INTRODUCTION:The Armed Forces Tribunal Bill, 2005, was presented in the Rajya Sabha on December 20, 2005.
The bill was suggested to the standing board on defence, led by Balasaheb Vikhe Patil, on
December 27, 2005.

Armed Forces Tribunals are in existence in other countries such as the UK, Germany, France and
Australia. The tribunal here would be formed on the lines of the Central Administrative Tribunal.
Appeals against the tribunal's award must be filed in the Supreme Court.
The issue of setting up of the tribunal has also been examined by the law commission. The move
to establish the tribunal assumes significance since over 7,000 cases of armed forces personnel
are pending before the High Courts and the Supreme Court
The Armed Forces Tribunal comprising a chairperson and judicial and administrative members
shall be established by the central government. The chairperson and members shall be appointed
by the president in consultation with the chief justice of India and may be removed from office
only under specified circumstances.
An individual wronged by a request relating to any administration matter may make a provision
to the tribunal. Administration matters are in connection to persons subject to the Army Act,
1950, the Navy Act, 1957, and the Air Force Act, 1950, and incorporate compensation, residency,
leave, preparing, advancement and trials.
The tribunal, after a request might concede the requisition assuming that it is fulfilled that the
provision is fit for mediation. A provision ought be conceded just if the aspirant has debilitated
all cures accessible to him under the Army Act, 1950, the Navy Act, 1957, and the Air Force Act,
1950.
The proposed tribunal will offer an opportunity to the Army, Navy and IAF personnel to appeal
against court-martial orders relating to service conditions, promotion, confirmations and
appointments. This is aimed at dispensing with the system where officers have no option but to
air their internal grievances in open courts
CONCLUSION:
An Effective Tribunal composed of competent members adhering to fair procedures and armed
with Requisite powers with alone inspire confidence amongst the litigants. Once the tribunal is
constituted, all trials relating to the guard, war fleet and flying corps acts pending before the
common courts including the HC send to these tribunals. The court won't be bound by the Code
of Civil Procedure however will be guided by the guideline of regular equity and subjected to the
procurements of this demonstration. Any request against the tribunal's requests might be made to
the Supreme Court
