BASIC LAW
ARTICLE I
NAME AND DOMICILE
SEC. 1 The name of the student council shall be Autonomous Student Government
(ASG) of the University of Southern Mindanao-Kidapawan City Campus.
SEC. 2 The student council shall hold office at the University of Southern MindanaoKidapawan City Campus, Sudapin, Kidapawan City, Province of North Cotabato.

ARTICLE II
DECLARATION OF PRINCIPLES AND OBJECTIVES
SEC. 1 The ASG is a democratic student government of USM-KCC. The sovereignty
resides among the students.
SEC. 2 The ASG is autonomous in governance and fiscal management. It has the sole
power and authority on matters within its jurisdiction. However, the ASG acknowledges
the leadership of the University Student Government of the main campus as an ally in
implementing rules that are beneficial for the students and the university in general.
SEC. 3 It is committed to support all student-related undertakings of the university which
are beneficial to students.
SEC. 4 It gives priority to student projects and activities that promote holistic
development of all USM-KCC students.
SEC. 5 The ASG is committed to uphold the following objectives:

a. To promote understanding, harmonious social relationship and cooperation


among the students of USM-KCC.
b. To develop a sense of responsible leadership and commitment for the interest of
all its members.
c. To unite all members of this council into one unified group, sharing the same
principles and objectives of the council that are not contrary to the law of the
Republic of the Philippines and international laws.
d. To promote the general welfare of the whole studentry by planning, conducting
and pursuing activities beneficial for the students.
e. To enable the students to render good, fair and productive services to the school
and community, particularly, to our country and above all to God.
f. The ASG shall be the highest student-governing body of USM-KCC and shall
represent the voice of the students to the Management Council of USM-KCC
and to the other authorities of USM.
g. The power of this council shall emanate for the interest of the whole studentry.
h. It shall support any organization, association, which will promote moral,
cultural spiritual and physical development of the campus.
i. The ASG shall defend the rights of the students.

ARTICLE III
MEMBERSHIP
SEC. 1 All students duly enrolled at the University of Southern Mindanao-Kidapawan
City Campus, not otherwise disqualified by law, regardless of sex, race and religious or
political belief or affiliation and upon payment of corresponding fees is eligible for
membership in the association. They shall be entitled to vote and hold office, if elected
during the duration of his/her stay as student of the institution.

ARTICLE IV
BILL OF RIGHTS
SEC. 1 The right to receive primarily through competent instructions, relevant and
quality education in line with national goals and regional development as a person with
dignity.
SEC. 2 The right to freely choose their field of study subject to existing curricula and to
continue their course thereon up to graduation except in cases of academic deficiency or
violation of disciplinary regulations.
SEC. 3 The right to receive guidance and counseling services in making decisions and
selecting the right field of works suited to his/her potentials.
SEC. 4 The right to receive official certificates, diplomas, transcript of records, grades,
transfer credentials and other similar documents in line with the policy rules and
regulations of the university.

SEC. 5 The right to publish student newspaper and similar publications as well as the
right to invite resource persons during assemblies, symposia and other activities.
SEC. 6 The right to express freely his/her opinions, suggestions and to be effective
channel of communication with appropriate academic manner.
SEC. 7 The right to form, establish, join and participate in any organizations, clubs and
associations that is not to the higher law.
SEC. 8 The right to be secured in their living quarters, dormitories, papers and properties
against unreasonable searches and seizures of whatever nature and for any purpose should
be inviolable and no search warrant nor warrant of arrest shall be issued except upon
probable cause to be determined personally by the proper authorities after examination
under oath or affirmation of the complaints and witnesses he/she may produce and
properly determine the place to be searched and persons or things to be searched.
SEC. 9 No student shall be prejudiced in the execution of justice without due process of
law nor shall be denied the equal protection of the law.
SEC. 10 no student laws, school rules and regulations, memoranda, enactments and
instructions shall be passed/issued abridging the freedom of speech, expressions or of the
press, or the rights of the students to peaceably assemble and petition the institution and
the duly constituted authorities for redress of grievances.
SEC. 11 Any student under investigation for violation of rules and regulations and any
other law shall have the right to be informed of his rights prior to the conduct of
investigation without the use of torture, force violence, intimidation, emotional and sexual
harassment and other means which hinder the free will.
SEC. 12 Students of this institution have the right for an immediate and fair investigation
of their cases.
SEC. 13 No student shall be denied for admission of this institution on account of his/her
physical handicap, socio-economic status, political or religious belief, and sexual
orientation.
SEC. 14 No student shall be forced to sign any agreement or waiver provided and
required by the school and or any other organization for any purpose.
SEC. 15 Free access of student to their personal records or school files from the
University Administration prior from the day of request for any legal purposes that may
serve best.
SEC. 16 The right to transparency of all records of the professors and or instructors
pertaining to the giving of grades.
SEC. 17 The right to run for any qualified positions to the Autonomous Student
Government of Kidapawan City Campus as well as in the University Student Government
of USM, Kabacan without prejudice.

