1. Introduction
1.1.
This Preliminary Environmental and Social Report (PESR) has been prepared in the
realm of the Environmental and social Due diligence (ESDD) performed by the InterAmerican Development Bank (IDB) and presents the preliminary assessment of the
environmental, social, occupational health and safety aspects related to the operation
phase of the Line 4 project to be implemented by the Concessionaire ViaQuatro (or
Company) within the legal standards that, in Brazil, guide the implementation of
Public-Private Partnerships, being this the first such experience conducted by the
Government of the State of So Paulo.
1.2.
The Bank has been approached regarding potential financing for the So Paulo Metro
Linha 4 (Line 4), pursuant to the award of a 30-year Public-Private-Partnership
(PPP) concession (the Concession). The Concession is to take place under the
responsibility of the Government of the State of So Paulo (GoSP or the Granting
Authority through the Secretaria de Estado dos Transportes Metropolitanos
(SETM) and in coordination with Companhia do Metropolitano de So Paulo
(Metr). The Project represents one of the first PPP projects under new Federal and
State PPP legal framework. Line 4 is the first in a list of PPP projects contemplated
by the State of So Paulo in the short-to-medium term.
1.3.
The PPP is structured such that the public sector performs the civil works before
turning over the operation and maintenance to the private sector under a concession.
The financing from the Bank would be to support the private sector concessionaire to
procure, install, operate and maintain rolling stock and control systems for Line 4. The
concessionaire will then operate and maintain the system for the 30-year life of the
Concession (the Project). The construction of all infrastructure work necessary for
the concession (i.e. track infrastructure, new metro stations and maintenance yard) is
being carried out under the responsibility of the Brazilian public sector (GoSP), under
supervision and according to the requirements of the World Bank.1

The Project under consideration for financial support by the Bank involves the
operation and maintenance of the line and rolling stock. Therefore, the potential
relevant negative environmental and social and health and safety impacts and risks
will be those typically associated with operation and maintenance of railway lines,

PMOC Project Management Oversees Commission (pertaining to technical issues on environmental and social management

such as: (i) increased noise in some areas, like in the maintenance yard, as most of
the metro line is underground; (ii) increased vibration transmitted to the soil and
structures in some areas; (iii) inadequate handling and disposal of wastes generated
at offices, stations an mechanical shops; and (iv) risks of accidents involving users at
stations and/or workers in maintenance activities along the line or at maintenance
yard. Other possible risks and impacts may arise in case of improper management of
environmental and social; and health and safety aspects during operation and
maintenance. However, the impacts and risks associated with the operation and
maintenance of Line 4 are expected to be relatively low, as the line, stations, and
maintenance yard are new and being constructed following requirements of the World
Bank and using modern equipment. The ESDD has been designed to assess the
main impacts; risks and control measures associated with the Project, as well as
compliance with the Equator Principles (see Annex 2).

As a result of the schedule for the construction and expected beginning of operations
of Line 4 in 2010, ViaQuatro is undergoing the initial stages of structuring the
Company, defining the staff and technical procedures, including those related to
environmental, social, and health and safety procedures for its operations. As such,
IDB requirements establishes that during this period, which precedes operations, the
Company should develop and effectively implement appropriate Environmental,
Social and Health and Safety Management Systems to ensure that operation and
maintenance of Line 4 will be carried out within the appropriate standards and in
compliance with IDB's policies and requirements.
1.8.
Taking into account the associated environmental impacts and control measures, as
well as the requirements outlined in IDBs OP 703 Environment and Safeguards
Compliance Policy, the Project has been classified as a Category B operation.
2. Project Description
A)
2.1.
So Paulo Metropolitan Region (RMSP) comprises 39 municipalities totaling a population of approximately 19 million.

and Santo Amaro and with the other transportation modes in the city of So Paulo
(See Annex 1 - Project Location). Daily the subway transports approximately 3
million passengers3.
2.2.
2.3.
The metro of So Paulo currently serves a large portion of the city, but key areas
such as those mentioned above still have no adequate public transportation access.
For that reason, commuters use private vehicles or buses to the detriment of traffic
flow, street conditions and air quality. The operation of Line 4 is expected to
significantly enhance traffic conditions in this east-west corridor by providing faster
access to these important commercial and residential centers and reducing travel
times for both users of the metro and the urban roads.

For Phase 1, ViaQuatro will be responsible for the supply of rolling stock and
operating systems including 14 metro trains with six cars each; train signaling and
control system, based on a centralized supervision and control system located at the
Vila Snia Yard; and a mobile voice and data communications system.
2.6.
Still for Phase 1, Metr is responsible for the construction of all necessary tunneling
and civil works related to the creation of Line 4 including track infrastructure,
maintenance yard and six (6) new metro stations along the Line, and the structure of
three intermediary stations: Fradique Countinho, Oscar Freire and Higienpolis.

2.7.
All maintenance will be performed in the Vila Snia Yard. This Yard will have the
capacity to park 25 trains, with platforms for cleaning, machines for cleaning and the
necessary administration areas. The Vila Snia Yard allows the automatic receiving
and dispatching of trains, without the help of operators. As such, the entire train
parking area was segregated from the remaining of the yard, in order to avoid
accidents with personnel circulating.
2.8.

For operation of Phase 2, Metr will be responsible for the conclusion of the Fradique
Coutinho, Oscar Freire, and Higienpolis stations; completion of the Vila Snia
Maintenance Yard; Urban Bus Terminal; and extension of the tunnel and permanent
track to Vila Snia.
2.10.
For Phase 3, Metr will be responsible for the operation of trains between Vila Snia
station and Taboo da Serra Station to replace the use of buses in Phase 2. The
concession contract does not specify additional trains for Phase 3.

