Married couple gets divorced yet stays together so what changed?

By Mark Charnet

great
deal
has
changed, in fact, a
lot more than you
might think, at first glance.
Firstly, the couples friends,
family and acquaintances are
confused as to why they got
divorced in the first place,
given that nothing has really
changed in their eyes.
However, there is a major
change in the eyes of the state
and federal governments,
employer retirement plans
and the tax treatment of any
former spouse beneficiaries of
any life insurance policies and
annuities. This change is a
really big deal, indeed!
Whether or not this couple resides under the same
roof, they are legally no longer
married in the eyes of the law
and no longer entitled to the
tremendous spousal benefits
at the death of the first spouse.
IRAs allow for a non-taxable
spousal rollover that disappeared with the divorce
decree. A non-spouse, named
as the employers 401k or pension plan beneficiary, will no
longer enjoy the right to rollover the proceeds of the
account into their name taxfree. Ex-spouses can no longer
roll-over the proceeds of a
non-qualified tax-deferred
annuity without paying tax on
the deferred gains in the
account.
Ex-spouses can no longer
take advantage of spousal discounts in the purchase of a
long-term care policy. Ex-

spouses may lose the pension

benefits of their former
spouses pension plan due to
their divorce as well, whether
receiving benefits currently or
at their ex-spouses death.
And if married less than a cer-

tain period of time and

divorced, they might lose
spousal Social Security benefits as well!
State and Federal Estate
Tax rules allow for the tax-free
passing of assets between
spouses; this too would be lost
upon divorce. This one item
may trigger the largest loss to
the survivor of the former

married couple.
These are but a few of
the items that change when a
couple gets divorced and for
all intents and purposes,
remain married as was
before. There may be a lot at

stake that perhaps the attorney forgets to mention when

first approached by a married
individual looking to discuss
divorce.
Upon a divorce, employer retirement plans usually
result in a negotiated settlement to the non-employee
spouse called a Quadro, the
acronym for a Qualified

Domestic Relations Order.

For couples that remain
together yet get divorced, this
could very well be a bitter pill
as the benefits offered by the
current plan may not be surpassed or duplicated in an

IRA or the recipient spouses

employer 401k plan. This is
one serious area that might be
considered when contemplating divorce, if the future is to
be that the couple remain
together.
Then there are the legal
expenses incurred by both
parties to consider. If there is
no big, glaring, overwhelming

reason or many reasons to get

divorced and after considering
the points brought to light in
this column, maybe planning
a divorce should be postponed, if the couple desires to
remain together as a couple
anyway.
Divorce rate statistics are
very high in our society. Just
ask any school age child how
many of his or her peers parents are divorced and the
numbers may frighten you.
Lets also not forget the cost of
duplication, the purchase of
another home and everything
that goes into it from pots and
pans, sheets and towels, furniture, utility bills and property
taxes too. After contemplating everything involved, you
might even find your spouse a
little more agreeable to live
and work with. If not, you
may always remain friends or
friendly as the case may be.
Divorce is much more
that a legal battle; it has consequences of taxation, income
today and tomorrow as well as
quality of life. In my career,
Ive counted more than a few
couples who were former married couples now living
together, with caring feelings
for each other that would be
better served in the future
when one passes if they
remained married. The good
news is for a few dollars and
an appointment at the courthouse, they can marry again.
Let me know your
thoughts by writing or email-

ing me at the contact info

below. For those that do
divorce where the thought of
remaining a couple would be
out of the question, a meeting
with a financial advisor may
be just as important as the
meeting with the divorce
attorney. To that end, I make
myself available and with no
cost or fee.

IRS warns: Thats not us calling you

ake a deep breath

before responding to
any communication
about your tax return and
verify that the query is actually
from the IRS. Why the need
for caution? The contact may
be from a bogus IRS agent who
intends to steal your financial
identity.
The scam can take many

forms and often starts with an

official-looking e-mail complete with IRS logo that warns
you of a problem with your
return. To correct the situation,
youre instructed to click on an
embedded link. The link sends
you to a website that asks a
series of personal questions.
Answers you supply can be
used to file fraudulent tax

returns or extract money from

your bank accounts.
Another tactic is a phone

call from a fake IRS agent

demanding
information.
Sometimes the phone call will

follow a recent e-mail intended

to make the communication
seem legitimate. The caller
might even know the last four
digits of your social security
number.
Here is what you need to
remember: The IRS will never
initiate contact with you by email.
How can you stay safe
from scams? If you receive an
out-of-the-blue e-mail purporting to be from the IRS, do not
click any link or reply in any
way. If you receive a phone call
about your tax return, do not
provide any personal details.
Simply note the callers information and disconnect.
Whether youre contacted by e-mail, phone call, or
standard mail paper notice,
please call our office immediately. Well help you determine
if the communication is real

or not and guide you on the

best way to respond.

