitoring and oversight of DD projects.
Accordingly, it is requested that the same letter (with minor revisions as appropriate) be transmitted to
the DD Coalition for the Coalition's records, as followup and response to the initial request and report of
DD's appointed "Subcommittee on the Lake Merritt Boulevard Remainder Parcel"

Hi Neil,
See attached comments about wind study from Measure DD folks for forwarding to LSA.
They make a good point that Citys existing palm trees on E 12th St might conflict with the studys
wind mitigation recommendation (SCA 12 and SCA 13) to install porous trees on the same block.
Thank you,

Hello David,
I hope this finds you well.
As you may know, UrbanCore-Integral, LLC has an Exclusive Negotiating
Agreement on the remainder parcel located at E. 12th Street and 2nd Avenue,
which was created when 12th St was relocated and became Lake Merritt Blvd. A
condition of the ENA is that the developers hold a community meeting to present
the project, which is a residential high-rise over ground floor neighborhoodserving retail, and obtain community feedback. Pats office is assisting the
developer in securing a meeting space that is easily accessible to the surrounding
E.12th Street neighbors and merchants. We believe an ideal location would be a
one that is close to the parcel site. Two OUSD locations stand out as great

options. Would it be possible to use either OUSDs old administration building

or La Escuelita Elementary for this community meeting? The meeting is
tentatively set for the evening of October 24, 2013. The developers are eager to
pin down a location so they can announce the meeting. Please advise.
Of course, wed like to invite you, other school board members and staff to
attend, too.

Hi Christine,
(Im still working on your earlier info requestsbut just to respond to your latest questions)
The sale of 12th Street Remainder parcel has been a topic of closed session meetings 4 times
December 4, 2012
April 16, 2013
February 17, 2015
March 3, 2015
The agenda/titles are published/public and can be found online here:
http://www2.oaklandnet.com/Government/o/CityCouncil/s/councilmeetings/ClosedSessionAgendas/index.htm
(and I have attached the relevant agendas to this email for your easy reference.)
However, the content of the discussions on Citys real estate negotiations that are held at closed session are
not public information.
The City Council authorized the ENA with UrbanCore at their open meeting on July 2013.
Heres the staff report online:

Hi Hui Chang,
Much of my notes from that meeting were erased when my computer crashed last week. If you don't
mind, can you please remind me what was the reason that the city selected the UrbanCore RFP over
the Wood Partners RFP? Who made this decision/has the authority to decide which RFP is

Hi Christine,
For your Public Records Request, I am working with Planning staff to assemble the documents, but
you will need to follow the Citys procedure in making a public records request. (While it isnt
always necessary to do a formal request, in this case it makes sense since your request is so
extensive.)

To do this, please contact Amber Todd in the Citys Administrators office at (510) 238-6369 or

Subject: Re: Update on "Shadow" & "Wind" Studies at "Remainder Parcel" for Meas DD Coalition
Hello Hui,
Our apology for failure of the Measure DD Coalition to get back to you sooner with review comments
on the proposed scope for the "Wind and Shadow Studies" to be provided by LSA. We hope the
studies have not been hampered or delayed as result.
Following your update report at the Coalition's Sept 15 meeting, we presumed the Coalition heard and
accepted your report as a status update, and did not designate or assign review to the followup
committee. Accordingly, our reply is not a formal review, but are comments that most likely are already
to be addressed by LSA.
Wind Study:
The Coalition desires that the Wind Study calculate wind speeds before and after (simulated)
construction of proposed Lake Merritt Tower Apartments for at least the following locations:
(a) several points on the surface of the lake
(b) the east side pedestrian pathway along the Channel at the line of the OUSD fence
(c) at both pathways under the center of the vehicle bridge
(d) at the center of the north and south topside sidewalks of the vehicle bridge
(e) at the center of the bicycle-pedestrian bridge
(f) at the easterly portion of the 'passive park' area adjoining the project
(g) at the public sidewalk fronting the project along E 12th Street
Shadow Study:
The Coalition desires that the study provide Drawings to depict maximum shadows cast by the
proposed building during:

(a)
(b)
(c)
(d)

the Winter Solstice

the Summer Solstice
the Equinox
particularly how the new building's shadows may impinge on the new Tidal Marsh on the
west side of the Channel (near the South entrance of the Convention Center Building).

Importance: Tidal marsh plants require full sun. The Coalition desires to be informed if the new
building's height will cast more than minimum of shadows on the Tidal Marsh. Extended lengthy
shadows would affect the Marsh's restoration effort. Success of the Tidal Marsh is a requirement of
the City's permits with the U.S. Army Corps and the State Fish & Wildlife Agency.

Hi Patrick and Hui-Chang

I wanted to make sure you were aware that at tomorrows Planning Commission hearing on the final
Lake Merritt Station Area Plan (and zoning), Rachel will be recommending extension of the public
hearing to a future date (yet to be determined). We are doing this, because we heard many
concerns from the community that they needed more time to review documents. This will mean
that final adoption hearings at City Council will also be bumped out, probably to sometime between
November and December, depending on the exact date selected for the continued Planning
Commission hearing.
Let us know if there are any timing considerations related to the Lake Merritt Blvd Apartments ENA
that we should keep in mind as we are making our recommendation for a new public hearing date.

Audree,
I had our 12 th street PM look a bit more closely at the site next to
the Lake Merritt channel and the school administration building (the
triangle). While an acre of the property is being sold to the
developer for a high rise, there is about 20,000 square feet left over
of an oddly shaped area that could be squeezed between the future
building and the water quality detention area. Ali has a site drawing
and our PM did a quick measurement for square feet estimate.

