Revenue/DESK -1/T-7/ NP/SHAHAD-KALYAN/SR-64/2014, dated 28-11-2014. granted to Shri


Ramesh Hari Marathe in respect of the Land admeasuring 1786.10 Sq.mtrs Area as per
7/12 Extract bearing Survey No.31, Hissa No.6A and C.T.S Nos. 887,891 to 899 & 932, in
Sheet No. 8 situated at Shahad Mohane Road, Shahad, Taluka Kalyan Dist .Thane.
I Smt. Mohini Kanhaiyalal Godhwani hereby state as under : -1) I hereby states that the R.T.S. Revision No 86/2014 is subjudiced and pending the same
before The Deputy Director of Land Record Kokan Region Mumbai Court and the matter
is under consideration and the same matter is not final, as there is a boundary dispute
and I have a objection regarding the adjacent land owner Shri Ramesh Hari Marathe had
carried by forceably the construction of compound wall on the backside some portion in
C.T.S.No.895(Plot No G as Per Sale Deed Plan) admeasuring area 325 sq. mtrs with
having the intension to grab the Plots and have applied to you for sanction of Building
Permission by misrepresenting the true facts and have succeeded in obtaining the
Building Permission , as it is totally illegal and obtained by fraud and misrepresentation
the plots boundaries by adjoining the two properties. Therefore I hereby request you to
find out actual, factual position and cancel the Non Agriculture Permission from
Collector Thane No. Revenue / DESK -1/T-7/ NP/SHAHAD-KALYAN/SR-64/2014, dated 2811-2014.

2) I hereby states that my Son Shri. Prakash Kanhaiyalal Godhwani and my daughter Lata
Kanhaiyalal Godhwani alias Smt. Reshma Ghanshyamdas Kherajani (after Marriage) and
Kum. Parmeshwar Khemchand Vaswani had purchased Land admeasuring 6014

166mtr (length) X 10 mtr (width) = 1660 Sq.mtrs. Affected Area after Road Widening. So
actually corrected area 4354 Sq.mtrs will be entered in the C.T.S Nos. Records and in the
Property Cards in Sheet No.8 after Road Widening of above mentioned plots instead of
6014 Sq.mtrs area as per 7/12 Extract as follows:-

4) Further I state that I have a objection that Shri.Ramesh Hari Marathe had carried
by forceably the construction of compound wall as a encroachment on the
backside some portion in C.T.S. No. 895, Chalta No.39 (Plot No. G as Per Sale Deed
Plan) admeasuring area 325 Sq.mtrs., Moral No. 131, D.I.L.R. Thane Measurement
Plan dated 10-01-1985 and previously Plot No. 30 mentioned accordingly to 43
parts according to Hissa From No. 4 in Survey No. 31 on Gut Book record, which
was purchased by my daughter Lata Kanhaiyalal Godhwani alias Smt. Reshma
Ghanshyamdas Kherajani (after Marriage) by Sale Deed No. 1591,dated 30-4-1985
from Shri. Hasha Shanker Kot and others lying being and situated in Survey
No.31,Hissa No. 6A, Shahad Mohane Road, on East Side, Shahad, Taluka Kalyan ,
Dist Thane.
5) I further state that Shri. Ramesh Hari Marathe had also acquired by forceably from
the 12 ft. Entrance Internal Road Plot No.3 area 155.5 Sq.mtr some portion in C.T.S.
No. 895 and Chalta No. 39 by reducing the entrance portion by encroachment as a
existing compound wall, office construction , Gate recently carried out with
getting the Measurement Plan Moral No.541 dated 11-11-2008 and Measurement
Plan Moral No. 196 dated 18-02-2013 by adjoining obtained the Non Agriculture
Permission from Collector Thane No. Revenue / DESK 1/T-7/NP/SHAHADKALYAN/SR-64/2014, dated 28-11-2014 and Building Construction Plan Permission
from Kalyan Dombivali Municipal Corporation No KDMC/NRV/BAP/KV/2014-15/1/260,
dated 04-12-2014 and Proceeding with the construction on the aforesaid plots,
which

was

purchased

by

my

daughter

Kanhaiyalal

Godhwani

alias

Smt.Reshma Ghanshyamdas Kherajani (After Marriage) by Sale Deed No. 1584,


dated 30-4-1985 from Shri.Vishwanath Ganpatrai Joshi , lying being and situated in
Survey No.31,Hissa No.6A & 6B, Shahad Mohane Road, on East Side, Shahad,
Taluka Kalyan, Dist Thane, admeasuring area 68 Sq.mtrs (Plot No. D as Per Sale
Deed Plan) and 87.5 Sq.mtrs. (Plot No. F as Per Sale Deed Plan), hence Plot No.3

Total area 155.5 Sq.mtrs of Moral Nos. 625 and 626, D.I.L.R. Thane Measurement
Plan dated 02-05-1981.
6) I further state that Shri. Ramesh Hari Marathe had acquired by forceably from the
Plot No G as per Sale Deed Plan area 325 Sq.mtrs. plot some portion and from the
Plot No 3 area 155.5 Sq.mtrs Some portion in the C.T.S. No. 895 with having the
intension to grab the Plots. Hence

Excess Area 223 Sq.mtrs had

acquired by

Ramesh Hari Marathe by changing the Name of Smt.Mohini Kanhaiyalal Godhwani
on dated 20/06/2013 by The Deputy Superintendent of Land Record is illegal and

not amenable to the provision of law.


Under these facts and circumstances, you are hereby requested to personally look
in to the matter and take the necessary action and for your ready reference and
knowledge I am enclosing documents Xerox Copies for the verification in the
present situation to bring the true facts before you. In order to enable you to
adjudicate completely. Therefore I hereby request you to find out actual, factual
position and cancel the Non Agriculture Permission from Collector Thane No.
