Benjamin S.

Seigel

Benjamin Seigel has been a partner with Buchalter Nemer in the firms Los Angeles office. He is
a former chair of the firms Financial Restructuring and Insolvency Practice Group and a
member of the firms Apparel Industries Practice Group. He serves as a mediator for the United
States Bankruptcy Court and as a private mediator under the auspices of Judicate West and the
American Mediation Association, Inc. He has successfully mediated numerous disputes
involving nearly every aspect of bankruptcy and commercial law, real estate, construction,
banking and finance matters.
He has represented clients who have been engaged in essentially every interest in the textile
and apparel industry.
His experience includes matters involving corporate, labor,
transportation, construction, real estate and litigation. He also has represented significant
parties in interest in numerous business bankruptcy cases of local and national prominence
including, B.U.M. International, Inc. (counsel to exit financier), Converse Athletic Shoes
(special counsel to unsecured creditors committee), Carter, Hawley, Hale (counsel to largest
unsecured creditor and member creditors committee) Converse (special counsel to creditors
committee), Fedco, Inc. (counsel to property owner and other interests), Fredericks of
Hollywood (counsel to creditors committee), Laykin et Cie (liquidating trustee), Orange County
(counsel to Orange Counter Employees Retirement System), Susan J. Powter (counsel to equity
group), Sambos Inc. (counsel to landlords), Standard Brands Paint Co. #2 (counsel to
liquidator), TR-3 Industries (counsel to secured creditor), The Sirena Apparel Group (counsel to
creditors committee) and Teddi of California, Inc. (counsel to senior secured lender). His has
also represented every type of interest in bankruptcy and commercial law cases in California
and other areas of the country.
Mr. Seigel is the Founding President and a Director of the California Bankruptcy Forum, a
Director and former President of the Los Angeles Bankruptcy Forum, past Chair of the
Bankruptcy Section of the Beverly Hills Bar Association, a member of the Financial Lawyers
Conference, the Los Angeles County Bar Association, the Secured Creditors Sub-Committee of
the Business Bankruptcy Committee-Business Law Section of the American Bar Association, and
the American Bankruptcy Institute. He served on the Debtor/Creditor Relations and Bankruptcy
Committee of the Business Law Section of the California State Bar, and drafted Assignment for
Benefit of Creditors Legislation enacted in California in 1992 and 1999.
Mr. Seigel served as an Officer in the United States Navy (1958-61) aboard aircraft carriers, and
as a collateral duty was Trial and Defense Counsel for Special Courts-Martial. From 1961 to
1974, Mr. Seigel was active in the textile and apparel industry. He was a member of the Board

of Directors of the National Association of Textile and Apparel Wholesalers and of the Los
Angeles Wholesale Institute. He is currently a, a member of the Executive Board of the
California Fashion Association, a Director of the Apparel Industries Group of City of Hope,
Chairman Emeritus of the Israel Cancer Research Fund and is active in numerous other
charitable and civic organizations.
Mr. Seigel received his Juris Doctor degree, Cum Laude, in 1974 from the University of West Los
Angeles School of Law. He is admitted to the Bar of the State of California and is admitted to
practice in the United States District Courts in California, the Ninth Circuit Court of Appeals, the
United States Tax Court, the United States Claims Court and the United States Supreme Court.
Mr. Seigels mediation experience is extensive and he has successfully mediated disputes
involving business transactions, commercial law, bankruptcy, intellectual property, debtorcreditor rights, construction controversies and real estate matters. Mr. Seigel completed the
Mediation Skills Training Program of the Institute of Dispute Resolution at Pepperdine
University School of Law. He has also published several articles on the practical aspects of
mediation of business disputes. His recent article on mediation entitled, Mediation of
Bankruptcy Disputes: A Risk Assessment Lesson for Lenders was published in the February 2005
edition of the Thompson West Bankruptcy Litigation Reporter and the March 2005 edition of
the Thompson West Bank & Lender Liability Litigation Reporter.
Mr. Seigels article, Valuation of Contingent Liabilities: Some Risk Management Considerations
for Lenders appeared in the September 2005 edition of the RMA Journal published by The Risk
Management Association. His article Using Contingent Liability Analysis in the Loan Approval
Process co-authored with Sandra Stevens, Esq., appeared in the December 2005-January 2006
Issue of the RMA Journal and his article Mediation of Professional Liability Disputes was
published in the March 2006 issue of the Los Angeles County Bar Update.
He has served as a mediator for the United States Bankruptcy Court for the Central District of
California since 1995. Mr. Seigel is the founder and current President of the American
Mediation Association, Inc. He is a graduate of the University of Missouri, Columbia, Missouri,
where he received a Bachelor of Science degree in Chemical Engineering in 1958.
Mr. Seigel is a former adjunct instructor at the University of West Los Angeles School of Law
and Paralegal Studies in the courses of legal theory and practice, contracts, torts, real property,
business planning and bankruptcy. He is a frequent lecturer to accounting firms, financial
institutions and other organizations on debtor/creditor topics, including the financial and
psychological benefits of resolving disputes through mediation.
