    Ruling:
    1.
    WithinthePhilosophyofthepresentlegalsystem,theunderlyingreasonforthe
    legalfictionbywhich,forcertainpurposes,theestateofthedeceasedpersonis
    considereda"person"istheavoidanceofinjusticeorprejudiceresultingfromthe
    impossibilityofexercisingsuchlegalrightsandfulfillingsuchlegalobligationsofthe
    decedentassurvivedafterhisdeathunlessthefictionisindulged.
    Withintheframeworkandprinciplesoftheconstitutionitself,tocitejustone
    example,underthebillofrightsitseemsclearthatwhilethecivilrightsguaranteed
    thereininthemajorityofcasesrelatetonaturalpersons,theterm"person"usedinsection
    1(1)and(2)mustbedeemedtoincludeartificialorjuridicalpersons,forotherwisethese
    latterwouldbewithouttheconstitutionalguaranteeagainstbeingdeprivedofproperty
    withoutdueprocessoflaw,ortheimmunityfromunreasonablesearchesandseizures.
    Wetakeitthatitwastheintendmentoftheframerstoincludeartificialorjuridical,no
    lessthannatural,personsintheseconstitutionalimmunitiesandinothersofsimilar
    nature.Amongtheseartificialorjuridicalpersonsfigureestatesofdeceasedpersons.
    Hence,weholdthatwithintheframeworkoftheConstitution,theestateofPedroO.
    Fragranteshouldbeconsideredanartificialorjuridicalpersonforthepurposesofthe
    settlementanddistributionofhisestatewhich,ofcourse,includetheexerciseduringthe
    judicialadministrationthereofofthoserightsandthefulfillmentofthoseobligationsof
    hiswhichsurvivedafterhisdeath.
    2.
    Ifbylegalfictionhispersonalityisconsideredextendedsothatanydebtsor
    obligationsleftby,andsurviving,himmaybepaid,andanysurvivingrightsmaybe
    exercisedforthebenefitofhiscreditorsandheirs,respectively,wefindnosoundand
    cogentreasonfordenyingtheapplicationofthesamefictiontohiscitizenship,andfor
    notconsideringitaslikewiseextendedforthepurposesoftheaforesaidunfinished
    proceedingbeforethePublicServiceCommission.Theoutcomeofsaidproceeding,if

    successful,wouldintheendinuretothebenefitofthesamecreditorsandtheheirs.Even
    inthateventpetitionercouldnotallegeanyprejudiceinthelegalsense,anymorethanhe
    couldhavedoneifFragrantehadlivedlongerandobtainedthedesiredcertificate.The
    fictionofsuchextensionofhiscitizenshipisgroundeduponthesameprinciple,and
    motivatedbythesamereason,asthefictionoftheextensionofpersonality.Thefictionis
    madenecessarytoavoidtheinjusticeofsubjectinghisestate,creditorsandheirs,solely
    byreasonofhisdeathtothelossoftheinvestment.
