LEASE CONTRACT

KNOW ALL MEN BY THESE PRESENTS:


This CONTRACT OF LEASE is made and executed at the Municipality of Guiguinto, Province
of Bulacan, this 13th day of June 2015, by and between:
Spouses PERFECTO S. CASAJE and VIOLETA D. CASAJE, both of legal age, Filipino
citizens, and with residence address at Purok 6, Barangay Palapat, Hagonoy, Bulacan,
hereinafter referred to as the LESSOR(s).
-ANDMA. DIVINA LUZ BALTAZAR CHAN, Filipino, married to HERVERT MORENO DE LARA
and with former residence address at Poblacion, Guiguinto, Bulacan), hereinafter referred to
as the LESSEE(s).
WITNESSETH; That
WHEREAS, the LESSOR(s) are the owners of a residential property specifically described as
Lot 16, Block 10, La Aldea Subdivision, Guiguinto, Bulacan;
WHEREAS, the LESSEE(s) manifested their intent to lease the above-described residential
property;
WHEREAS, the LESSOR(s) agreed to lease-out the property to the LESSEE(s) and the
LESSEE(s) are willing to lease the same;
NOW THEREFORE, for and in consideration of the foregoing premises, the LESSOR(s) leased
unto the LESSEE(s) and the LESSEE(s) hereby accepted and occupied the above-described
residential property, subject to the following:
TERMS AND CONDITIONS
1. PURPOSES/OCCUPANTS: That premises hereby leased shall be used exclusively by the
LESSEE(s) for residential purposes only and shall not be diverted to other uses. It is hereby
expressly agreed that if at any time the premises are used for other purposes, the LESSOR(s)
shall have the right to rescind this contract without prejudice to their other rights under the
law. The maximum number of occupants shall be four (4) whose names and identity are
strictly limited to the following herein registered individuals with their names, ages and
relationship to the herein named LESSEE(s), as follows:
1. MA. DIVINA LUZ BALTAZAR CHAN, Lessee;
2. HERVERT MORENO DE LARA, Lessee;
3. JANN VENIEDIC CHAN DE LARA, 6 years old, son of Lessee(s);

4. JANNA VERLIN ROSE CHAN DE LARA, 5 months, daughter of Lessee(s),


in which case, however, all four of them shall be jointly and severally liable to all the terms and
conditions contained in the herein Lease Contract.
Another person, limited to one only, the purpose of whom is to serve as domestic helper, yaya
or the like, subject to the LESSEE(s) written notification to the LESSOR(s) and their approval
may be allowed by the LESSOR(s) to stay in the leased property.
2. TERM and RENEWAL OF CONTRACT OF LEASE: The term of lease is for ONE (1) YEAR
from June 1, 2015 to May 31, 2016. Upon expiration, this lease may be renewed under such
terms and conditions as may be mutually agreed upon by both parties. Written notice of
intention to renew the lease shall be served to the LESSOR(s) not later than seven (7) days
prior to the expiry date of the period herein agreed or not later than May 27, 2016, upon
which a new LEASE CONTRACT shall be prepared subject to the acceptance of the herein
parties.
Since the LESSEE(s) paid the three (3) times rental rate and move-in to the leased property
on June 13, 2015, and if the herein LEASE CONTRACT is not renewed upon expiration of its
one-year term or pre-terminated at any period within the one-year term, the LESSEE(s) shall
be allowed to move-out of the premises on June 13, 2016 and or accorded an allowance of 13
days upon pre-termination, in order to compensate for the rental fee for the period from June 1
to 13, 2015 they have already paid.
3. RENTAL RATE: The monthly rental rate for the leased property shall be in PESOS: SIX
THOUSAND (P6,000.00), Philippine Currency, all rental payments shall be payable to Violeta
D. Casaje.
4. DEPOSIT/PAYMENT, FORM OF PAYMENT: CASH/CHECK NUMBER/DATE and/or DUE
DATE OF PAYMENT: That the LESSEE(s) shall deposit/pay to the LESSOR(s) upon signing of
this contract and prior to move-in in the form of cash for the initial deposit/payment of three
(3) times the rental rate to cover the rental for the first two (2) months and security
deposit which shall answer partially for damages and any other obligations, for utilities such
as Water, Electricity, CATV, Telephone, Association Dues or resulting from violation(s) of any of
the provision of this contract and ten (10) checks to cover the rental for the third (3rd)
month up to the twelfth (12th) month. Monthly rental for the third up to the twelfth month
shall be payable two months in advance and on the 5 th of the month of payment. The schedule
of payment in the form of cash and/or post-dated checks shall be strictly as follows:

