I am writing to request participation in the Delegation of Authority Program pursuant to 287 (g)
of the Imrrtigration and Naturalization Act. Given OUf past relationship with ICE. this partnership
will enable us to better serve the needs of the residents of Cumberland County and Fayetteville.

Dear Sheriff Butler,

Thank you for your interest in the 287(g) Delegation of Authority program. Thi s letter is to
notify you that the Office of the Ass istant Secretary for U.S. Immi grat ion and Customs
Enforcement (ICE) has received your request for 287(g) Delegation of Authority training for
the Putnam County Sheriff's Office.

On June 7, 2007, the Program Manager for 287(g) Delegation of Authority at lCE
Headquarters forwarded your request for participation in the 287(g) program to the Special
Agent in Charge (SAC). and the Field Operations Director (FOD) for the Atlanta area of
responsibility (AOR). The SAC and FOD, along with a member of your staffwilll1eed to
conduct a feasibility assessment study. After compl etion, the assessment will be reviewed at
ICE Headquarters and a detennination will be made to either accept or deny your request to
participate in the program.

Should you require information concern ing the status of your request to participate in the

Dear Ms. Skinner:

As of 12:01am October 15,2009 the Cumberland County Sheriff's


Office, Fayetteville, North Carolina, is no longer participating in
the detention portion of the 287(g) program.

Our detention facility is currently reaching capacity most days


and we are close to a significant population increase as Ft.
Bragg goes through the military BRAC Program. Of great concern
to me, as well, was a considerable amount of language in the ICE
submitted MOA that I could not accept as a Sheriff and local
governmental official. Finally, the copy I received was so very
close to the deadline set that the time frame was woefully short
of a reasonable period to contemplate a document of such
importance.