ARTICLE V
DUTIES AND RESPONSIBILITIES OF THE STUDENTS
SEC. 1 Exert capability to develop his/her potentials for service particularly going to an
educational trips and relevant activities suited to his/her abilities in order that he/she may
become an asset to his/her family or society.
SEC. 2 Uphold the moral integrity of the college, endeavor to achieve academic
excellence and by the rules and regulations governing his/her academic responsibilities.
SEC. 3 Promote peace and tranquility of the college by observing the rules of discipline
and by exerting efforts to attain harmonious with students, teachers, and other school
personnel.
SEC. 4 Participate actively in civic affairs and the promotion of general welfare
particularly in the social-economic, political and cultural development of his/her
community in the attainment of a just, compassionate, humane and orderly society.
Students who failed to attend duly recognized activities of the university shall be subjected
to disciplinary action. Disciplinary actions shall be determined by the Senate through a
senate resolution duly approved by the ASG President.
SEC. 5 Exercise his/her rights and responsibilities in the knowledge that he/she is
answerable for any infringement or violation of the public welfare and rights of others.
SEC. 6 Defend the USM-KCC-CIT from any internal and external threat that will
infringe the students right to acquire quality education.
SEC. 7 Uphold the students code promulgated by the University of Southern Mindanao
Board of Regents.
SEC. 8 All students shall be subjected to the highest student code regarding student
conduct and discipline formulated by the Board of Regents.

ARTICLE VI
ASG STRUCTURE
SEC. 1 The structure of the ASG shall be organized into Executive Branch, Legislative
Branch, Local Student Government, Commission on Audit and the Commission on
Elections.
SEC. 2 The person having the highest number of votes in any position shall be
proclaimed the winner, but in case two or more shall have an equal number of votes in any
positions, in which case the winner cannot be determined, a toss coin shall be done by the
COMELEC with the presence of both parties, whosoever win, shall be proclaimed winner
by a chance of luck.
SEC. 3 In case that a candidate during the election has no opponent, he/she must have to
get the majority vote of the total number of actual turn-out of votes in the specific position
he/she is running to for him/her to be declared as winner.

SEC. 4 Any elected or appointed ASG officials must not hold any major position outside
to any recognized organization of the university, in the Commission on Audit and in the
Commission on Election.
SEC. 5 All officers of ASG shall hold office for 1 academic year.
SEC. 6 The election shall be held in accordance to the date set forth by the COMELEC of
this college.
SEC. 7 Assumption of the office of the winning elected officers shall commence on the
first Monday of May.
SEC. 8 A student who will undergo internship, on-the-job training, apprenticeship or its
equivalent outside the USM-KCC-CIT campus on any semester of the next school year
following the election shall be allowed to hold the office only if he/she satisfies the other
qualifications set forth by competent authorities.

