Statement of CW-1 Sh. Vinay jha S/o Sh. Vishwanath Jha, R/o RZ-B-149C,
Nihar, Vihar, New Delhi-110041 (recalled for cross-examination after
application U/S 145(2) of N.I. Act was allowed on 19.01.2015).
On S.A.
Xxxxxxx by Sh. P.D.P. Deo, counsel for the accused.
I am six brothers, namely, Vijaya Nand Jha, Amarkant Jha,
Uday Kant Jha, Kumarkant Jha, Sanjay Kumar Jha and Vinay Jha.

My

brother Uday Kant jha had been working with V.N. Singh in Premier
Security Service, which was run by Sh. V.N. Singh. He was working with
Sh. Vinod Kumar Singh who was supervisor in the said company but I am
not aware what work my brother was doing with that supervisor.

I am

working as an accountant in Sai catering till 2012 now I was doing part
time job in other companies. I am not aware from what date to what date
my brother Uday Kant Jha had been working or had worked with Sh. V.N.
Singh. I never asked him what job he was doing with Sh. V.N. Singh. I
have/had no relation

with Sh. Vinod Kumar Singh.

I know him only

because he had been friend of my brother Sh. Uday Kant Jha.

I never

asked him also what work he was doing.

I had a plot in Kirari of 33 Sq. Yds. I have no receipt of any
nature pertaining to the alleged loan given to Mr. V.N. Singh (Vol. I asked
my brother Sh. Uday Kant Jha to transfer an amount of approximately Rs.
1,80,000/- from his account to the account of the complainant on account
of part payment of the loan). I do not remember the date or month when
this money was given to Mr. V.N. Singh.
Mr. V. N. Singh never came to me for loan but Sh. Vinod
Kumar Singh came on his behalf for the loan.
Q.

I want to say that you have not written any date, any month and

any year when Sh. Vinod Kumar Singh came to you for inducting him as
partner in the business of Sh. V.N. Singh and he was in urgent need of
money for the revempting the loss in the said business?
Ans. Yes, it is correct that no date, no month and no year is mentioned.

It is correct that no date, month and year is given in the
complaint to sold my plot in Kirari. It is also correct that the amount for
which the plot was sold. It is correct that in the complaint I have not given
the amounts for which the plot was sold and to whom. It is also correct
that I have not given by which mode the sale amount was taken by me
from the unknown buyer. It is also correct that when the Rs.6,00,000/was given to Sh. V.N. Singh in the complaint. It is also correct that I have
not written the date, month and year as to when I demanded money from
Mr. V.N. Singh. It is also correct that I never approached Sh. Vinod Kumar
Singh to approach Sh. V.N. Singh to give him money back ( Vol.

approached Sh. Vinod Kumar Singh to request Mr. V.N. Singh to return my
money).
I do not have any proof that I took out Rs.4,20,000/- from the
bank.

I do not have any other proof to say that I

had Rs.4,20,000/-

except that the said amount was received from the sale of my plot. It is
correct to say that I have not written any amount in my complaint which I
received from sale of my plot. I do not have the sale deed of the said plot
except the notice. It is correct to say that no date/month or year has been
given in the notice also for the alleged request for inducting me in the
business of Mr. V.N. Singh and also sale of plot, date of alleged giving of
Rs.6 lacs and allegedly Vinod Kumar Singh in this regard. It is also correct
that in my complaint I have not given any date month or year for alleged
request to pay the alleged amount by Sh. V.N. Singh. It is also correct that
no date month/year has been given pertaining to the issues of the
complaint except that of date of legal notice.
It is correct that returning memo dated 03.05.2014 does not
have any endorsement as Funds Insufficient. After received the returning
memo I did not write to Mr. V.N. Singh for dishonoring of the said cheque.
I have no friendship with Mr. V. N. Singh.

I do not know much

about the business of the Sh. V.N. Singh.

I was earning Rs.20,000/- per month till 2010-14.

I got

married in 2010. After my marriage my wife was staying at my native

village in Bihar. Out of this money, I have been maintaining myself and
my wife. My

income has reduced now. I am not a income-tax payee. I have not shown
anywhere by any document about the sale purchase and sale receipt of
the alleged plot at Kirari.
I have never seen Sh. V.N. Singh signing on any paper. The
handwriting on cheque in question in its 'colum Pay' is written by as Vinay
Jha by Sh. Vinod Kumar Singh and the amount Rs.6 lacs only on the
cheque is also written by Sh. Vinod Kumar Singh and the date also on the
top of the cheque written by Sh. Vinod Kumar Singh and the amount in
figure i.e. Rs.6 lacs is also written by Sh. Vinod Kumar Singh.
It is wrong to suggest that I do not know Mr. V.N. Singh. It is
wrong to suggest that I have never given any money to Mr. V.N. Singh. It
is wrong to suggest that the said cheque was misused by Mr. Vinod Kumar
Singh in consonance with my brother Uday Kant Jha to take revenge due
to rively in the business.
It is incorrect to suggest that Mr. Vinod Kumar Singh had been
taking the blank cheques from Sh. V.N. Singh

for payment to various

persons, employees, business expenditure and for their own share for
working with.
It is incorrect to suggest that Sh. Uday Kant Jha had been
taking the blank cheques from Sh. V.N. Singh

for payment to various

persons, employees, business expenditure and for their own share for
working with.
It is incorrect to suggest that there is no liability as far as the
impugned amount is concerned towards Mr. V.N. Singh as I never give the
said amount nor Mr. V.N. Singh took any amount to him. It is incorrect to
suggest that Mr. Vinod Kumar Singh used me by forging and misusing the
cheque in question.
That It is incorrect that the total lie that I ever give money to
the Sh. V.N. Singh and he ever took any amount from me.

That it is

incorrect that I have never met Mr. V.N. Singh in my life.
