CALL to Order Colin Lichtenstein called the meeting to order at 9:00 a.m.

Findings of Fact:

The subject site is located at 6400 Roswell Road (SR9). The property is zoned C-1
(Commercial District) conditional under Fulton County zoning case Z66-0058 and is located
within the Urban District of the Sandy Springs Overlay District.

Abutting Property Land Uses/Zoning:

North: Properties zoned C-1 (Community Business District) under Fulton County zoning
case Z64-0069 and C-1 (Community Business District) under Fulton County zoning case
Z68-0148.
East: Property zoned C-1 (Community Business District) under Fulton County zoning case
Z57-0031.
South: Property zoned C-1 (Community Business District) under Fulton County zoning
case Z96-0036.
West: Properties zoned R-3 (Single Family Dwelling District) and O-I (Office and
Institutional District) under Fulton County zoning case Z00-0119.

Enforcement:
On May 1, 2009 the building was inspected by Code Enforcement and Building Inspection
officers. The building had a dilapidated dumpster enclosure and roof damage caused by a
fire. The building was condemned after determining it was un-inhabitable.

A citation was issued on September 18, 2009 for continuous deterioration of the dumpster
enclosure and the building. The owner appeared in court on November 19, 2009. The case
has been reset until March 18, 2010 to allow time for the Design Review Board’s decision
and plan review process (see attached code enforcement case).

Request:

The applicant is seeking approval to reconstruct a 4,000 square foot building, which was
damaged by fire. The building is to remain in the existing footprint. Modifications include
straightening of a wall and removal of interior walls. The proposed building exterior will
consist of red tint brick with white mortar, tan stucco with a matching EIFS trim. The store
front will have large tampered windows with a dark ionized tint. The larger windows will
allow more natural light into the building. “Shade fins” are proposed to be installed above
the windows to shade the building and reduce heat. The existing parking lot and landscape
is to remain the same.

The Board is asked to take action at this meeting due to the court schedule. The Board may
comment on the appropriateness of the building permit to meet the intent of the ordinance
relative to appearance and function. If the proposed building permit seems appropriate with
some modification, the Board should make a recommendation on changes that might bring
the relief proposed into harmony with the intent of the ordinance and with the surrounding
development if deemed appropriate.

Analysis

The requested Building Permit involves Urban District Overlay requirements. Relative to
the building, staff requests the Board address each item under the following sections of the
Zoning Ordinance:

 12B.5.H. Windows – the proposed plan meets this standard.

The building permit will not exceed forty (40) percent of the property’s most recent tax
appraisal (12B.2.A). Therefore, they are not required to install streetscape along the property
frontage.

Staff recommends APPROVAL.