A. EXECUTIVE BRANCH
SEC. 9 The executive power shall be vested in the President of the Autonomous Student
Government of USM-KCC who will be selected by students of USM-KCC in a general
election.
SEC. 10 The Vice President be elected in a popular vote along with the Executive
Secretary, Executive Treasurer and the Executive Public Information Officer.
SEC. 11 Qualifications
A. For President and Vice President
a. A bona fide college student of USM-KCC-CIT.
b. A resident of the college for at least two (2) academic years or four
semesters.
c. Must not be an editor or staff of The Techno Builders or any student
publication of USM-KCC.
d. Must not have any failing grades for two consecutive semesters before
the conduct of the election.
e. Must be of good moral character.
B. For the Executive Secretary, Executive Treasurer and Executive Public
Information Officer.
a. A bona fide college student of USM-KCC-CIT.
b. A resident of the college at least 1 academic year or 2 semesters
c. Must not be an editor or staff of The Techno Builders or any student
publication of USM-KCC.
d. Must be of good moral character.
C. For Cabinet Secretaries
a. The President has the power to appoint and/or designate Cabinet
Secretaries or Undersecretaries when the need arises subject to the
confirmation of the Committee on Appointments.
D. The President may create committees when the need arises, such appointment
must not exceed one semester.
SEC. 12 The Presidency is declared vacant when:
A. Upon resignation.

B. Incapable to discharge his duties due to mental, physical, or psychological


distress or incapacity.
C. Has lost moral ascendency to govern charged with a criminal offense with more
than 6 months of imprisonment.
D. Death.
SEC. 13 Other elected official may be removed from the office with same conditions as
the President
SEC. 14 Duties and responsibilities of the elected officers
A. President
a. To represent the ASG in the USM-KCC Management Council and other
important gathering that will help uphold the welfare of the students.
b. Act as Executive officer.
c. To sign resolutions, bills, and/or documents pertaining to the
disbursement of funds which will be utilized during school programs,
activities or undertakings and other official communication letters.
d. Create committee.
e. To veto resolutions with corresponding legal explanation of having such
action.
f. To appoint officers including the vacancies for elective positions subject
for confirmation by the Committee on Appointments.
g. To preside over meetings.
h. To act and vote on motion in case of tie.
i. To introduce new members to the council.
j. To initiate annual planning of activities for the advancement of the
students.
k. To recommend to the Senate the dismissal of the officers who are found
notoriously undesirable.
l. To exercise his prerogative power in case of emergency.
m. To make report upon completion of term.
n. To approve the release of the council properties.
o. To give information, memorandum of any special meetings and sessions
2 days ahead of time prior to the said meeting.
p. The President may make an Executive proclamation which shall be
concurred by the legislative within 72 hours otherwise it will be
rendered invalid.
q. The President shall submit a proposed budget to the senate for 1 year
intended for student activities.
r. The President may call upon the president of organizational and mayors
to be a member of the committee that shall undertake students activity
and programs.
B. The Vice President
a. In the absence of the President he/she shall perform the duties and
responsibilities of the President.
b. Responsible to bring execution on the plans for all projects and
supervise the projects with the President.

c. Attend all regular or special meetings for the Legislators and pass a bill
and resolution same of the power of the Legislators.
d. In the law of succession must be second from the President.
e. Perform duties assigned to him/her by the President.
C. The Executive Secretary
a. Take charge of all records of the members.
b. Keep records of minutes of the meetings for the Executive, General
Assembly and Joint Legislative and Executive.
c. Print and post council minutes inside the office before the preceding
meeting.
d. Perform the duties assigned to him/her by the President.
D. The Executive Treasurer
a. Be the custodian of the funds of the council.
b. Receive all the money due from the members and will duly credit them.
c. Authorized to receive membership fees and sign clearance.
d. Keep records of all receipts and disbursements for all money expended.
e. Prepare all financial reports.
f. Perform the duties assigned to him/her by the President.
E. The Executive Public Relation Officer
a. Serves as the liaison officer of the Executive Branch.
b. Responsible for disseminating information as directed by the President.
c. Perform the duties assigned to him/her by the President.
SEC. 15 The President cannot be re-elected. Voluntary renunciation of the office for any
length of time shall not be considered as an interruption in the continuity of the service for
the full term for which he was elected.
SEC. 16 The President shall nominate on the beginning of his/her term, the members of
his/her Cabinet subject for the confirmation of the Committee on Appointment.
The President shall be assisted by the Cabinet composed of the following Departments:
a. Department of Defense and Security
b. Department of Social Welfare and Services
c. Department of Sports Development
d. Department of Socio-Cultural Affairs
e. Department of Property Management
f. Department of Waste Management and Beautification
g. Department of Monitoring and Services
SEC. 17 Any elected/appointed Executive official shall attend all regular and special
meetings of the Executive Branch, General Assembly and Joint Legislative and Executive.
A. Failure of attending the said meetings shall be subjected to disciplinary action.
B. Disciplinary action shall be referred on the agreed penalty of the council.