Concessionaire Equipments4
2.11.
Rolling Stock. The trains will be composed of six railcars, without an operator's cabin,
but with command console for manual operation, if necessary, and with continuous
interconnection and emergency doors at the extremes. The trains are specified to
have the following capacity: a load capacity of at least 1900 passengers including 254
seated passengers, 2 in wheel chairs and 1644 standees at a density of 8
passengers per square meter, with an average weight of 70 kg per person. The
system will operate on 75-second headways, and transport 60 thousand people per
hour per direction using the six car trains at an average speed of 35 km/hr, with each
train carrying 1280 people.
2.12.
Signaling System. The signaling system will be supplied by Siemens and will cover
the entire network, including the main lines, the stations and the maintenance and
storage yard. It is a Communications Based Train Control (CBTC) system, including
the continuous, bidirectional and high capacity track-train communication subsystem,
for transmission of signaling, control and diagnostics parameters in real time
throughout the track, stations, yard and parking areas.

of each train, and enables the on-board communications and video monitoring to be
transmitted back to the control center through a fiber optic network.
2.14.
The CBTC system to be installed in So Paulo will provide fully automatic operation
of the trains, which not only will simplify the trains, but increase their capacity as no
operators cab is required.
2.15.
Voice and Data Mobile Communication Subsystem. This subsystem will include track
to train communication to permit the transmission of Closed Circuit Television images
from the Units (both internal and external) to the CCO; voice and data communication
from the CCO to the passengers utilizing the Units, through sound systems (PAS)
and through Information Panels (PIS); and voice communication between the CCO
and the maintenance, operation and security staff of Line 4 in the stations, units,
tracks and yard.
2.16.
Vila Snia Yard Control System. This system will provide: monitoring of train
movement in the Yard, monitoring of the power and auxiliary systems in the Yard, and
failure control and diagnostic to support maintenance.

Concessionaire Operation
2.18.
Line 4 operation will be performed by ViaQuatro, and will be done daily from 4:40
a.m. to midnight in integration with the other subway lines and other urban collective
transportation systems. Programming of the train services will be designed in order
to provide regular and continuous services according to the variation in demand
throughout the day.
2.19.
Concessionria ViaQuatro will provide complementary services for users such as: (i)
allocation of employees to information and servicing; (ii) sound and visual signage
information; (iii) lost and found service.

In compliance with the provisions set forth in CONAMA Resolution 01/86, Metr
presented to SMA in 1994 an Environmental Impact Study and the corresponding
Environmental Impact Statement (EIA/RIMA) for the environmental licensing of Line 4
(or Yellow), for the Paulista - Vila Snia section. The EIA/RIMA were analyzed
through process SMA 7.245/94, and the project received the Preliminary
Environmental License - LP 0098 on 03/25/97 supported by the Technical Opinion
CPRN/DAIA/026/97. That license was issued for a two-year period, and renewed for
an equal period of time on 02/16/2000.
3.5.
In compliance with the provisions set forth in CONAMA Resolution 01/86, as well as
SMA Resolution 42/94 and CONAMA Resolution 237/97 a Preliminary Environmental
Report (RAP) was presented to SMA, corresponding to the continuation of the Line
4 Project, involving the Paulista - Luz section. The RAP was reviewed through the
SMA 13.24783/98 process, having the Municipal Department of the Environment
(SVMA) been consulted through initiative of SMA. The Preliminary License was
granted on 06/09/99 - LP00220 - supported by the Technical Opinion CPRN/DAIA /
026/97. That license was issued for a two-year period, and renewed for an equal
period of time on 04/25/2001.
3.6.
In
proceeding
with
the
environmental
licensing
process,
the
Installation License - LI 00219 - was granted by SMA on 12/19/2001, supported by
the Technical Opinion CPRN/DAIA/401/2001, for both sections covered by the two
LPs, in other words, between Luz and Vila Snia, unifying the environmental licensing
for Line 4.

In 2007 this License was renewed by Metro for a period o fone year, supported by the Technical CPRN/DAIA/006/2007.

b)
Waiver of the environmental licensing for the implementation of the work site,
establishing environmental conditions for their operations6. Such installations
are, despite a waiver of the license, being systematically inspected by CETESB,
and no situations which could harm the operation of the line are being identified.
3.9.
CETESB has also performed, together with the Construction Consortium and Metr
on addressing, on a case by case basis, areas contaminated by fuel stations located
in the project's area of influence - areas excavated for the construction of Line 4. In
these cases, the remediation actions and solving of the environmental liability are the
responsibility of the businesses (Gas Stations) and the necessary measures are
being taken for the excavations in theses areas and the appropriate treatment and
destination for the areas.

Noise, subsidence and vibrations: continuation of the monitoring program for the
physical environment in order to supervise the air, noise, vibration and
subsidence conditions during the implementation and operations phase of the
line. Special attention will be given to Vila Snia Yard, in terms of noise and
vibration control, and measures to reduce the level of noise and vibrations are
forecast;

Solid Waste: In addition to the solid waste generated during cleaning of the
trains, stations, etc., the Vila Snia Yard is expected to generate a greater
amount of contaminated waste as a result of the mechanical and electrical
maintenance of the rolling stock. A Solid Waste Management Plan shall be
prepared and applied to all units under the operator's responsibility. This Plan
shall apply to the collection and handling of waste generated in this station,
including yards, sanitary facilities, ticket counters, platforms, etc., as well as

waste generated in the mechanical shops, during track maintenance, and in the
Maintenance Yard;

