COUNT ONE
Patent Infringement
9. As a cause of action and ground for relief, Plaintiff alleges and incorporates
by reference paragraphs 1 through 8 of this complaint as a part of this Count.
10. Plaintiff is the Patentee and the owner of all rights under the United States
Patent No. D573, 399 S entitled Barbecue Grill (the Patent), including the right
to bring action against infringers of the Patent.
11. On July 22, 2008, the Patent was duly and legally issued. A copy of the
Patent is attached as Exhibit A.
12. Defendant Shinerich has manufactured, used, sold, and/or offered for
sale products in the United States that infringe the Patent. See Exhibit B, the
Instruction Manual for Tabletop Gas Grill Model No. SRGG806 identifying
Defendant Shinerich by its customer service e-mail,
customerservice@shinerichgroup.com, which infringes the Patent ("Products").
Further, Defendant Shinerich is the owner of U.S. Trademark Registration
Number 3,932,452, for MASTER COOK registered on March 15, 2011, covering the
following goods: barbecue grills.see Exhibit C.
13. Defendant Menard has manufactured, used, sold, and/or offered for sale
products in the United States that infringe the Patent through Defendant Menards

Case 3:15-cv-01159 Document 1 Filed 07/30/15 Page 5 of 13

website offering for sale Defendants Tabletop Grill Model No. SRGG806. See
Exhibit D.
14. Upon information and belief, Defendant Shinerich manufactures the
infringing tabletop grill, which it sells in the United States through Defendant
Menard.
13. Plaintiff has never authorized Defendants at any time to make, use or sell
any products covered by the Patent.
14. Plaintiff has been damaged by the Defendants infringement of the Patent,
including, without limitation, lost profits, and/or royalty income, and/or damages
on account of convoyed sales, and the Defendants have been unjustly enriched by
such infringement, on account of profits and/or conveyed sales. Plaintiff has also
suffered irreparable harm by Defendants infringement of the Patent and will
continue to suffer irreparable harm in the future, unless the Defendants are
preliminarily and permanently enjoined from infringing the Patent.
15. Upon information and belief, Defendants have had actual knowledge of the
Patent, and its infringement of the Patent has been, and continues to be, willful,
wanton, malicious and deliberate. The circumstances of such infringement warrant
finding the above-complained of infringement to be an exceptional one.
COUNT TWO
Federal Unfair Competition

Case 3:15-cv-01159 Document 1 Filed 07/30/15 Page 6 of 13

16. As a cause of action and ground for relief, Plaintiff alleges and
incorporates by reference paragraphs 1 through 15 of this complaint as a part of this
Count.
17. Plaintiff, long prior to the acts complained of herein, has been and is now
engaged in interstate commerce and/or the foreign commerce of the United States
by virtue of the ongoing sales of products, including the above barbecue grill as
illustrated in Exhibit E (herein after Infringed Product). Defendants copycat
product is illustrated beside plaintiff's patented barbecue grill as shown in Exhibit F.
Such product of the defendants is the subject of this litigation.
18. Plaintiffs Infringed Product has been sold for great numbers of years and
continues to be extensively sold.
19. The sculptural and graphic design of Plaintiffs Infringed Products
(hereinafter Trade Dress), namely their sculptural configuration and/or other
non-functional design features, is a protectable trade dress under 43(a) of the
Lanham Act, which has been infringed by Defendant (See Exhibit F, photograph of
Defendants Infringing Products beside the original products of plaintiff) and
continues to be infringed on account of Defendants sale in commerce of piratical
copies of Plaintiffs barbecue grill. Plaintiff derives substantial benefits from selling
products bearing Plaintiffs exclusive Trade Dress.