5. DEFAULT PAYMENT: In case of default by the LESSEE(s) for one month in the payment of
the rent, such as when a check(s) is/are dishonored by the drawee bank, the LESSOR(s) at its
option may terminate this contract without prejudice to the unutilized advance rental, eject the
LESSEE(s), padlock the premises and forfeit and/or apply the deposit to the utilities and/or
other damages whatsoever due to the negligence of the LESSEE(s).
6. SUB-LEASE: The LESSEE(s) shall not directly or indirectly sublet, allow or permit the
leased premises to be occupied in whole or in part by any person, form or corporation, neither
shall the LESSEE(s) assign its rights hereunder to any other person or entity and no right of
interest thereto or therein shall be conferred on or vested in anyone by the LESSEE(s) without
the LESSOR(s) written approval.
7. PUBLIC UTILITIES: The LESSEE(s) shall pay for its telephone, electric, cable TV, water,
Internet, association dues and other public services and utilities during the duration of the
lease.
8. FORCE MAJEURE: If whole or any part of the leased premises shall be destroyed or
damaged by fire, flood, lightning, typhoon, earthquake, storm, riot or any other unforeseen
disabling cause of acts of nature/without the fault of the LESSEE(s), as to render the leased
premises during the term substantially unfit for use and occupation of the LESSEE(s), then
this lease contract may be terminated without compensation by the LESSOR(s) or by the
LESSEE(s) by notice in writing to the seven (7) days prior to the intended date of termination.
The remaining uncleared/unused checks/payments shall be returned by the LESSOR(s) to the
lessee after deducting appropriate charges/damages due to the fault of the LESSEE(s).
9. LESSOR'S RIGHT OF ENTRY: The LESSOR(s) or its authorized agent shall after giving
due notice to the LESSEE(s) shall have the right to enter the premises in the presence of the
LESSEE(s) or its representative or a police officer, barangay official or the like at any
reasonable hour to examine the same or make repairs therein or for the operation and
maintenance of the building or to exhibit the leased premises to prospective LESSEE(s), or for
any other lawful purposes which may be deemed necessary.
10. EXPIRATION OF LEASE: At the expiration of this Lease Contract the LESSEE(s) shall
turn-over the leased premises with all the corresponding keys and in good, tenable and original

condition as when it was leased to them except for reasonable deterioration due to normal wear
and tear and/or without their fault, vacant of all occupants, movable furniture, articles and
effects of any kind to the LESSOR(s). Non-compliance with the terms of this clause by the
LESSEE(s) will give the LESSOR(s) the right, not to accept the turn-over of the premises and
compel the LESSEE(s) to pay rent at the rate imposed by the LESSOR(s) plus Twenty Five
(25%) percent thereof as penalty until the LESSEE(s) shall have complied with the terms
hereof or make an inventory at the presence of appropriate authorities and remove out of the
premises all the movable furniture, articles and effects of any kind at the expense of the
LESSEE(s), so as to make the properly make the premises leasable. The same penalty shall be
imposed in case the LESSEE(s) fails to leave the premises after the expiration of this Lease
Contract or its termination for any reason whatsoever.
11. ACKNOWLEDGEMENT and UNDERTAKING: The LESSEE(s) acknowledged to have
leased the above residential property in good order and condition and undertakes to take good
care the same with the diligence of a good father of a family and do the necessary repair
and/or bring back the said residential unit to its original condition at the time he/she/they
lease the same in case of damage thereto due to their own negligence and use except for
reasonable deterioration due to normal wear and tear which shall be for the account of the
LESSOR(s);
The LESSOR(s)
acknowledged to have received the aforementioned
payments/checks and undertakes to return the security deposit of P6,000.00 in full or net of
the costs incurred or to be incurred for the LESSEE(s) unpaid utilities and necessary costs
and any unutilized rental in case of pre-termination of this lease contract not due to the fault
of the LESSEE(s).
12. JUDICIAL RELIEF: Should any one of the parties herein be compelled to seek judicial
relief against the other, the losing party shall pay an amount of One Hundred (100) % of the
amount claimed in the complaint as attorney's fees which shall in no case be less than
P50,000.00 pesos in addition to other cost and damages which the said party may be entitled
to under the law.
13. This LEASE CONTRACT shall be valid and binding between the parties, their successorsin-interest and assigns.