B. LEGISLATIVE BRANCH
SEC. 18 The Legislative power shall be vested in the Senate of the Autonomous Student
Government.
SEC. 19 The Senate shall be composed of twelve elected Senators and one Senate
Secretary who has no voting power.

SEC. 20 Qualifications of Senators


1.) A bona fide college student of USM-KCC-CIT.
2.) A resident of a college at least 1 academic year or 2 semesters.
3.) Must not be an editor or staff of The Techno Builders or any student
publication of the university.
4.) Must be of good moral character.
SEC. 21 A Senator can be re-elected. Voluntary renunciation of the office for any length
of time shall not be considered as an interruption in the continuity of his/her service for the
full term for which he was elected.
SEC. 22 No Senator shall hold any concurrent major position in other campus
organizations nor shall be appointed to fill such vacancy in the Executive Department,
Local Student Government and Commission on Elections.
SEC. 23 The Senate shall elect its Senate President, President Pro Tempore and other
officers as it may deem necessary by the majority vote of all its members.
SEC. 24 The Senate may determine the rules of its proceedings, punish its members for
disorderly behaviors, and with the concurrence of 2/3 of its members, expel a member in
its session.
SEC. 25 The Senate shall keep a journal of its proceedings and publish from time to time
and the ayes and nays on any question shall be entered.
SEC. 26 The Senate shall observe the accepted rules of Parliamentary Procedure in all of
its session and proceedings, and shall adopt an official textbook (Roberts Rule of Order)
on Parliamentary Procedures to serve as their source of authority.
SEC. 27 The Senate shall be create Committee on Appointments consisting of the Senate
President as ex officio chairman and 5 Senators as members to be chosen by the majority
of the Legislators. The Chairman of the Commission shall vote in case of a tie. The
Commission shall act on all appointments submitted to it within 4 days from their
submission and shall rule by the majority vote of all its members.
SEC. 28 The Senate may create other committees when the need arises.
SEC. 29 All appropriation of revenues and other sources of fund shall exclusively
originate in the Senate.
SEC. 30 The Senate may increase the appropriations recommended by the President for
the operation of the student council as specified in the budget, except there will be some
changes of the budget and should be voted upon by the majority of the members of the
Senate.
SEC. 31 The Senate shall enjoy fiscal autonomy in the conduct of its official functions
and duties and any expenses shall be subjected to auditing by the Executive Auditor in the
end of every semester.
SEC. 32 Every bill/resolution passed by the Senate shall only embrace one subject which
shall be expressed in the title thereof.
SEC. 33 No bill/resolution shall be approved unless it has passed three readings,
otherwise provided.
SEC. 34 Every bill/resolution passed by the Senate shall before be approved, be
submitted for approval to the ASG President. If he approves, he sign it; otherwise it shall
become a law in 10 days from its approval on the Senate, veto it and return the same with

his objections to the Senate. If the President shall not communicate his veto after 3 days
from the date of receipt thereof; in which case it shall stand approved as if he signed it.
SEC. 35 One week after the declaration of the winners of the Senators, the Senate shall
call for the special session with the purpose of electing the incoming Senate President and
the Senate Pro-Tempore that will be presided by the incumbent Senate President.
SEC. 36 The Senate President shall be third in the law of succession from the President.

