I, Dennis Montgomery, declare as follows:

I am the judgment debtor in this matter. As such, I have personal knowledge of the

3 facts set forth herein.

Judgments have been entered against me in the amount of $26.5 million in favor of

5 eTreppid Technologies, LLC and Warrant Trepp.

I am currently unemployed and have no source of income. I was employed by

7 Blxware, LLC ("Blxware"). The judgment creditors, however, executed on Blxware's assets in
8 Washington State. Accordingly, Blxware is no longer in business.

My assets, including my homes in California, Nevada and Washington, have been

10 liened by the judgment creditors. As a result of the judgments and related liens, Wells Fargo and
11 Bank of American accounts have closed the accounts that held funds belonging to me and my wife.
12 Since my credit score is so low, I have been unable to open new accounts.

In short, I have no income and no assets which have not been liened. I therefore

14 have no ability to pay any amount of attorneys' fees awarded against me.
