The Peace Corps, Office of Acquisitions and Contracts Management seeks to
purchase fifty (50) Computer Based Training (CBT) for Developers
licenses/seats. The CBT licenses/seats will be used for continuing education
and cross training in the latest development software.
All interested companies shall provide a quotation for the following:

SECTION 2 PERIOD OF PERFORMANCE/DELIVERY INFORMATION


2.1.

PERIOD OF PERFORMANCE

The Period of Performance shall be a base year and four (4) option years, if
exercised, and shall be as follows:
Base Year: 11/1/15 -10/31/16
Option Year 1: 11/1/16 -10/31/17
Option Year 2: 11/1/17 -10/31/18

2.2.

DELIVERY REQUIREMENTS

The above items and quantities shall be electronically delivered no later than
thirty (30) days after award the Technical Point of Contact identified in
Section 3.

3.2.

CONTRACTING OFFICERS AUTHORITY

The Contracting Officer (CO) is the only person authorized to make or


approve any changes to any of the requirements of this contract, and,
notwithstanding any provisions contained elsewhere in this contract, the said
authority remains solely with the Contracting Officer. In the event the
Contractor makes any changes at the direction of any person other than the
Contracting Officer, the change will be considered to have been made
without authority and no adjustment will be made in the contract terms and
conditions, including price.
3.3.

INTERPRETATIONS OF MODIFICATIONS

No oral or written statement of any person and no written statement of


anyone other than the CO shall modify or otherwise affect the terms and
conditions of this contract. Requests for interpretations, modifications or
changes must be made in writing to the CO. The technical point of contact

can only respond technical matters that do not result in a change of scope to
this contract.
3.4.

INSPECTION & ACCEPTANCE

Inspection and acceptance will be at destination in accordance with FAR


clause 52.212-4. In accordance with FAR 52.212-4, the Government has the
right either to reject or to require correction of nonconforming supplies.
Supplies are nonconforming when they are defective in material or
workmanship or are otherwise not in conformity with contract requirements.
The Government may reject nonconforming supplies with or without
disposition instructions.
3.5.

For questions regarding payments, please send an email inquiry, including
the invoice number, Delivery Order number, billed amount and date sent to
Disbursing@peacecorps.gov. The invoice shall include, but not be limited to,
the following information:

Name and address of the Contractor


Invoice date and invoice number
Period of performance covered by the invoice
Description, price(s), date of service, and quantity(ies) of services and
supplies for which payment is being requested

Shipping and payment terms, if any

EFT account/payment information (see below)

Costs incurred under the current voucher or costs incurred to date


(cumulative)

Signature of the Contractors authorized representative

Contractors Tax Identification Number (TIN)


3.6.

INVOICE CERTIFICATION

Upon receipt of the invoices, the Peace Corps will check the invoices for
correctness and appropriateness of the charges and will ensure that
chargeable items appearing on the invoices have been formally accepted by
the Peace Corps. In the event that the Peace Corps discovers any
discrepancies in the invoice, the Peace Corps Contracting Officer and
Contracting Officer Representative (COR) will, in addition to following the
requirements of the Prompt Payment Act, take steps necessary to resolve the
discrepancies with the Contractor.

3.7.

INVOICE PAYMENT

For the purposes of this subsection, invoice payment is a Government


disbursement of moneys to the Contractor under this order for products
and/or services which are formally accepted by the Government. Invoices are
payable in accordance with the requirements of the Prompt Payment Act.
Payment will be considered as being made on the day of the electronic funds
transfer is made.

SECTION 5 - CLAUSES
The full text of FAR provisions or clauses may be accessed electronically at

apply to this acquisition:
5.1.

FAR 52.212-4, Contract Terms and Conditions -- Commercial Items (May


2015) and below addendum:
a. Section 508 Accessibility
All electronic and information technology (EIT) procured under this
contract must meet the applicable accessibility standards at 36
CFR 1194, unless the Call Order excepts this requirement. 36 CFR
1194 implements Section 508 of the Rehabilitation Act of 1973, as
amended, and is viewable - PART 1194 at: URL-http://www.accessboard.gov/sec508/508standards.htm.
The following standards are applicable under this contract:
1194.21 Software applications and operating systems.
1194.22 Web-based intranet and internet information and applications.
1194.23 Telecommunications products.
1194.24 Video and multimedia products.
1194.25 Self-contained, closed products.
1194.26 Desktop and portable computers.
The standards do not require installation of specific accessibilityrelated software or the attachment of an assistive technology
device, but merely require that the EIT be compatible with such
software and devices so that it can be made accessible if so
required by the agency in the future.