Risks of accidents and contingency and/or emergency plan to reduce risk and
consequences of accidents in the stations, mechanical shops and offices: An
Emergency Action Plan (Plano de Ao de Emergncia - PAE) and Risk
Management Plan (Plano de Gerenciamento de Riscos - PGR) will be prepared
to address any emergency situation that may represent risk of environmental
contamination. Due to the nature of this project, the plans will focus mainly on
procedures in case of spills of product used in the maintenance of trains (oil, for
example) and accidents during the operation of Line 4.
Physical Environment
4.1.
The So Paulo region is located in the transition zone between the warm climates of
the low latitudes and the mesothermal climate of the middle latitudes. In terms of
rainfall, it is characterized by a rainy summer and a dry winter. During the winter
season, there are thermal inversion episodes which increase the concentration of
atmospheric contaminants, adversely affecting the air quality which is most notably a
result of vehicle emissions.
4.2.
In geological and geomorphological terms, Line 4 of the So Paulo subway, with its
total extension of 12.8 km, in a section which corresponds to more than half of the
total length, passes the So Paulo Tertiary Sediment Basin, with the occurrence of
soft clays, silty clays, sandy clays, and also crossing areas of granite-gneissic rocks.
It is characterized by hills and flat tables in altitudes between 700 and 800 m. above
sea level, with slopes between 20 and 30%. Reddish yellow topsoil is predominant in
the superficial layer of weathering or colluvial origin.

4.3.
The section serviced by the Line 4 of the So Paulo subway is not characterized as a
region subject to dynamic surface processes with intensity sufficient to cause damage
to the drainage system. Despite the occurrence of sections with thick and porous soil
with steep slope, the region offers an efficient and consolidated urban infrastructure.
4.4.
Throughout the extension of Line 4, there's only one location with the occurrence of
flooding: in the vicinities of Vital Brasil station, however, without risk of affecting the
Station since it is located in the highest point in the area. It was near this section
(work on the Pinheiros River Station well construction site) that an accident of large
proportions occurred on January 12, 2007, causing the death of seven people and
affecting households and commercial establishments. The causes of the accident are
still under investigation. 7
4.5.
The main water stream in the project's direct area of influence is the Pinheiros River.
Crossing of the river will be done through a tunnel and no direct interference is
expected as a result of the work. Line 4 will also cross, through tunnels, other smaller
streams generically called creeks. These creeks, which have been channeled for
some decades through closed galleries, in general have the water quality
compromised by discharges of domestic sewage. Nevertheless, due to the depth
where the tunnels will be located, no direct interference is expected in this natural
drainage network, with the exception of the channel on Avenida Imigrante Japons,
Jardim Leila, near the Vila Snia Yard. Specific risk assessments were carried out
concerning possible risks to the project:

4.7.
Similarly, acoustic comfort conditions in the direct area of influence are severely
degraded as a result of intense road traffic and densely populated urban areas. This
problem tends to worsen year after year as a result in the growth of the city's
vehicular fleet, which reached the 6 million mark on February 20, 2008.
B)
Biotic Environment
4.8.
Relative to the flora, as the areas to be crossed by the new line are fairly urbanized,
no conservation units or other relevant ecological areas are present in the area of
influence of the project. The implementation of the line will only pose some pressure
over green areas in the Districts of Pacaembu, and Jardins Europa, Amrica and
Paulistano, reinforcing the trend of using services in these areas. In the remaining
green areas, the influence of Line 4 will be insignificant, since areas with greater
significance were preserved by the choice of route and construction methods.
4.9.
4.10.
The Register contains 23 locations that contain the necessary work site for the
construction of the stations, ventilation wells, emergency exits and support areas
(worksites and discharge areas). The vegetation found in these locations is limited to
urban vegetation in streets and squares and some trees in properties (normally
vacant lots).
4.11.
In regards to the fauna, as a result of the intense urbanization process in the project's
direct area of influence, no species of interest were reported, only animals fully
adapted to urban life were found.
C)
Anthropic Environment
4.12.
4.13.
In regards to the income of the population affected by the project, the Pacaembu
region stands out with 14 minimum wages, while Itapecerica da Serra has less than
one minimum-wage.
4.14.
The mass transportation system which services the RMSP is comprised by the
Companhia do Metropolitano de So Paulo (Metr), by the Companhia Paulista de

The subway is integrated with CPTM at the Brs, Barra Funda, Tatuap, CorinthiansItaquera and Santo Amaro stations. CPTM has six lines in operation in a total of
262.8 km, 97 stations and transporting 1.2 million passengers per day.
4.16.
EMTU/SP was created on December 13th, 1977, with the creation of the Sistema
Metropolitano de Transportes Urbanos (Metropolitan System Urban Transportation).
Currently it is responsible for managing the following systems: So Mateus /
Jabaquara Metropolitan Corridor (33-km trolley bus line and capacity for 210,000
passengers/day). Regular Metropolitan System (50 operating companies and 1.2
million passengers/day capacity), Airport System (interconnects the So Paulo
International Airport, in Guarulhos, to the city through six special lines and two
common), Metropolitan System (595 operating companies and 511,000
passengers/day capacity).
4.17.
All bus lines in the city of So Paulo are operated by private companies under
supervision from So Paulo Transporte S.A. (SPTrans), de municipal company for
planning and management of collective transportation.
SPTrans, issues service
orders for the operation of each line, including the definition of routes, schedules and
necessary fleet, in addition to operating 17 transfer terminals. Currently, 54
companies operate a fleet of approximately 10 thousand buses, 800 lines and
offering services to nearly 4 million passengers per day.
4.18.
In terms of other relevant projects, located in the area of the Project, the following
should be noted:

The parking areas near the Morumbi stadium, which will be necessary to meet
demands of the Football International Federation Association - FIFA, in order for
the city of So Paulo to be one of the host cities for the
2014 Football World-Cup. Despite this area still not have a definite location; it
may come to be an important support point for residents of this region to increase
the use of the subway;

In regards to generation of traffic, the major generating hubs identified in the area
of the study, which cause interference in their vicinities, are: Makro Supermarket,
Butant Shopping Mall and Ccero Pompeu de Toledo Stadium (Morumbi).

