DETAILS:
On 06{7-2001 at approximately '1030 hours, Deteciive F.R. Scarbo, Detective E. Edington and
Detective Sergeant D. Cummings contaded cooperating witness (CW, Kelly Moffet, and her mother at
the JacKon County Courthouse in Kansas City, Missouri. Those present for his contact were District
Attorney Bob Beaird and Assisiant District Attorney Crayon of the Jackson County Prosecutols Ofiice.
_The Jackson County Drug Task Force had been ccntacted by Bob Eeaird regarding assistance in a
1997 homicide that had been investigated by the Jackson Ccunty ShenfFs Department. The Jackson
County Prosecuto/s office had asked the Jackson County Drug Task Force to assist in obtaining a
controlled ccntact between fre cooperating witness and the suspect, Byron C. Case, W/lI, 11-23-78.

At approximately 1 115 hours, the first attempt by the CW was made to suspect Eyron C. Case at the
number 916-763-1435. No contact was made during this call. The CW adMsed that he telephone at
Case's residence did pick up, but it was an answering madtine only. This callwas placed from fie
Jackson County Courhouse in Kansas City, Missouri. After a seccnd atternpt, it was deemed that the
CW should attempt to contact Case from her residence. The CW advised fiat she believed Case
wculd answe!'the telephone at his residence if he reccgnized the telephone number thrcugh Caller lD.

At approximately 1230 hours, Detedjve F.R. Scarbo and Detective E. Edington r+.ccntacted tre CW at
her residence, while a surveillance team from the JCDTF was set up in the area of Eyron C. Case's
residence, which was located at 6608 E. g€d'Terrace, Kansas City, Missouri.

At approximalely 1248 hcurs, the first attempt ccntrolled ccntact was plaed by the CW to Byron C.
Case at the telephone number 816-7ffi-1435. No contaci was made. The CW advised that ihe
telephone at Case's residence rang only and that no answering madline picked up. Calls were tren

placed on hourly intervals to Byron Case at the number 816-763-1435. Furth€rmore, two calls were
placed to an associate of Case's named Chrisdna Panos. The first attempt to contact Panos was at
approximately 1607 hours at he nurnber 81&931-8460; at which time the CW advised that an opeGrtor
had answered this number and had stated that the number had changed lo 913-722€780. At
approximately 172A hours, a seccnd callwas placed to Panos' residence to the number 91T722-6780.
No contad was made to Panos or the suspect, Byron Case; however, a message was left cn Christina
\
Panos'answering machine.

At approximalely 1752 hours, a final call was placed to Byron Case at the number 816'763-1435, at
whiol time fre CW made ccntact with Byron Case-. Case advised the CW to r+contact him at
approximately 1130 hours on 0&08-2001 to discuss a meeting regarding the homicide rnr,estigation.
The ccntact with Case ended at approximately 1759 hours. lt should be noted that apprcximately nine
(9) phone calls were made to Eyron Case's residence and three (3) phone calls were placed io
Christina Panos'residence, with only the one ccntact a|1752 hours.

Following the ccntact with Case on 06-07-2001, Detectjve F.R. Scarbo and Detective E. Edington
cleared the residence of the CW with an understanding that re-contaci would be made on 06-08-2001
at approximately 1100 hours to re-contact the suspect Byron C. Case.

On 0&08-2001 at approximately 1115 hours, Detective F.R. Scarbo and Detedive E. ECingron r+
ccntacted the CW at the CWs residence. At approximately 1135 hours, the first ccntrolled phone call
was made to Eyron Case at the number 816-763-1435. The CW did not make contact with Case and
left no message on the answering machine. At approximately 1249 hours, a second attempt to ccntad
Eyron Case was made by the CW. The CW teft a message to Case and advised for he suspect to
contiact her at her residence. At approximately 1535 hours, a final call was placed to Byrcn C. Case at
the number 816-763-1435. The CW did not make contact with the suspect and did not leave a
message on Case's answering machine. Following the trird phcne call to the suspec Eyron Case,
Detective F.R. Scarbo and Deteciive E. ECington cleared the CWs residence.