Memorial Day throughout the Nation

continued from page 1

ended, especially in a hymn

not published until 1867 by
Nella L. Sweet called Kneel
Where Our Loves Are
Sleeping. Maybe it would be
safe to say that Memorial Day
had its start in numerous
places wherever the celebration of the patriotic dead was
carried out.
To go back to its beginnings, the first state to officially recognize what was
originally called Decoration
Day was New York in 1873,
followed by all the Northern
states by 1890. However, the
South refused to acknowledge the observance, honoring their dead on separate
days until after World War I,
when the holiday changed
from honoring just those who
died fighting in the Civil War
to honoring Americans who
died fighting in any war.

Southern communities set

aside a day to mark the end of
the war or as a memorial,
such as Sharpsburg, Maryland
(Antietam
Battlefield),
Charleston, South Carolina,
Petersburg, Virginia, and
Columbus, Mississippi.
The popularity of the day
and the use of poppies were
heightened in 1915 with the
December publishing of the
World War I poem In
Flanders Field by Lieutenant
Colonel Dr. John Mc Crea.
Inspired by the poem, Moina
Michael replied with her own
four-line verse extolling the
use of the red flower on graves
and on clothing.
Governor Nelson A.
Rockefeller signed a proclamation on March 7, 1966,
that the State of New York
officially recognized Waterloo
as the birthplace of Memorial
Day. The Congress of the

United States passed House

Concurrent Resolution 587
on May 17 and May 19, 1966,
in Waterloos favor. Also, on
May 26, 1966, President
Lyndon B. Johnson signed a
Presidential
Proclamation
recognizing Waterloo.
The National Holiday
Act of 1971 made every last
Monday in May the national
observance of Memorial Day.

This ensured a three-day

weekend for all involved, but
it has come under criticism
by some veterans groups, who
feel that the three days takes
away from the feeling of the
observance. Several southern
states have an additional separate day for honoring the
Confederate war dead, such
as January 19 in Texas, April
26 in Alabama, Florida,

Memorial Day in 2015
falls on Monday, May 25, and
however you choose to spend
it, whether by a cookout or
going to a parade or both, is
totally personal. Memorial
Day is a time of reconciliation
and
remembrance,
and

whether you know the soldiers name(s) or not, it is a

period to think of what they
have done for us. Many have
made the ultimate sacrifice in
giving their lives for what we
as Americans believe, and no

How to find more time for family

orking
parents
tend to have hectic schedules, and
those responsibilities often
impede on the time moms and
dads get to spend with their
families. Many parents strive
to make more time for their
families, and doing so can
prove a greater reward than
any promotions or bonuses
earned at the office.
For those parents whose
efforts to achieve better worklife balances remain works in
progress, the following are a
few ways to free up more time
for those people who matter
the most to you.
Stop working. Once you
leave the office for the day,
resist the temptation to pick
up your smartphone and check
your email or listen to your
voicemail messages. Smartphones have made it easier

NDS
ALL BRIACED
SERV

than ever before to stay connected to the office. But many

working professionals feel this
convenience has a significant
downside, making them feel as
if they are working round-theclock, even during moments
that were initially earmarked
as family time. Working parents who want to make the
most of the time they have
with their children should
ignore their smartphones during dinner or the time they
spend hanging out with their
kids or helping them do their
homework. You can always
sneak a peek at your emails
when the kids go to bed.
Shake things up. If your
list of responsibilities is truly
taking time away from your
family, dont be afraid to
shake up your routine. For
example, instead of cooking
dinner alone, involve the

kids so you can get some

extra time in with them. If
you like to go on a nightly jog
around the neighborhood, let
the kids accompany you on

with your children.