4.19.
Concerning the Historic, Archeological and Cultural Heritage, Metr obtained from
governmental agencies associated with preservation of historic heritage at federal
level (IPHAN), at state level (CONDEPHAAT), and at municipal level (CONPRESP),
the approval of the project. Only the documents issued by CONPRESP specify
certain guidelines for the Executive Project, such as for example, issues referring to
protection of historic buildings, interference with vegetation and position of the
ventilation tower intakes.
The Concessionria ViaQuatro will be responsible for the purchase of equipment and
trains and for the operation and maintenance of Line 4, by means of the Concession
Agreement between Metr and the Concessionaire. The present Project does not
involve civil works, but an assessment has been made of potential liabilities from the
construction phase that could possibly migrate into the operation phase.
5.2.
It should be pointed out that the operation of this new subway line will bring significant
social and environmental benefits to the RMSP, especially concerning the
improvement of urban conditions, with the increase in the public transportation safety,
reduction of air pollution and noise emission levels through the reduction of bus fleets
in the Western and Southwestern Regions. Integrated to these benefits, the
optimization and integration of the public transportation system in the city of So
Paulo, mitigating traffic problems in the main road network and reducing commuting
time for users; and integrating more distant areas such as Campo Limpo and
Educandrio and the cities of Taboo da Serra, Embu, Itapecerica da Serra and
Cotia to the job-creating centers like the Historic Downtown and Expanded Center
(Paulista and Faria Lima Avenues).
5.3.
It is estimated that the implementation and operation of Line 4, integrated to the other
subway lines and RMSP trains will promote an increment of 970 thousand users per
day. According to information contained in the Preliminary Environmental Report
(RAP), in 1998 the urban bus system in So Paulo was responsible for 77% of the
daily trips of the RMSP mass transportation system, 17% were attributed to the
subway and 6% to metropolitan trains.
5.4.
Another important benefit that will be brought by the expansion of the railway system
will be the potential reduction of poverty in the RMSP, by the improvement of the
transportation access for low-income population. A major part of the low-income
population lives in the suburbs of the state capital where the deficiency of the urban
structure and public transportation system is significant. The low access promotes
social exclusion of this population from the job-creation centers, to the health and
education structure, in addition to the recreation and culture centers. It is estimated
that, in its first phase, 24% of the users of Line 4 will be commuters who live below
the poverty line (per capita wages of two dollars a day)8.

5.5.
We point out that Concessionria ViaQuatro must be in compliance with the Quality,
Environmental, Health and Safety Policies from Companhia de Metropolitano de
So Paulo (Metr). In 1999, Metr began to adapt its operations to the International
Rules for quality management, specifically to the ISO 9000 standards. In 2000 the
first certification was obtained, the one for Rolling Stock Maintenance Process for
lines 1, 2 and 3. In the subsequent years the Maintenance of Quality Management
System scope was increased and established the Quality Management System for
the Operation, Purchase and Hiring Management, Administrative Services and Civil
Works Management for Line 2 and Assembling.

The Project under consideration for financial support by the Bank involves the
operation and maintenance of the line and rolling stock. Nevertheless, indirectly
related to the Project, there may be some potential environmental and social liabilities
and/or reputational risks in association with possible improper mitigation of
construction-related impacts by the public sector, which is under supervision by the
World Bank. Therefore, this report will also discuss some of the relevant
environmental and social impacts associated with the construction phase.
A.1)
Construction Phase
5.8.
A.1.1) Environmental
5.9.
Generation of Wastewater. The main wastewater flux that are generated during the
construction period basically result from pumping operations for lowering the water
table in some of the construction areas and, possibly from refluxes of injection and
construction water. The Construction Consortium has a Wastewater Management
Program that will be complemented with daily measurements of pH and suspended
solids.
5.10.
Solid Waste Production. Main solid wastes that are generated during the construction
phase from common origin (cafeteria, bathrooms and offices); from ambulatories;
inert waste (from land cleaning procedures and removal of dump material) and

industrial (equipment packages: paper, plastic and metal; lubricants, grease, and
scrap from vehicles, machinery and equipment maintenance). It should be pointed
out that the Construction Consortium / has a Waste Management Plan (PGR), whose
main goal is to establish the criteria for appropriate management of industrial and
commercial wastes generated in the construction activities.
5.11.
The disposal of excess material (inert waste), removed from work fronts is being
made in places approved by SMA. Additional measures will be taken, in addition to
the technical issues, such as the implementation of landscaping so as to assure the
recomposition and future use of such areas.
5.12.
Changes in noise and vibration levels. During construction, the main actions that
generate increased noise levels are: demolition of buildings, installation and operation
of construction sites and dormitories, relocation of road system and public utilities
network, construction of stations, wells and tunnels, and transportation and disposal
of material. The construction Consortium has been monitoring, by means of a
sampling program, the noise level from the construction sites, with emphasis to the
night shift.
5.13.
Soil and water contamination. In the Environmental Action Plan presented by the
Construction Consortium in the beginning of the construction phase, two areas were
identified contaminated by fuel close to the construction site, which required specific
monitoring. As such, no specific monitoring is foreseen for the operation phase.
However, any problem verified during the construction will be reported in the Request
for Operating License and can motivate monitoring demands from environmental
authorities, such as CETESB.