The taoes frcm 06-07-2001 and C€-08-2C01 were both reccvered by Detective Edingtcn. Soth tapes
were copied and placed into the evidence room at the JCDTF. Eoth tapes uere furher transcnbed.

DETAILS:
On 06-07-0'1, Detedives F.R. Scarbo and E. Edington responded to a pre-ananged location to ccntact
cooperating witness (CV1l) Kelly Moffett. The purpose of this ccntaci was to afiempt to have the CW
contaci suspect Byron Case and make a recording of this conversation. Furthermore, the CW was to
attempt to make arrangements for a ccntrolled ccntact with Case. The follcwing is a transcription of the
conversation.

Byron Case: Hello.

CW: Hey is Byron there?

Case: Yeah (unintelligible).

CW: Byron?

Case: Yeah.

CW: l've been trying to get ahold of you forever,

Case: (Unintelligible).

CW: \ /ha?

Case: I heard.

CW: Yeah weil..

Case: (Unintelligible).

CW: What?

Case: I said what happened to you?

CW: I gave it up having to go into my work orientation, but (unintelligible) talk to you, okay?
When are you gonna be able to do somefiing?

Case: You should of called me (unintelligible).

CW: I tried to callyou that morning.

Case: (Unintelligible). \

CW: What?

I Case: I guess ljust didn't have the phone on.

CW: Wellyeah'cause I got up that morning and the second they told me that, I tried to
get ahold of you.

Case: Well I was down there in the (unintelligible) for awhile.

CW: Okay. Well I did call that moming, but uh fie answenng machine didn't ccme on, sc.
I didn't know what, well I still need to talk to you obviously.

Case: Yeah.

CW: I'm not, when do you wanna do something?

Case: Well I found out from the docior yesterday that I (unintelligible) so, um (unintelligible).

CW: Okay well I realize that, but it's not like I'm gonna be in that close of contad with you,
and I mean I need to talk, we need to like get this over a phone to talk to you.

Case: What?

- CW: I said l'm not really womed about that, I need to talk to you like as socn as possible.

Case: (Unintelligible) I mean if it's waited this long, why is it so urgent now,Z

CW: Because l'm supposed to talk to people (unintelligible). They've uh been calling me
like every single day to come in, and I need to get the siory straight and figure
scmefiing out because they've literaily been calling me every single day for the
past week bugging me, like when can I come in, when can I come in, and if I can't
come in out there, they'll come to me and all this stuff.

Case: Well...

CW: Wha?

Case: -
I mean really the only advise that I can give is start everything with I think, or tre
best I can remember is... there. I mean if (unintelligible)...

CW: I guess I (unintelligible) holc! up as of so long because frey're making me like leave
stuff that I liked a long time ago. And I mean I can-t really even like remember like
what we told the police. I know that, we said that Sheiia gct out of the car, but I don't
remember the route, I dcn't remember what street it was. I don't remember any of frat.

CW Wtr, what?

Case: Sometimes that isn't supposed to stick in your memory?

CW: Well uh...

CW: Just anytime.

Case: I don't know. ljust uh I'm sorry but the whole thing is a little bit on the weird side to me.

CW: Why is that?

Case: I mean like, I don't know.

CW: Well whatever, can I just talk to you now?

CW: Well hen duh, thaf s why I want, I figured that you'd say that, I feel the same way.

CW: Look that's nct important, I really don't give a ci'ap about strep throat, okay? This
whole thing is really disturbing me.

CW: Yeah untilthen, yeah.

CW: No I don't think so.

homicide. The following is a reccrded ccnversation between a ccoperating wiftess,
Kelly Mofiit| and susped, Byron C. Case, white male, 11-23-78. The ccoperating
witness placed a callto 81S76$1435, Byron Case's residence, whereupon she made
contact with Byron Case.

Detective E. Edington recovered the tape of the conversation between Morfett and Case and placeC it
into prcperty at JCDTF Headquariers.