Propose changes at work.
Work is one of the biggest
consumers of parents time.
Parents who feel their work

their bicycles so you can still

get your exercise without
having to sacrifice time spent

schedules are inefficient or in

need of some change should
try to think of ways to

approach those inefficiencies

so they arent having such
adverse effects on family time.
Business travel was once a
reality of life for many working
professionals, but nowadays
technology, such as video conference calls, can let working
moms and dads stay closer to
home without sacrificing their
productivity. Before bringing
any issues to your boss, think
of realistic ways to institute
change so you and your
coworkers can get more time
with your families without
falling short of company goals.
Move closer to the office.
Though this might be a drastic
change, moving closer to the
office might free up more time
for parents to spend with their
families than any other potential change they can make.

more than 8 percent of workers have a commute to work

of 60 minutes or more.
The Census Bureaus 2013
American Community Survey
also found that nearly 24 percent of workers worked outside their county of residence,
which no doubt contributed to
the nearly 26-minute average
commute time to work.
Parents who feel their commutes are greatly diminishing
the time they get to spend
with their families may want
to consider moving closer to
their offices so they spend less
time sitting in traffic and more
time with their families.
Many parents are determined to spend more time
with their families, and those
willing to make a few adjustments can find that goal is not
as difficult as it seems.

Get your dog in shape

umans are not the

only animals that
may get a bit pudgy
around the middle and tip the
scale in the wrong direction.
Mans best friend also may put
on some extra pounds, necessitating a workout plan to get
back into shape.
According
to
the
Association for Pet Obesity
Prevention, 53 percent of
adult dogs in the United
States are classified as overweight or obese by their veterinarians. Yet, pet owners are
sometimes unaware that their
prized pooches are overweight.
Overweight dogs and cats
face some of the same health

risks as overweight men

and women. Musculo-skeletal
problems, such as degenerative

joint diseases, and back problems have been linked to obesity, as have heart disease and

respiratory problems. Diabetes

and heat or exercise intolerance are other side effects of

being overweight.
But a pets weight is not
the lone indicator of how
healthy the animal is, and the
ideal weight can vary from dog
to dog. A body condition score
is helpful in determining a pets
ideal body weight. Some indications a dog may not be at a
healthy weight include:
-a belly that hangs below the rib
cage area
-a belly that moves when the dog
moves, unless the dog is pregnant
or has just given birth
-inability of the owner or vet to
feel the dogs ribs in the rib cage
-a waddle of skin on the neck of
dogs where excess skin isnt
indicative of the breed

-no visual indication of dogs waist

-inability of the owner or vet to
feel the bones near the base of the
tail
-a less active lifestyle, including
avoiding exercise and play
-excessive panting
Keeping a dog in shape is
one of the best things you can
do for your pet. But what if
your dog already has packed on
a few unnecessary pounds? Its
time to start a canine fitness
routine and follow some other
guidelines.
Talk to your veterinarian.

Consider a new food. There
are many different types of
foods on the market, including
low-calorie options. Some
foods contain extra fiber to
help the dog feel fuller without
having eaten as much. Also,
look for foods with lean protein

other filler.
Break up the feeding schedule. Instead of one large meal a

Take up swimming. Many

SUMMER REGISTRATION going on now!

Manage teams, clubs and leagues in a digital world

ports leagues, afterschool clubs and other

extracurricular activities
enjoyed by children and their
parents would not be possible
without the volunteer efforts of
fellow parents and other adults.
Very often an entire committee
of volunteers gathers to make a
sports team or group successful,
and much of their work is being
done behind the scenes.
Managing a recreational
group is no small undertaking.
Such an endeavor requires the
patience and perseverance of
volunteers ready to juggle a
variety of tasks. While in the
past there may have been few
resources to aid in such tasks,
todays technology makes it
easier to handle the responsibilities that come with managing a team. The vast array of
apps available for smartphones,
tablets and other devices can
alleviate some of the work for
recreational group managers.
The following are just a handful of applications league managers can consider to coordinate efforts across the board.
TEAM SNAP: Team Snap is
one of the premier team and
club management services
available
(www.teamsnap

one, even those with little or

no website design experience,
run a team, league or other
organization online. The team
is managed by a team owner
who can choose free services or
a tiered payment plan depending on the option that owner
chooses. Team members are
invited to join free, where they
can message other players,
check calendars and even get
text message alerts.
TEAM PAGES: Having a current and well-designed website
can encourage others to be
more involved and invested in
a particular team or league.
However, sometimes getting a
website up and running can be
challenging, particularly to the
novice designer. With Team