5.17.
Interference with the vicinities. In the work sites and in the various fronts of work
execution, construction companies and suppliers observe a set of rules in order to
make the services that are going to be developed compliant with the basic aspects of
safety and of interference with the vicinities, such as: control of particulate matter and
gas and noise emission; security teams trained in the work sites and capable of
guiding workers, visitors and the vicinity itself regarding possible risks; internal
commissions for accident prevention; certifications and training programs for drivers
and equipment operators.
Changes in noise and vibration levels. As the new line will be underground, the
potential impacts related to noise during the operation of Line 4 will be concentrated
mainly in the vicinities of the Maintenance Yard at Vila Snia due to the continuous
movement of trains9. Other acoustic impacts may be related to the ventilation
systems, which are located in the internal area of the stations. The traffic of the
subway trains may also generate vibrations.
5.19.
However, measures were taken in the design of the new line to minimize and even
avoid the generation of noises and vibrations. With the purpose of reducing noise and
vibrations caused by trains, the system will present a superstructure system of
permanent way using mass-spring, for special sections of the main route, in the areas
surrounding hospitals, auditoriums, hotels and houses, in which harmful vibrations,
generated by the Metr operation, will be mitigated. For noise deriving from the
ventilation system, noise absorbers will be installed at the entrance and exit ends of
air ducts. Acoustic barriers will be implemented at Vila Snia Yard.
5.20.
In addition to these measures, during the Preliminary and Installation License process
a monitoring program was proposed for the physical environment to observe the

evolution of conditions of air, noise, vibration and subsidence during the construction
of the line as well as during the operation phase.
5.21.
Generation of solid waste. Solid wastes will be generated during the operation phase
by the need of cleaning the stations, lines and trains, in addition to sludge from
station toilettes and Vila Snia Maintenance Yard. A greater amount of contaminated
waste is expected to be generated at Vila Snia Maintenance Yard due to mechanical
and electric maintenance of rolling stock. Areas for fuel storage, hazardous chemical
substances, lubricants, oils and greases that are generated by maintenance and
similar tasks will be stored over impervious areas, in contention dams, sized in
compliance with the applicable ABNT technical regulations. It will keep waste for
adequate disposal. In additional, a Waste Management Program will be implemented
in compliance with the Environmental Management System (see item E). The Plan
will establish the procedures to properly manage the wastes generated during
operation of the new line.
5.22.
Liquid effluent generation. During the operation of the new line, domestic sewage is
expected to be generated at the stations and Vila Snia Maintenance Yard; and
industrial effluents will result from washing of parts, equipment and trains, also at the
Maintenance Yard. Domestic effluents from stations will be treated using septic tanks
and then pumped to Sabesp sewage treatment stations. The Vila Snia Yard project
contemplates a liquid effluent treatment system (for domestic and industrial effluents)
by using flocculants and biodigestors. In order to minimize effluent generation, the
project also contemplates a system for reusing the washwater.
5.23.
5.24.
Soil stability. Changes in soil stability and structure of buildings during the operation
phase can occur in a restricted way by underground settlings as a late reflex of the
construction phase activities. The Concessionaire foresees a monitoring subsidence
program, including the list of properties that were affected by the subsidence caused
by the construction and identifies non-conformities.
Accidents with workers. Health and safety aspects related to operation activities of
Line 4 contemplate: (i) worker accidents - workers are exposed to moving trains or
machinery; (ii) noise and vibration workers may be exposed to noise and vibration
from locomotives, rolling stock, and machinery; (iii) fatigue - workers may be affected
by the length and time of the shift (e.g. night shifts, shift start times); (iv) electrical
hazards - workers may be exposed to electrical hazards from electrified railway; (iv)
electric and magnetic fields - workers on electric railway systems may have a higher
exposure to electric and magnetic fields. Additional health and safety issues include
the following: (i) aspects of ergonomics at work, inherent to the activities of Metr

operations; (ii) handling of hazardous materials at Vila Snia Yard; (iii) health and
safety aspects resulting from the operation of urban buses for Phase II.
5.26.
Risk of accidents with users. The subway operation must guarantee the physical
integrity of employees and users, through the availability and reliability of its system
and fixed and mobile equipment, as well as by the performance of its staff in the
operation of the subway system. As such, the following were risks were assessed:
risks related to boarding and exit conditions, availability of safety equipment for
emergencies (hydrants, extinguishers, etc.) operation of escalators, illumination
system at stations, cleaning of stations and trains, number/presence of employees on
platforms to prevent accidents in the crowd, company responsibility in case of
accidents with users, risk of accidents in stairways, platforms, doors and risk of
accidents with the trains (derailment, fire), and risks related to ventilation of stations
and trains.
5.27.
Measures such as: lighting system, correct sizing of employees and of machinery for
service and safety should reduce the risks of accidents and increase user safety. As
for the risk of falls on subway tracks, the current system for Line 4 anticipates the
installation of a panel to isolate the platform, with a line and safety doors, similar to
the system adopted by Line 14 of the Paris Subway, which prevents such type of
accident given that such security doors only open when the subway car arrives at the
platform.
5.28.
Risk of public safety for users. The subway operation must also assure public safety,
aiming at the prevention and repression of theft and events that could disturb the
order in the subway system. As such, risks related to the presence of group of
football supporters and/or gangs are evaluated; number of security personnel to
guard and act in case of theft, assault, emergencies, etc.; risk of robberies and
presence of criminals; risk of sexual harassment on trains and platforms; and risk of
robbery on overcrowded trains and platforms.
Working conditions and worker rights. All ViaQuatro workers will be registered and
legally employed, have their rights respected as established by the Brazilian
Consolidated Labor Laws, and are entitled to health and other benefits provided by
the Company. The Concessionaire shall be responsible for transportation,
accommodation, catering, medical care and welfare facilities for the personnel. The
Concessionaire shall pay rates of wages and observe conditions of labor, which are
not lower than those established in the locality in which the Project is located.

