Pursuant t o Section 51 (b) of Republic Act No. 6975 which provides

that the city and municipal mayors stfall exercise operational supervision and
control over the Philippine National Police (PNP) units in their respective
jurisdictions except during the thirty (30) days before and thirty (30) days
following any national,

local or barangay elections, the Commission on

Elections, by virtue of its power under the Constitution, the Omnibus Election
Code,

other election

laws,

and R.A.

RESOLVED,

as it hereby

RESOLVES t o promulgate, the following:

S e c t i o n 1. Supervision and Control. - From April 13, 2 0 1 3 to
June

12,

2013,

the

Commission

on

Elections

shall

exercise

direct

operational supervision and control over' the Philippine National Police

through the' PNP Director.
During said period, all decisions, directives, orders and instructions of
the Commission on Elections shall prevail over those emanating from any
other authority except the President of the Philippines.
Sec. 2. Definition of terms. - The following shall mean:

a. "Operational supervision and control"

the

power t o direct,

superintend, oversee and inspect the police units or forces. It shall

include the power t o employ and deploy units or elements of the
PNP, through the station commander, t o ensure public safety and
effective maintenance of peace and order within the locality;

b. "Employ"

- the utilization of units o r elements of the PNP for

purposes o f protection of lives and properties, enforcement of laws,

maintenance of peace and order, prevention of crimes, arrest of
criminal offenders and bringing the offenders t o justice,

and

ensuring public safety, particularly in the suppression of disorders,

riots,

lawless

violence,

rebellious

or

seditious

conspiracy,

insurgency, subversion or other related activities; and

c. "Deploy"

elements

or

the orderly and organized

physical movement of

units

of

the

PNP

within

the

province,

city

or

municipality for purposes of employment as herein defined.

Sec. 3. Effectivity. - This Resolution shall take effect on the seventh

(7th) day after its publication in at least two (2) newspaper of general

circulation in the Philippines.

Let the Education and ~ n f o r m a t i d n~ & a r t m e n t cause the publication of
this Resolution in two (2) daily newspapers of general circulation and furnish
copies hereof t o the Secretary of the Department of Interior and Local
Government, all provincial governors, city and municipal mayors copies
hereof.