C. LOCAL STUDENT GOVERNMENT


SEC. 37 The Governor shall be the head and leader of the student government of their
respective department. Among the other LSG officers are the Vice-Governor, Secretary,
Treasurer, Auditor and P.I.O
SEC. 38 The qualifications of LSG officers:
a. A bona fide college student of USM-KCC-CIT.
b. A resident of the department for at least 2 semesters.
c. Must not be a holder of any key position in other organizations,
societies, clubs and fraternities and sororities.
d. Must have good moral character.
SEC. 39 Responsibilities and duties of the LSG Governor:
a. Enforce all laws and ordinance which are applicable within his/her
territory.
b. Negotiate, enter into, and sign contracts for and in behalf of the
department.
c. Maintain public order in his/her department and, in pursuance, thereof,
assist his/her constituents or the members of his/her department and the
ASG in the performance of their duties and functions.
d. Call and preside over the meetings and sessions of the LSG and vote
only to break a tie.
e. In coordination with the Executive and Legislative branch, prepare the
annual and supplemental budgets of their respective department.
f. Approve vouchers related to the disbursement of the departmental
funds.
g. Exercise such other powers and perform such other duties in functions
as may be prescribed by the law.
h. To call special meeting by giving written notice to each member of the
LSG.
i. To appoint, in case of vacancy of the position of the LSG department
the remaining officers may call for special election to fill the sit which
may authorize by the Legislative Branch.
j. Implement policies, programs and projects within his/her jurisdictions in
coordination with the ASG.
k. Submit annual and end-of-term reports to the ASG on their projects and
activities for the survival and development of the LSG in their
department.
l. Represent the LSG in its official capacity as Governor in occasions and
events where the organization needs participation.

m. Be a representative of their department to the ASG.


n. To implement the Parliamentary Procedure during the conduct of the
meeting.
o. Shall pass formally all its duties and responsibilities including pending
transaction to its Vice-Governor before undergoing internship, on-thejob training, apprenticeship or its equivalent outside of USM-KCC
campus.
SEC. 40 Responsibilities and functions of LSG Vice-Governor:
a. There shall be a Vice-Governor who shall have qualifications and be
elected with and in the same manner as the Governor.
b. Shall automatically take over or preside a meeting if the Governor is
absent.
SEC. 41 the LSG Secretary, Treasurer, Auditor and P.I.O shall perform all other
functions traditionally designated to such office and other functions assigned to them by
the LSG Governor.
SEC. 42 General Powers and duties of LSG:
1. Enact budgets Enact annual and supplemental budgets in accordance
with the provision of this code.
2. Provide compensation for LSG officials Provide compensation,
reasonable allowances as well as travel expenses for LSG members and
appointed committees subject to the budgetary limitations prescribed by
law
3. Hold fund raising activities Hold fund raising activities for LSG
projects, programs and activities without the need for securing permits
from ASG. The proceeds from such activities shall be tax-exempt and
shall accrue to the general funds of the LSG provided that in the
appropriation thereof, the specific purpose for which such fund raising
activity has been held shall be first satisfied. Provided further, that the
said fund raising activities shall comply with campus policy standards
and regulations on morals, health and safety of the persons participating
therein. The LSG, through the Governor shall render a public
accounting of the funds raise at the completion of the projects or
programs or activities for which the fund raising is undertaken.
4. Grant authority to enter into contract Authorize the Governor to enter
into contracts in behalf of the LSG, provided that the contracts are
related to his/her jurisdiction.
5. Authorize direct purchases Authorize the LSG Officers to make direct
purchases in an amount not exceeding to Ten Thousand Pesos (Php.
10,000.00) at any one time for the ordinary and essential administrative
needs of the LSG.
6. Provide for welfare of their constituents Provide for the proper
development and welfare of the students in the Department by
promoting and supporting activities for the protection and total
development of students.

7. Solicit funds for activities Solicit or accept money, materials and


voluntary labor for specific activities from any individuals. The monies
or properties donated shall accrue to the LSG as property or fund.
8. Submit recommendations Submit to the ASG such suggestions or
recommendations as it may see fit for the improvement of the campus or
for the welfare of the whole students.
9. Fiscal Autonomy The LSG shall enjoy fiscal autonomy on their
respective Department prescribed by law.
SEC. 43 League of Class Mayors:
a. There shall be elected Class Mayors League President and other set of
officers when need arises.
b. Duties of their League of Class Mayors President and other officers
shall be set by their own league with the approval of the ASG President.

ARTICLE VII
MEETINGS AND SESSIONS
A. EXECUTIVE MEETING
SEC. 1 The Executive Branch with the Cabinet Members, Governors of every department
shall hold regular session on every first and third Thursday of every month with President
as the presiding officer.
SEC. 2 The President shall have the right to call for special meetings with a written
memorandum when urgent issue arises.