5.32.
Increase in public transportation safety. The reduction of traffic expected with the
additional offer of transportation provided by Line 4 could contribute to the reduction
in the number of accidents, especially consequences of accidents involving buses,
which transport more passengers and are usually associated with a higher number of
casualties when accidents occur.
5.33.
Change in the road system and accessibility. During the operation phase, regarding
the local and regional road systems, the changes have a positive aspect, mainly from
reducing the number of buses and an integrated reorganization foreseen for mass
transportation (bus lines). The negative impact from this change will occur in the
vicinities of subway stations due to the higher flow of traffic and pedestrians. One of
the most relevant positive impacts related to Line 4 will be an increase in the
accessibility to the general population to other ways of transportation, due to the
integration with the train system and other subway lines.
5.34.
Changes in offer and demand of public services. Operations of stations, yard with
maintenance centers and bus terminals will increase the demand for public services
such as water, electric power, telephone, sewage, etc. that should be previously
addressed with the concessionaries for these services. Pressures on these
concessionaries are not expected because the regions where Line 4 will be
implemented have a consolidated urbanization and fully service local demands.

Reduction in noise and vibration levels. Similarly, a reduction in the levels of noise
and vibration is expected to occur along the areas served by Line 4 due to the
substitution of buses and private vehicles by subway trains that run underground (the
exception will be in the vicinity of Vila Snia Yard).
5.39.
Reduction in the number of traffic accidents. The new subway line will also contribute
to lower the number of traffic accidents by reducing the number of cars and buses on
public roadways.
5.40.
5.41.
The Southwestern Vector is one of the most crowded regions of the city and RMSP,
due to the growth of poor suburban areas, industrial activities moving to the interior
and the increasing expansion of services at more traditional districts such as Paulista
and Brigadeiro Faria Lima Avenues, marginal roads of the Pinheiros River to Santo
Amaro Region. These changes created deep alterations on land use, and increasing
vehicular traffic and causing traffic jams regardless of the day or period of the day.
5.42.

The analysis made regarding environmental and social impacts related to Line 4 of
the So Paulo Subway, allowed the identification of three other impacts indirectly
related to the project, which are extremely relevant: the contribution of this project to
reduce urban poverty, urban betterment for the regions where the project is located,
and the possibility of obtaining carbon credit by the introduction of cleaner
technologies for the operation of the new Line with the substitution of the traditional
technologies adopted, and also the reduction of greenhouse gases, by changing the
use of private or group vehicles fueled with petroleum products, for a transportation
that uses electricity from Hydroelectric power plants10.

The low-income population living in the RMSP has low mobility and restricted use of
public transportation.
Investments, such as Line 4, will provide operational
improvements in public transportation and fare integration with the existing
transportation network will improve the accessibility of poor people to metropolitan job
centers and reduce the transportation costs with benefits to the family income.
Estimates from Metr indicate that when Line 4 starts to operate, 22% of passengers
transported will be from low-income population, against 13% on other subway lines
and 19% in the general transportation system.
5.46.
Most job openings in the third sector of the RMSP are located in Line 4 area of
influence, totaling 1.3 million jobs. These are jobs available in offices, commerce,
stores, personal and domestic services. Line 4 will provide the low-income population
with access to these areas where job opportunities are concentrated. In Line 4 region
the most important health, educational and leisure centers on RMSP are also located.
5.47.
With regards to the improvement of the vicinities of the subway, the Municipal
Strategic Master Plan (Plano Diretor Estratgico Municipal)12 () foresees the
implementation of the Butant-Vila Snia Urban Project (Operao Urbana ButantVila Snia) (), which comprehends an area of about 633 hectares, between Francisco
Morato and Eliseu de Almeida Avenues. Urban Projects are a group of interventions
and measures coordinated by the Municipality, with the participation of homeowners,
residents, users and private investors, aiming at achieving in one urban area,
structural urban changes and social and environmental improvements.
5.48.
Among the investments foreseen on Urban Project Butant - Vila Snia13 are those
for improvement of traffic conditions in the region, redesigning Ministro Laudo
Ferreira Camargo Avenue, linking Raposo Tavares road to Vila Sonia Station,
through a tunnel under Parque Previdncia, linking Joo Jorge Saad Avenue,
improving traffic in this region. The construction of the South Bus Terminal (Estao
Rodoviria Sul), next to Vila Snia Station is foreseen, avoiding that buses coming
from Vale do Ribeira and Southern Brazil have to cross the city to leave passengers
at Barra Funda Terminal, as it is done nowadays.
> Metropolitan Area. The change in transportation are related to operational and price betterment from the train system and are
also related to the future operation of Line 4 (2010) and the construction and extension of Line 5.

The accrual of carbon credits due to the reduction of greenhouse gas emissions by
changing petroleum-fueled vehicles to another transportation based on electricity
generated almost entirely by hydroelectric power plants may provide the Metr and
the Concessionaire another source of revenue, with positive reflexes to implement
the enlargement of this transportation service.
5.50.
5.51.
Preliminary studies conducted by Metr and related to Line 4 indicated two possible
scenarios for certification of credits due to reduction of carbon emissions associated
with the operation of the new line. The first scenario considers the reductions
associated with the new technological improvements in Line 4 and results in an
estimated carbon dioxide emission reduction around 24 thousand tons per year. The
second scenario considers the reductions associated with the reduction in road traffic
along the region served by Line 4; In this case the results pointed out to an estimated
carbon dioxide emission reduction of approximately 128 thousand tons per year.