Case 3:15-cv-01159 Document 1 Filed 07/30/15 Page 7 of 13

20. Plaintiffs barbecue grill include the following elements: a shiny exterior
comprised of a rounded trapezoidal shaped lid on top, with a plastic handle and a
rounded trapezoidal base pan at the bottom. The entire grilling unit is secured on
top of four wire chrome legs with curved feet. The lid also has three cartoucheshaped) openings/cutouts in series on its left and the right sides and four additional
cutouts on the back arranged in parallel with two cutouts in each row. The base pan
also has similar cutouts with two such openings on the left and also on the right
side. The lid also has a sheet metal plate attached in the back imprinted on which,
are technical information regarding the burner and its proper use. Plaintiff has used
and continues to use its distinctive Trade Dress and, by virtue of widespread sales,
the Trade Dress has come to indicate origin with Plaintiff. Plaintiff, by virtue of said
use of the Trade Dress on its goods, and through Plaintiffs business, has obtained a
reputation of the highest quality. Such reputation has given Plaintiff and its
barbecue grill and other products a pre-eminent position in the marketplace.
21. Defendants barbecue grills are of inferior quality but include the
following copied elements: a shiny exterior comprised of a rounded trapezoidal
shaped lid on top, with a plastic handle and a rounded trapezoidal base pan at the
bottom. The entire grilling unit is secured on top of four wire chrome legs with
curved feet. The lid also has three cartouche-shaped openings/cutouts in series on
its left and the right sides and four additional cutouts on the back arranged in

Case 3:15-cv-01159 Document 1 Filed 07/30/15 Page 8 of 13

parallel with two cutouts in each row. The base pan also has similar cutouts with
two such openings on the left and also on the right side. The lid also has a sheet
metal plate attached in the back imprinted on which, are technical information
regarding the burner and its proper use.
22. The design of Plaintiffs product itself, namely its configuration, is a
protectable trade dress under 43(a) of the Lanham Act, which has been infringed
by Defendant and continues to be infringed on account of Defendants sale in
commerce of the Defendants product.
23. Plaintiff has incurred great expense and has devoted substantial
resources to make the barbecue grill famous and/or readily recognizable to
consumers. Plaintiffs investments and efforts have been successful as the Trade
Dress has become highly distinctive in the marketplace and denotes to purchasers a
line of goods which originate with Plaintiff.
24. Upon information and belief, long after Plaintiffs creation, adoption and
use of the Infringed Product, and without any authorization, the Defendants, with
actual and/or constructive knowledge of Plaintiffs use of the Trade Dress of said
Infringed Product and in contravention of Plaintiffs trade dress rights, adopted and
used a product configuration for its barbecue grill calculated to simulate Plaintiff's
Trade Dress. Defendants had as their objective to mimic the distinctive elements of
trade dress as a means for unfairly taking advantage of and profiting from Plaintiff's

Case 3:15-cv-01159 Document 1 Filed 07/30/15 Page 9 of 13

image in the marketplace through the sale of the Defendants copycat grills.
Defendants have distributed and continues to distribute in interstate commerce to
the public, copycat grills bearing an infringing derivative version of the distinctive
features and layout of Plaintiffs Trade Dress for the Defendants own commercial
advantage.
25.

Defendants have used and continue to use derivatives, and/or

colorable imitations of Plaintiffs Trade Dress in direct competition with Plaintiff.

Defendants have used and continue to use these derivatives and/or colorable
imitations of Plaintiffs Trade Dress in connection with sales, offering for sale or
distribution, advertising and promotion of goods which are not the product of
Plaintiff, in a manner that is likely to cause confusion or mistake or to deceive
purchasers as to the source of origin of such goods.
26. Defendants have deliberately misled and will continue to mislead
purchasers, and prospective purchasers, as well as the public at large, to believe,
contrary to fact, that Defendants goods are manufactured, marketed, sponsored or
endorsed by, or affiliated with Plaintiff. The Defendants are unfairly competing
with Plaintiff by trading on and disparaging Plaintiffs goodwill symbolized by its
Trade Dress.
27. The Defendants acts are a false description and representation that said
goods are made by, sponsored by and/or affiliated with Plaintiff. Said acts are in

