AFFIDAVIT OF DESISTANCE
We, Joel Torita and Michael M. Angelo, MCH operator and driver
respectively, both of legal age , both married and both resident of Valencia
Ormoc City, after having been duly sworn to an oath in accordance with the
law hereby jointly depose and state the following facts to writ;
That I am the rightful owner of one (1) unit MCH Honda Motorcycle
bearing plate # HV-6992 and with body # 1676 driven by Michael M. Angelo,
holder of professional drivers license #H03-05-394951 flying the route of
Ormoc City;
That sometime on 11 December 2011 at more or less 5:00 A.M, my
MCH Honda Motorcycle meet vehicular accident in front of San Lorenzo
College Brgy. San Pablo Ormoc City involving a Drop side Suzuki Multicab
bearing plate # JD V-980 blue color owned and driven by John L. Demera,
holder of professional drivers license #D06-96-048339, Canadian National
and temporarily residing at Brgy. Milagro, Ormoc City. That on that accident
the left back portion of my side car was damaged while the right front side of
the multicab was also damaged;
That after a soulful/deeper talk with the owner/driver of the Multicab
we have came into terms to resolve to withdraw; cease and desists from
filing a case against one John L. Demera in any court of justice in the
Philippines for he paid all the expenses for the repair of my sidecar;
That this affidavit was voluntarily given by us without any force and or
intimidation applied upon our persons but the same was voluntarily and
freely given;
IN THRUTH HEREOF I have here unto affix my signature this _____ day