A.2)
Operation Phase
6.5.
Monitoring noise and vibrations. During the Line 4 operation, a monitoring program of
the physical environment will be performed so as to follow up on the evolution of
noise and vibration levels. Measurement campaigns with the participation of CETESB
are contemplated for noise levels. Such measurements will be compared to a
baseline to be made immediately before the operation, establishing, from this
baseline, which will be set immediately before the operation; the implementation of
mitigation actions will be established by such comparison. As for vibration, the
sections that are more susceptible will be monitored according to local geology and/or
the line depth. Such monitoring will have to be performed through the identification of
the areas that are susceptible to higher vibration and, after subsequent identification
of such areas, this monitoring must be done first by identification of susceptible areas
and, after the identification of such areas, the constructions they hold will have to be
inspected and the cracks and fissures found in them will have to be identified and
documented. Such documentation will serve as baseline for the evaluation of the
damage attributed to line operation.
6.6.
Monitoring soil and surface and groundwater contamination. At Vila Snia Yard at
least two piezometers will be installed with filter section for periodical monitoring of
groundwater quality. Training programs will simultaneously be applied for the
environmental control of maintenance activities to the employees that develop these
tasks.
B)
6.7.
Monitoring of health and safety aspects. ViaQuatro will conduct health and safety
inspections of Line 4 facilities and operations as well as of contractors. ViaQuatro
must keep records of all work accidents and occupational illness.
C)
Contingency Plan
6.8.
Concessionria ViaQuatro shall present an Emergency Action Plan (PAE) and a Risk
Management Plan (PGR) to address emergency situations which represent a risk of
environmental contamination. Additionally, it will present an Emergency Fire Plan,
which should be duly approved by the Fire Department. As part of these plans,
ViaQuatro shall prepare fire brigades duly trained at each location. For events of
accidents with the rolling stock involving passengers, ViaQuatro shall rely on and
Emergency Response Plan set forth according to the guidelines provided to
Companhia do Metr de So Paulo and in line with the company plans.
6.9.
The Contingency Plan shall include: (i) identification and specification of accident
hypothesis; (ii) classification of the scenario risk, identifying for the most critical
situations the scope of the area of the event and the receptors to the expected
impacts ;(iii) detailing of the emergency action procedures with the definition of
responsible personnel; (iv) list of third parties involved, including all possible agents
involved with emergencies (Fire Department, civil defense, police, ambulance
services, etc.); (v) specification of the need for training; (vi) system to register and
document emergency occurrences; and (vii) investigation of accidents.

driven by the following principles: to ensure compliance with IDBs environmental and
social requirements and in-country regulations, to provide well-being and satisfaction

environmental risks, reducing them to lowest level possible through the use of
effective and efficient programs, technologies and procedures; to contribute, through
the incentives and technical support and/or formal requests for selection/hiring, for
the gradual improvement in the environmental performance of contractors and
suppliers and for the development of their activities on a sustainable basis and in
compliance with the applicable legislation; to raise awareness of the direct and
indirect environmental risks/impacts of the Line 4 activities, and to communicate with
total transparency, among employees and the community in general, of the
environmental and social impact.

The Environmental and Social Management System shall encompass the following
programs: Noise Monitoring Program, Water Quality Monitoring Program, Solid Waste
and Liquid Effluent Management Program; Emissions and Atmospheric
Contamination Monitoring and Control Program; Damage to Third-Party Property
Monitoring Program. The environmental monitoring programs will be managed
through the team responsible for the coordination and operation of the System.

programs. The Concessionaire will develop procedures to address its health and
safety issues at corporate level in line with IDBs requirements, in-country regulations

for free dental care; (v) subprogram to fight sexual exploitation of minors, created by
the World Childhood Foundation WCF and Ethos institutes.
7. Public Consultation
7.1.
The Line 4 Project for the So Paulo subway, in its implementation phase, was
submitted to the regular environmental licensing process for projects considered to
affect the environment through the presentation and approval of an Environmental
Impact Study and Environmental Impact Statement (EIA/RIMA), in the initial phase
(section Vila Sonia - Paulista) and subsequently of a Preliminary Environmental
Report (Relatrio Ambiental Preliminar - RAP - section Paulista - Luz)
7.2.
As per legal determination, both licensing processes , were conducted with ample
communication and availability of information to the community directly and indirectly
affected by the work, highlighting the following aspects and events:

The previously listed actions taken, both during the construction phase of Line 4, as
well as for the operation phase of the new line, were developed in compliance with
IDBs OP-102 Disclosure of Information Policy.
8. Conclusion
8.1.
The Line 4 Project for the So Paulo Metr is in compliance with IDB Operating
Policies, both in the current construction phase - which relies on consistent follow-up
and financing from the World Bank and consequently also addresses the policies of
that institution - as well as the future operation phase to be implemented by
ViaQuatro. Throughout the structuring process, ViaQuatro shall implement the
actions recommended by IDB (see item 9 below) which shall ensure full compliance
of the operations of the new line with IDBs environmental and social requirements.
8.2.
The Line 4 Project fully complies with the legal applicable procedures in the state of
So Paulo which guide the environmental licensing process for projects which are
considered to be modifiers of the environment. The necessary environmental
licenses were obtained within the legal schedules and procedures, and no situations
considered of noncompliance work registered.
8.3.
Relative to the operation phase of Line 4, there will be a need to obtain a specific
environmental Operating License, which may be requested, according to the
completion phase of the work, per sections of the project (for example: for Vila Snia
Yard, or specific sections of the line). The responsibility for obtaining the Operating
License(s) is not defined in the Concession Agreement and is being the object of
negotiations between the Metr, the Concession Commission and ViaQuatro. As
such, the institutions involved shall define specific procedures to assign the
completed infrastructure for the operation by the Concessionaire. As per IDB
recommendations, these procedures shall include environmental, social and other
relevant aspects (see item 9 below).