Case 3:15-cv-01159 Document 1 Filed 07/30/15 Page 10 of 13

violation of 15 U.S.C. 1125(a) in that Defendants have used, in connection with

goods, a false designation of origin and a false description and representation,
including words, reproductions and other symbols tending to falsely describe or
represent the same and have caused such goods to enter into interstate commerce,
and or are in violation of 43(a) of the Lanham Act as constituting dilution of the
Trade Dress.
28. As a direct and proximate result of these acts of unfair competition, trade
dress infringement and false designation of origin, Plaintiff has sustained and will
continue to sustain irreparable damage and injury to its business, goodwill,
reputation and profits, in an amount not presently known but believed to be in
excess of $1 million. Plaintiff is entitled to judgment for the Defendants profits and
any damages sustained by Plaintiff in consequence of the deliberate nature of the
infringement by Defendants in an amount equaling three times said damages.
29. By reason of the acts of the Defendants herein alleged, Plaintiff has been
damaged and, unless restrained and enjoined preliminarily and permanently,
Defendants have and will continue to deceive the public, impair the value of
Plaintiffs products and otherwise will cause Plaintiff immediate and irreparable
harm.

to splatter and could result in serious burns, bodily harm
or other damage. If a grease fire develops, turn regulator/control knob OFF.

f food residue on HIGH. If grill has not been regularly
cleaned, a grease fire can occur that may damage the product.
WARNING: When cooking, fire extinguishing materials shall be readily accessible. In the event of an oil/grease fire, do not
attempt to extinguish with water. Use type BC dry chemical fire extinguisher or smother with dirt, sand or baking soda.
Controlling Flare-ups:
Flare-ups are a part of cooking meats on a grill, and adds to the unique flavor of grilling.
Excessive flare-ups can over cook your food and cause a dangerous situation for you and your grill.
Important: Excessive flare-ups result from the build-up of grease in the bottom of your grill. If excessive flare-ups occur, DO NOT
pour water onto the flames.
If grease fire occurs, close the lid AND turn the regulator/control knob to OFF, until the grease burns out. Use caution when opening
the lid as sudden flare-ups may occur.

1. Use the upper cooking grid (warming rack) for keeping cooked food warm, toasting breads or cooking delicate
foods in aluminum foil pouches.
2. To keep food from sticking to the grids, spray or coat with cooking oil before lighting.
3. To reduce flare-up keep grill clean, use lean cuts of meat (or trim fat) and avoid cooking on very high temperatures.
4. Place delicate foods like fish and vegetables in aluminum foil pouches and indirect cook or place on upper cooking
levels (warming rack).
WARNING: Never cover entire cooking area with aluminum foil.
5. To avoid losing natural juices, use long handled tongs or spatulas instead of forks and turn foods over just once
during cooking.
6. When direct cooking adjust your burners to different levels so foods can be prepared to different internal
temperatures in the same time frame.
7. When indirect cooking roasts and larger cuts of meat, place meat onto a roasting rack inside a heavy gauge metal
pan. Place pan over the un-lit burners.
8. Try water pans to reduce flare-ups and cook juicer meats. Before starting grill remove cooking grids and place a
heavy duty shallow pan directly on heat plates. Fill half way with water, fruit juices or other flavored liquids. Replace
cooking grids and position food over the loaded pan.12. Enhance food flavors by using wood chips in smoker boxes
or aluminum foil pouches. Follow the wood manufacturers instructions.
9. Rotisseries, grill baskets, vertical poultry holders and other acc essories can enhance your experiences, reduce
cooking times and aid in clean-up.
10. Clean cooking grids and racks after every use with a quality grill bush designed for your grid material. Wear
protective gloves and gently remove the build-up while grids are hot.
11. After every use, allow grill to cool. Then protect clean cooking grids with a light coat of cooking oil, empty grease
pan, wipe outside surfaces with a suitable kitchen cleaner and protect surfaces with a quality cover that properly
fits your grill.