B. LEGISLATIVE MEETING
SEC. 3 The Senate shall conduct session separately of the Executive Branch except
during joint sessions.
SEC. 4 The Senate shall convene every first and third Friday of the month for its regular
SEC. 5 The Senate President may call special session anytime if seem deem necessary
with a written notice two days before the special session.

C. JOINT EXECUTIVE-LEGISLATIVE MEETING


SEC. 6 Either the President or the majority of the Senators may call for Joint ExecutiveLegislative meeting which will be presided by the Senate President.

D. ASG MEETING
SEC. 7 The President may call for a general meeting of the council of all the ASG and
LSG officers at any time.
SEC. 8 Each Branch may impose penalty exclusively to their respective members.
SEC. 9 The Senate President may call general assembly of all the ASG at any time with
the approval of majority of the Senators.

ARTICLE VIII
FEES COLLECTION AND FISCAL MANAGEMENT
SEC. 1 The ASG shall enjoy fiscal autonomy in the collection and disbursing of their
funds. the ASG shall collect ASG fees before the start of each semester.
SEC. 2 The ASG Fee shall be amounting to seventy-five pesos (Php. 75.00) per student
per semester.
SEC 3. The financial affairs, transactions and operations of the council shall be governed
by the following fundamental principles:
a. ASG funds and moneys shall be spent solely for the council and student
advancement purposes.
b. ASG shall formulate sound financial plans; budget shall be based on
functions, activities and projects in terms of expected output.
SEC. 4 The President based to the fees collected, shall prepare the budget for the council
priorities within one month from the opening of the class for each semester as for general
appropriation and submit it to the Senate for amendments and approval.
SEC. 5 The Treasurer shall follow standard procedures and effective measures in
releasing the budget from the treasury.
SEC. 6 Any officer, Committee or Department who utilized the released budget is
obliged to submit liquidation report and receipts to the ASG Treasurer one week after the
activity/purpose is conducted.
SEC. 7 The council, if applicable, shall furnish sound financial report to the Office of the
Student Affairs every end of the semester.
SEC. 8 The student government fund shall be deposited in a bank located at Kidapawan
City with a passbook savings account in the name of the council. The signatories shall be
the Adviser and Treasurer and or the President of the ASG.
SEC. 9 Reimbursement shall be accepted only if its provided such expenditure incurred
in accordance with a Legislative resolution or Executive proclamation.
SEC. 10 Diversion borrowing or directing ASG funds other than for its intended projects,
plans and calendar of activities are not allowed unless that these programs are primarily
spearheaded by the ASG officials and a college wide activity.

ARTICLE IX
ADVISORSHIP
SEC. 1 There may be two ASG Advisers, one shall be selected by the ASG officers
through majority of votes and the other one shall be recommended by the Campus Dean
for the term of one year.
SEC. 2 The Adviser shall join in all meetings of the council in his/her availability and not
allowed to speak unless he/she is permitted by the body to do so.
SEC. 3 If in case of absences which committed by the two Advisers, the Executive
Secretary will furnish a copy to them in order for them to be aware of the said meeting.

SEC. 4 The Advisers shall receive a written notice a day before the meeting.
SEC. 5 The two Advisers shall not be given the privilege to cast any votes to all meetings
and sessions.
SEC. 6 The two Advisers shall be assigned by the Legislative Branch to have any ASG
transactions including all financial operation such as depositing and withdrawal of funds
and the like transactions otherwise approved by the Legislative Branch.
SEC. 7 At least one of the two Advisers must be holding a permanent position.