The Contractor shall indicate whether each product or service is


compliant or noncompliant at the contract level and the Call Order
level with the accessibility standards at 36 CFR 1194.
b. Virus-Free Check and Certification of Data Delivered Via Electronic
Media
All data delivered via electronic media (by disk, telecommunications
transmission, or any other manner of electronic medium) shall be
checked and certified as virus-free at data point of origin. Virus-free
electronic media data certification shall be required to accompany all
such delivered data identifying the specific certifying party, telephone
number, data generation location, date certified, a list of each data
item being certified, and the following certifying statement, all data
provided for by this delivery is virus free.
c. Privacy Act
The Contractor, in the course of performing under this contract, will be
the custodian of, and therefore inherently will have access to,
personally identifiable information (PII) and files protected under the
Privacy Act. Such information shall be kept secure whether it is in
electronic or paper form. Privacy Act systems of records include paper
& electronic records that the Peace Corps controls, and/or which are
collected for the Peace Corps. Such records contain personal
information about individuals which are accessed by name or any other
personal identifier. The Contractor shall treat any material or records
that contain personal information on an individual, whether filed in a
system of records or any other Agency file, in a confidential manner.
There are penalties under the Privacy Act if information is improperly
disclosed.
5.2.

52.217-8 Option to Extend Services (NOV 1999)
The Government may require continued performance of any services within
the limits and at the rates specified in the contract. These rates may be
adjusted only as a result of revisions
to prevailing labor rates provided by the Secretary of Labor. The option
provision may be exercised more than once, but the total extension of
performance hereunder shall not exceed 6 months. The Contracting Officer
may exercise the option by written notice to the Contractor within five (5)
days.

52.217-9 Option to Extend the Term of the Contract (MAR 2000)
(a) The Government may extend the term of this contract by written notice
to the Contractor within five (5) days; provided that the Government gives
the Contractor a preliminary written notice of its intent to extend at least ten
(10) days before the contract expires. The preliminary notice does not
commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be
considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options
under this clause, shall not exceed five (5) years.

SECTION 6 PROVISIONS

All quotes shall be submitted via email to Noah Padilla at


npadilla@peacecorps.gov. Quotes shall be firm-fixed-priced. Quotes shall
include the pricing information in the Product List in Section 1. Quotes shall
include a completed copy of Attachment 1 - The Domestic Vendor File
Request Form. Quotes shall include all proposed commercial warranty terms
and conditions for the items in the Product List in Section 1. If accepted by
the Government, these warranty terms and conditions may be incorporated
as an attachment or incorporated by reference in the final award.
Quotes that do not include all required documents and information may
receive no further consideration and may be eliminated from this evaluation.
All questions shall be e-mailed to Noah Padilla no later than Tuesday,
September 22, 2015, at 1:00 PM Eastern Time. Quotes must be received by
the Contract Specialist via email by September 24, 2015, at 9:00 AM Eastern
Time.
6.2

FAR 52.212-2, EvaluationCommercial Items (Oct 2014)

The Government will award a contract resulting from this solicitation to the
responsible offeror whose offer conforming to the solicitation will be most
advantageous to the Government on a lowest price technically acceptable
basis. The offeror shall demonstrate the ability to provide computer based
training that meets the salient characteristics listed in Section 1. The
evaluation of offers received shall not be on the basis of FAR Part
15.
6.3

FAR 52.212-3, Offerors Representations and CertificationsCommercial


Items (Mar 2015)

The offeror shall complete only paragraphs (b) of this provision if the Offeror
has completed the annual representations and certification electronically via
the System for Award Management (SAM) Web site accessed through

representations and certifications electronically, the Offeror shall complete
only paragraphs (c) through (p) of this provision.