Hi Audree,
As discussed here are some rough sq. ft. areas for the following potential alternate dog
play areas:
<!--[if !supportLists]-->1) <!--[endif]-->Lakeside Park: along Grand Ave. between
Lenox Ave. and Perkins - can easily get 25,000 and up to 35,000 sq. ft.
<!--[if !supportLists]-->2) <!--[endif]-->Next to 18 th St. Tennis Courts: 15,000
22,000 sq. ft.
<!--[if !supportLists]-->3) <!--[endif]-->Grand Ave. Bellevue Dr. exit: easily get
25,000 35,000 sq. ft.
<!--[if !supportLists]-->4) <!--[endif]-->Estuary Park: the main grass area is
67,000 sq. ft. the smaller area near the water is at least 15, 500 sq. ft and from
the aerial I couldnt tell if the dirt area next to it was available, but is so it
would add another 2000 -5000 sq. ft.

Lets talk about what to do with this information.

City Attorney
I am waiting to get confirmation from Rafael

that there does not need to be a title change

that CEDs directives can be addressed in the body of the staff

Do we need to indicate somewhere that the Ordinance has been

revised?

how to handle staffs alternative recommendation for Measure DD

maintenance funding in the staff report and the Ordinance
Budget
I am waiting to hear back from Budget about

the correct funding blocks for the Affordable Housing Trust Fund

the correct funding blocks for the Measure DD maintenance fund

any additional info for staffs alternative recommendation for how

to fund Measure DD maintenance
(Note: The community benefits package is complete for the purposes of
the staff report; it will be inserted as a last page to Exhibit A, although
further details may be needed for drafting of the DDA itself.)
Let me know if you have questions.

Please see my edits to the report; however, We need to get official word
from the city attorneys office ASAP. In the supplemental you are
changing the title to add items 4 and 5. A title change would require us
to go back to rules and reschedule the item allowing 10 days of noticing
of the new title even if it is something that came out of CED committee.
This means we would have to schedule the item for Council on May
19th.
The question for the City Attorneys office is does this need to be a title
change or can we just build the requested information into the reason for
supplemental portion of the report and add the whereas to the
ordinance? The addition of the 25% for affordable housing and Measure
DD, in my opinion, could be added to the reason for supplemental rather
than changing the title. Likewise, I believe it can be built into the
ordinance without amending the title, but before we proceed we need
the City Attorneys opinion on what to do.

Hi Rafael,
Here is the draft of the Supplemental Report I have as of this morning.
I do have placeholders for the sections on Measure DD maintenance and
community benefits, but both still subject to change per Budget Office
and CM Guillens office.
Note, you have already given me feedback on the attached Ordinance
and Exhibit A.

But my legal question for you is: please confirm there is nothing else we
need to do with the Ordinance, esp the title, in light of the fact that
staffs alternative and preferred recommendation is to NOT appropriate
funds from this one-time transaction for ongoing maintenance of Measure
DD improvements.
i.e., if Council votes to go with staffs alternative recommendation, will
another Ordinance have to be produced for the record or will they just
strike from this Ordinance those parts that are not relevant? I am not
familiar with how this normally gets handled
Separately, I will send an email about just the community benefits

but hopefully before then.
Please pay special attention to highlighted sections - I am waiting on
Budget Office to advise on the funding blocks for both the Measure DD
maintenance fund and the Affordable Housing Trust Fund. I understand
that Budget Office has an alternative recommendation for how to fund
Measure DD maintenance go ahead and add to that section as you see
appropriate.
(Note that the exact Community Benefits are still under negotiation but
this is the draft/placeholder I have so far.)

Hello,
See below and attached. They are looking for a fund to use for the Lake
Merritt maintenance 25% that Council requested today. Patrick thought
the CAO/Finance should indicate if this action puts a hole in the
planned/proposed budget. He thought that is what the Committee was
looking to the Administration for feedback.
If the LM maintenance does go through, what fund should it be
transferred to? There seemed to be a desire for it to be non-1010. I
mentioned the LLAD is where most park maintenance resides now or
maybe a misc grant fund?
Please advise.

Hi Sarah,
CED Committee recommended an amount of 25% of net land sale
proceeds from sale of 12th St Remainder go toward a fund dedicated for
the maintenance of Measure DD improvements.
(See attached letter from Measure DD Coalition, which actually asked for
50% of the land sale proceeds go toward this purpose.)
I need to reflect this change (and others introduced today at CED) in the
Supplemental Report, due to be published this Thursday for the April 21st
City Council Meeting.
Please review attached report, especially highlighted sections, and advise
on the appropriate Oracle funding block and language.

Hello,
My name is Karen Kunze and I am a resident of 1200 Lakeshore Blvd. We have put a
post about your project up on the our website: CLICK HERE
Residents do have strong interests/concerns related to your project.
A couple of general questions:
1. Do you have a photo that shows the relationship and views from a number of our
units looking out at the proposed building that we could use on our posting? (Looking at
the planning staff report, I could not find any. More importantly, from my deck, E stack
unit, it appears the view is going to be extremely disturbing, see photos attached)
2. Would you be willing to host a meeting at the Church on Lakeshore Blvd. adjacent to
our building where you would have your traffic consultants and project development
plans available for comment and discussion with our community?
Please feel free to contact me by return email (best means of communication) or
telephone 510-271-8355 (home phone with voicemail).
Thank you very much.