ARTICLE X
COMMISSION ON AUDIT
SEC. 1 There shall be an independent body called the Commission on Audit which shall
be composed of an Auditor and 2 Co-auditors.
a. Officers of the COA
a. 1 Auditor
b. 2 Co-auditors
SEC. 2 Qualifications of the Auditor and Co-auditors:
a. Enrolled student of the institution for at least 2 semesters at their time of
appointment.
b. Not an elected officer in major positions in any campus organizations and in
the ASG.
SEC. 3 The Auditor and the Co-auditors shall be appointed by the President with the
consent of the Committee on Appointments for a term of 2 academic semesters from the
assumption of office.
SEC. 4 The Commission shall exercise the following powers and functions:
a. Make necessary guidelines in the proper disbursement and liquidation of
funds.
b. Receive liquidation reports and other financial documents form the
Executive Treasurer;
c. Submit all financial documents of the student government to the college
accountant for final accounting and auditing procedures.
d. To ratify that all funds of the council are properly accounted for.
e. Before the end of the term, publish audit reports.
f. Recommend disciplinary action to the senate for officers showing
disorderly conduct in the disbursement of organizational funds.
g. Reprimand officers who are neglecting their duties by being
irresponsible and submitting late necessary liquidation report

ARTICLE XI
COMMISSION ON ELECTIONS
SEC. 1 There shall be an independent body called the Commission on Elections which
shall be composed of a Chairman and six Commissioners.
b. Officers of the COMELEC
a. 1 Chairman
b. 6 Commissioners of the COMELEC
SEC. 2 Qualifications of the Chairman and the Commissioners:
a. Enrolled student of the institution for at least 2 semesters at their time of
appointment.
b. Not an elected officer in major positions in any campus organizations and in
the ASG.
SEC. 3 The Chairman and the Commissioners shall be appointed by the President with
the consent of the Committee on Appointments for a term of 2 academic semesters from
the assumption of office.
SEC. 4 The Commission shall exercise the following powers and functions:
a. Submit to the President and to the Senate a report on the result of the
election.
b. Select members of the electoral board from USM-KCC students which
earned higher curricular years.
c. The COMELEC shall be granted sole authority over the planning and
conduct of election.
d. The COMELEC shall conduct election orientation before the election.
e. The COMELEC has the power to set rules and guidelines when needed,
provided that it is not contrary to this law or any laws of the land.
f. The COMELEC shall pass resolutions when necessary and be the sole
authority to decide matters regarding the election.
g. The COMELEC shall have the sole authority to decide on all cases of
election protest.

ARTICLE XI
PROCLAMATION AND TENURE OF OFFICE
SEC. 1 The newly elected ASG officers shall be proclaimed by the COMELEC. For
formality, the COMELEC shall issue a resolution proclaiming and listing the names of all
winning candidates.
SEC. 2 The newly elected ASG Officers shall assume the office beginning at the first
Monday of May for the reason that the elected officers can come up with a sound budget
proposal, program of works and effective planning of activities.
SEC. 3 The newly elected ASG Officers shall be inducted for office in the month of June
and officially hold the office for one academic term as elected ASG officers.

ARTICLE XII
AMENDMENTS
SEC. 1 Any amendment to, or revision of, this Basic Law may be proposed by:
(1) The Senate, upon a vote of three-fourths of all its members; or
(2) A constitutional convention.
SEC. 2 No amendment shall be authorized within three years following the ratification of
this Basic Law nor oftener than once every three years thereafter.
SEC. 3 The Senate may, by a vote of two-thirds of all its members, call a constitutional
convention, or by a majority vote of all its members, submit to the electorate the question
of calling such a convention.
SEC. 4 Any amendment to, or revision of, this Basic Law under Section 1 hereof shall be
valid when ratified by a majority of the votes cast in a plebiscite which shall be held not
later than ninety days after the approval of such amendment or revision.

ARTICLE XIII
SEPARABILITY AND EFFECTIVITY
SEC. 1 Separability Clause. If any part or provision of this Basic Law is held invalid or
unconstitutional, the other provisions are not affected thereby shall remain in force and
effect.
SEC. 2 Effectivity. This Basic Law shall take effect immediately after the approval of
the majority of students in attendance during the conduct of the plebiscite. The ASG Joint
Executive-Legislative however, for formality, must pass a joint resolution acknowledging
such approval.

This Autonomous Student Government Basic Law (ASG-BL) has been ratified by the
University of Southern Mindanao-Kidapawan City Campus students on the 23th day of
February 2015 at the USM-KCC Social Hall. As prescribed by law, such result of this
plebiscite is hereby acknowledged by the Autonomous Student Government through Joint
Resolution No. 01 series of 2015.