How to make your renovation a successful, positive experience

By Scott McGillivray

n the United States, renovation spending has more

than doubled since the late
1990s, reaching nearly $65 billion last year alone. Oftentimes
the investment a homeowner

financially and emotionally.
The stakes are high. Thats why

on the inside that counts

seems apt. While homeowners
tend to get caught up in the
aesthetics of a project, such as
finishings and paint colors, the
key to a successful renovation
often lies in what you wont
see. Investing in quality behind
your walls will ensure durability, comfort and safety for years
to come.
6. Focus on the basics. This
includes quality electrical,
plumbing, HVAC, framing and
drywall. Dont underestimate
the importance of insulation especially in a basement renovation. Not all insulation is
created equal. Opt for insulation that is fire-resistant, sound
absorbent and resistant to

mold,
mildew,
bacterial
growth, and rot. In my renovations, I like to use products like
Roxuls Comfortbatt and
Comfort-board IS to help
achieve a more energy efficient
home, buy you valuable time in
the event of a fire and prevent
moisture issues that can pose
health risks and lead to costly
repairs.
7. Develop a good plan. This
includes preparing for the
unexpected. Setting aside a 20
percent contingency fund will
help bring you to the finish line
when unanticipated issues
creep up.
Lastly, the key to a successful renovation includes
patience. Living in a construction zone - or alternately mov-

ing out while the work is done

- can be stressful and trying.
Keep your eyes on the prize.
Theres nothing more rewarding than the end result, which
can bring years of enjoyment
and ultimately add to your
homes bottom line.

Manage teams, clubs and leagues in a digital world

Simple techniques
to help you relax

inding ways to relax

can improve life at
home and at the office.
While its not often easy to
find time to slow down, especially for those men and
women juggling the responsibilities of career and family,
the following are some simple
techniques that dont take
much time but can have a
positive impact on your day.
Take some time out from
multitasking. The ability to
multitask is a cherished commodity for parents and working professionals alike, but
men and women can benefit
from periodic breaks from
their everyday juggling acts.
Something as simple as focusing on a single task for 30
minutes at a time, as opposed
to checking emails while
preparing dinner or working
on a project while answering a
clients phone call, can help
lower stress levels and have a
lasting and calming effect on
your nerves.
Make time to meditate
every day. Studies have shown
that meditation can affect the
circuitry in the brain, positioning it to more adequately
respond to illness and stressful
situations. Meditation has the
added benefit of being a relaxing exercise, as meditation
encourages people to sit with
their feet on the floor with
both eyes closed in a relaxing
setting that is free of external
distractions.
Walk away from your
desk and couch. Its well documented that spending too
much time sitting at a desk
can have a negative impact on
your health. In addition to
elevating a persons risk of
heart disease and diabetes, sitting at a desk all day long has

been linked to
repetitive stress
injuries, obesity
and back pain,
each of which can
contribute
to
stressful
living
conditions
that
make it difficult to
relax. Men and
women should spend at least
five minutes each hour walking, whether they are getting
up from their desk at work or
getting off the couch at home.
Doing so takes little time, but
it can help to relieve stress at
work and at home and
improve your overall health.
Practice yoga. Yoga is

men and women relax. Yoga

helps stretch the muscles and
aid their recovery from everyday aches and pains, including

The time has come for grill masters to gear up

rilling season has

returned for the millions of people who
live in regions where grilling
is unlikely to happen during
the winter months. While
standard fare like hot dogs and
hamburgers may suffice for
backyard barbecues with lots
of friends and family, when
the party is smaller, grill masters may want to up their
games and try their hands at
something new. Tri-tip steak
is cut from the bottom of the
sirloin and is popular on the
West Coast of the United
States, but this cut, which is
suited to marinating and rubbing, can be enjoyed anywhere.

Those who want to give

tri tip steak a shot may find it
sold as bottom sirloin roast in
their local grocery store or
butcher shop. But once you
find the right cut, the following recipe for Grilled Tri-Tip
with Black Olive Aioli courtesy of Bill Niman and Janet
Fletchers The Niman Ranch
Cook-book (Wiley) is sure to
please you and your guests the
next time you fire up the grill.
Grilled Tri-Tip with Black
Olive Aioli
Serves 4 to 6
1 tri-tip steak, 2 pounds
1 tb olive oil
2 tbs fresh rosemary leaves,
chopped
1 tb freshly cracked black pepper

cup finely chopped pitted oilcured black olives

1 cup aioli (see below)
1 tb coarse sea salt
Cayenne pepper
Place the steak in a
small, nonreactive baking
dish. Combine the olive oil,
rosemary and black pepper in
a small bowl and stir well. Rub
the mixture evenly over the
tri tip. Cover with plastic
wrap and refrigerate for at
least 8 hours or up to 24 hours.
Remove the tri-tip from
the refrigerator 1 hours
before cooking.
Prepare and light a charcoal grill for direct cooking.
Add the olives to the
aioli and season with cayenne.