8.4.

In regards to the environmental impacts generated during the operation of the new
line, these shall be mostly positive and considered of great significance (see Chapter
5 of this report) highlighting the contribution to the reduction of vehicle emissions
resulting from the removal of cars and buses from the region; the offer of mass public
transportation with quality and within operating standards considered to be
satisfactory; The contribution for the implementation of urban public policies with the
desirable population density for the area serviced by the line, addressing the
guidelines set forth in the city's Master Plan; The contribution of the project for the
reduction of poverty (as per technical estimate of Metr and the World Bank) among
other relevant factors.
8.6.
The potential negative impacts are considered typical ones associated with this kind
of project and whose mitigating measures and monitoring are already currently being
applied by Metr in the other operating lines in the city of So Paulo, such as for
example, monitoring of noise level and vibration. The existence of residential areas
in the vicinities of Vila Sonia Yard14 (where maneuvering and maintenance of trains
will occur) will demand specific measures to control, mitigate and monitor noise levels
in order to assure adequate environmental conditions to the population residing in the
vicinity (see item 9 below).

of ViaQuatro, which is undergoing the assembly of the team and beginning of

9.2.
Preparation of this plan will be done based on the proposal forwarded by ViaQuatro
to develop and Environmental, Health and Safety System as provided in the RAA,
and presented and commented on item 7 of this PESR. This system should be
consolidated before the beginning of commercial operations of Line 4.
9.3.
The guidelines for this action plan will be focused on, among other things, on the
following aspects: structuring the Company to manage the environmental, social,
health and safety aspects in terms of human resources and finance consolidation of
the environmental programs - and control and monitoring of impact caused by the
operation of the new Line - of the health and safety programs for employees and
users, and the Contingency Plan.
9.4.
As such, IDB guidelines seeks to promote, during the period that precedes the
operational phase of the project, the development and effective implementation of an
Environmental, Social, Health and Safety Management System (whose principles and
guidelines have already been defined by the Concessionaire) assuring that Line 4 will
operate within appropriate standards and in compliance with the Bank's Operating
Policies.

measures be implemented to ensure reduction of noise levels in residential districts
located next to the maintenance installations and train lines is to be included in the
Action Plan, defining the measures to be implemented, timetables, investments and

operation of buses that will interconnect the future Vila Snia station to the District of

According to IDBs Safeguard Policies, the Project has been classified as Category B. According to the Equator
Principles, for Category B projects, the project sponsor have to prepare an environmental report, including an
evaluation of the possible environmental and social impacts of a project, measures designed to manage, mitigate and
monitor those impacts and details of public consultations.
As per IDBs request, the Concessionaire prepared an Environmental Assessment Report (RAA) of the Project with
focus on impacts and control measures and made it available for public consultation.
As mentioned, ViaQuatro prepared the RAA (Environmental Assessment Report) for the Project and the proposal of an
integrated Environmental, Social, Health and Safety Management System for the Concessionaire and operation and
maintenance of the Line, which will include the following elements: (i) environmental and social assessment; health
and safety and labor assessment; (ii) management procedures and plans; (iii) organizational capacity; (iv) training; (v)
community engagement; (vi) monitoring; and (vii) reporting.
The operation and maintenance activities shall comply with the health and safety environmental guidelines for
infrastructure services (Environmental, Health and Safety Guidelines EHS for railways). The Concessionaire
activities shall be in compliance with IFC performance environmental standards related to atmospheric emissions; fuel
management; wastewater; waste from passenger trains, terminals, and from field operations; and noise and vibrations.
Additional health and safety issues specific to railway operations include the following: Train / worker accidents, noise
and vibration, fatigue, electrical hazards, and electric and magnetic fields.
The Concessionaire shall, as per IDBs indication, prepare an Environmental, Health and Safety Action Plan (EHSAP)
related to the Concession. The guidelines for this Action Plan focus, among others, on the following aspects: Company
structuring for the management of environmental, social, health and safety aspects in terms of human and financial
resources; consolidation of environmental and social, as well as health and safety procedures, programs and plans to
control and monitoring impacts and risks associated with the Project, Contingency Plan.
ViaQuatro has conducted consultation with project-affected communities in a structured and culturally appropriate
manner. The evidences are presented in Chapter 7 of this PESR. In addition to the measures being voluntarily
implemented by the Concessionaire, the Concession Agreement for Line 4 foresees mechanisms, such as periodic
assessments by the Granting Authority based on Quality of Service Indicator (IQS Indicador de Qualidade dos
Servios), which will assess the level of satisfaction of users of the new line by means of direct surveys.
The Concessionaire shall establish mechanisms for consultation and social communication with the community to be
directly or indirectly affected by its operations as per IDBs recommendations. These mechanisms will be incorporated
into the integrated management system, through a Social Communication program. In addition to these aspects, the
Concession Agreement foresees performance assessment mechanisms of the Concessionaire by users of the new
line.
The RAA and other environmental and social documentation and plans have been, or will be revised by an IDB
independent consultant, in compliance with the standards for analyzing a request for possible financing. The
Concession Agreement has mechanisms for the performance assessment of the Concessionaire by the Granting
Authority. IDBs financing foresees independent supervision during the operation of the new Line.
As part of the appraisal and negotiation process, the Loan Agreement to be established between the Borrower and IDB
will include environmental and social requirements and covenants.
ViaQuatro activities shall be supervised and assessed by an independent environmental and social consultant as per
usual IDB procedure.
The Concessionaire shall periodically submit to IDB a report on the compliance of the Company and their operations
with the IDBs Policies and Environmental and Social Requirements, established in the Loan Agreement.
