According to a report by G. John Richards, Prosecuting Attorney of Lincoln County, the


following cases were heard in the Circuit Court of Lincoln County before the Honorable Amy
Kinker, on January 25, 2010.

STATE OF MISSOURI VS. JACK MAXAM

Jack Maxam, 69, of Winfield, entered a plea of guilty on December 07, 2009 to two Class B
felonies of assault in the first degree and was sentenced on January 25, 2010. The defendant
received a suspended imposition of sentence of three years with the Missouri Board of Probation
and Parole. This sentence arose out of the events of June 12, 2009, in the County of Lincoln,
State of Missouri, the defendant rammed his Chevy van into the victim’s father’s vehicle while
the victim was a passenger in the vehicle, and such conduct was a substantial step toward the
commission of the crime of assault in the first degree and was done for the purpose of
committing such assault and the defendant rammed his Chevy Silverado truck into the victim’s
father’s vehicle while the victim was a passenger in the vehicle, and such conduct was a
substantial step toward the commission of the crime of assault in the first degree and was done
for the purpose of committing such assault.

STATE OF MISSOURI VS. JAMES DAVISON

James Davison, 24, of Moscow Mills, entered a plea of guilty to the Class B felony of
possession of a controlled substance with intent to distribute. The defendant received a sentence
of five years in the Missouri Department of Corrections. This sentence arose out of the events of
May 26, 2008, in the County of Lincoln, State of Missouri, the defendant, with the intent to
distribute, possessed heroin, a controlled substance, knowing of its presence and nature.

STATE OF MISSOURI VS. DAVID PARKER

David Parker, 43, of Winfield, entered a plea of guilty to the Class B felony of driving while
intoxicated. The defendant received a sentence of eight years in the Missouri Department of
Corrections. This sentence arose out of the events of January 25, 2009, in the County of Lincoln,
State of Missouri, the defendant operated a motor vehicle while under the influence of alcohol.
The defendant has four prior convictions of driving while intoxicated.

STATE OF MISSOURI VS. BARRY ROWDEN

Barry Rowden, 21, of O’Fallon, entered a plea of guilty to two Class C felonies of possession of
a controlled substance. The defendant received a suspended imposition of sentence of five years
with the Missouri Board of Probation and Parole. This sentence arose out of the events of
November 24, 2008, in the County of Lincoln, State of Missouri, the defendant possessed Xanax,
a controlled substance, knowing of its presence and nature and the defendant possessed Adderall,
a controlled substance, knowing of its presence and nature.

STATE OF MISSOURI VS. JESSE REYNOLDS

Jesse Reynolds, 22, of St. Ann, entered a plea of guilty to the Class D felony of resisting arrest.
The defendant received a suspended imposition of sentence of five years with the Missouri
Board of Probation and Parole. This sentence arose out of the events of April 04, 2009, in the
County of Lincoln, State of Missouri, Officer Ryan Parker, a law enforcement officer, was
making an arrest of Jesse Reynolds for speeding and the defendant knew or reasonably should
have known that the officer was making an arrest, and, for the purpose of preventing the officer
from effecting the arrest, resisted with the arrest of defendant by increasing his speed to over 110
miles per hour while on Hwy 47 traveling west bound after looking back at Officer Parker while
Officer Parker’s emergency equipment was running, passing numerous vehicles forcing them to
take evasive actions and resulting in a motor vehicle collision with Sergeant Hoyt’s patrol
vehicle.

STATE OF MISSOURI VS. LACY HOEFT

Lacy Hoeft, 20, of Wright City, entered a plea of guilty to the Class D felony of possession of
methamphetamine precursor drug with intent to manufacture methamphetamine or their analog.
The defendant received a suspended imposition of sentence of five years with the Missouri
Board of Probation and Parole. This sentence arose out of the events of June 17, 2009, in the
County of Lincoln, State of Missouri, the defendant, with intent to manufacture
methamphetamine, and acting in concerts with others, knowingly possessed pseudoephedrine.

STATE OF MISSOURI VS. DONNIE BURGESS

Donnie Burgess, 57, of Hawk Point, entered a plea of guilty to the Class C Felony of domestic
assault in the second degree. The defendant received a sentence of two years in the Missouri
Department of Corrections. This sentence arose out of the events of February 22, 2209, in the
County of Lincoln, State of Missouri, the defendant attempted to cause physical injury to the
victim by punching her in the chest, pushing the victim down and kicking the victim in the face,
and such conduct was a substantial step toward causing physical injury to the victim, and was
done for the purpose of causing such physical injury, and the victim was a family or household
member or an adult who is or has been in a continuing social relationship of a romantic nature
with the defendant in that the victim and the defendant resided together.

STATE OF MISSOURI VS. MATTHEW FORD

Matthew Ford, 34, of Cahokia, entered a plea of guilty to the Class C Felony of possession of a
controlled substance. The defendant received a suspended execution of sentence of two years in
the Missouri Department of Corrections and five years probation with the Missouri Board of
Probation and Parole. This sentence arose out of the events of May 14, 2009, in the County of
Lincoln, State of Missouri, the defendant possessed heroin, a controlled substance, knowing of
its presence and nature.
STATE OF MISSOURI VS. GRAY GABBERT

Gray Gabbert, 52, of Maryland Heights, entered a plea of guilty to the Class C Felony of
possession of a controlled substance. The defendant received a suspended imposition of sentence
of five years with the Missouri Board of Probation and Parole. This sentence arose out of the
events of August 23, 2008, in the County of Lincoln, State of Missouri, the defendant possessed
methamphetamine, a controlled substance, knowing of its presence and nature.

STATE OF MISSOURI VS. ZACHARY CARLSON

Zachary Carlson, 24, of Troy, entered a plea of guilty to the Class D Felony of driving while
intoxicated. The defendant received a suspended execution of sentence of three years in the
Missouri Department of Corrections and five years probation with the Missouri Board of
Probation and Parole. This sentence arose out of the events of December 25, 2008, in the County
of Lincoln, State of Missouri, the defendant operated a motor vehicle while under the influence
of alcohol. The defendant has two prior convictions for driving while intoxicated.