When the grill is at its

hottest (when the coals are
red and glowing and its too
hot to hold your hand over
the grill for more than a couple of seconds), remove the tri
tip from the marinade, wipe
off any excess marinade, and
season on both sides with sea
salt. Place the steak on the
cooking grate directly over
the coals, cover the grill, and
cook, turning once, for about
20 minutes, or until a thermometer inserted into the
thickest part reads 130 F for
medium rare. Transfer to a
cutting board and let rest for 5
to 10 minutes.
Cut the tri-tip into thin
slices across the grain and

arrange on a platter. Serve

with aioli.
Aioli
Makes about 1 cup
1 small clove garlic
tsp kosher salt
1 tsp Dijon mustard
2 tsp fresh lemon juice
2 egg yolks
1 cup olive oil
To make by hand, chop
the garlic and salt together on a
cutting board until a paste
forms. Transfer to a deep mixing
bowl and wrap a damp towel
around the base of the bowl to
keep it from sliding around the
counter as you work. Whisk in
the mustard, lemon juice and
egg yolks. While whisking continuously and vigorously, add

the olive oil in a slow, thin,

steady stream until all of it has
been incorporated and the mixture is thick and completely
emulsified.
To make the aioli in a
food processor, place the garlic and salt in the work bowl
and process to chop as finely
as possible. Add the mustard
and lemon juice and pulse to
combine. Add the egg yolks
and, with the motor running,
add the olive oil in a slow,
thin, steady stream until all of
it has been incorporated and
the mixture is thick and completely emulsified.
Cover and refrigerate for
up to 24 hours until needed.

What to look for in an investment property

istorically,
the
appreciation rate for
real estate is very
strong. Even when the housing market declines, longterm investors in real estate
can rest easy knowing that
property values tend to
rebound rather quickly,
rewarding patient investors
in the process.
Looking at real estate as
a long-term investment is
just one way to approach a
potential investment property. The following are a few
additional considerations
prospective investors should
contemplate before buying
an investment property.
LOCATION
Many people are famil-

iar with the real estate industry axiom, location, location, location! When buying an investment property,
location is everything. A
great location should outweigh your own personal
feelings about the home,
especially if you do not
intend to live at the property. You will likely define a
great location for an investment property differently
than you would a property
you intend to live in, so
dont let your own desires in
a home cloud your judgement when choosing an
investment
property.

DCOR
Dcor is another thing
to consider when looking for
an investment property. If
you dont plan to reside in
the property, your opinion of
the dcor should not carry
much weight. When viewing
a property, try to imagine
how much it might appeal to
prospective tenants. Quirky
properties typically do not
appeal to as many prospective tenants as properties
whose dcor are similar to
other homes in the area.
Though you might find a
tenant who prefers properties
with unique interiors, a property that appeals to as many
prospective tenants as possible often makes for a better
investment and a lot less
stress when the time comes
to find tenants.
CONDITION
The condition of the
property also must be considered before buying an investment
property.
Some
investors want a fixer-upper,
while others prefer turnkey
properties that wont require
any elbow grease. The former

type of property likely wont

cost as much as a fully renovated property, but those cost
savings might be lost when
its time to renovate. Find a
property thats in the type of
condition youre comfortable
with. If you decide to go with
a fixer-upper, learn the cost
of your potential projects
before submitting an offer.
COST
Real estate makes a great
investment, but dont go overboard when buying an investment property. Before making
an offer on a property,
research rents in the area and
the cost of insurance in that
particular neighborhood. You
want a property that essentially pays for itself, so make sure
the rent youre likely to collect is enough to cover your
monthly costs, including the
mortgage on the property,
insurance and the costs associated with managing and
maintaining the property.
Real estate investors
often reap great rewards
when selling their properties.
But its still important for
potential investors to consider a host of factors before
investing in a property.

or the past 40+ years, if

you ask local residents
about Century 21 Crest

likely hear of the exemplary
treatment they received when
purchasing their home here in
Pequannock/Pompton Plains.
But there is another story you
may also hear....one in which
a group of giving and generous
individuals who care about
the communities they serve.
The professionals at
Century 21 Crest Real Estate
have been volunteering their
time and giving generously
to various Township and

decades. To honor these professionals,

supporting Township athletes,

the years. The bottom line is
that we really care about our
