Indonesia.
It has been jointly issued by 13
organisations from seven countries:
Indonesia, Malaysia, India, Canada,
United Kingdom, Australia and New

The situation at Merak has dragged on
much too long. For over 120 days, the
254 mostly Tamil asylum seekers have
been stranded there. They have suffered
hardships at the hands of the Australian
and Indonesian authorities. The
International Organisation of Migration
funded by Australia to provide welfare
assistance for asylum seekers has used
its control over food, and medicine and
other welfare to deprive the refugees
of basic needs such as medicine,
tarpaulins, and toilets to try to force
people off the boat.
With each passing day, the conditions
deteriorate further and the suffering
grows. The lack of medical attention and
basic care cost the life of a 29 year-old
man, Jacob Christin, in December 2009.

or Australia. Australia should not be
funding, and Indonesia should not be
building, detention centres when people
need houses, schools and medical
centres. 
Australia must help Indonesia

international standards and it must
guarantee re-settlement for those found
to be refugees. last year Australia re-
settled only 32 refugees from Indonesia
Urgent Action Needed
The Indonesian government can act
immediately to open access to the
refugees, allow humanitarian assistance
and begin immigration verification. It
should release those being held in
Jakarta and allow them to return to
the boat if they wish. The Australian
government should instruct IOM to
return to the port area and provide
humanitarian assistance. 
Urgent meetings are needed
between the Indonesian government,
representatives from the boat,
Indonesian human rights, Legal Aid,
refugee rights and welfare NGO’s
to resolve the outstanding issues.
These meetings should also include
representatives of the Australian
government and Australian refugee
advocates to discuss the conditions of
resettlement. 
The people on the boat at Merak are
fleeing persecution in Sri Lanka. One
hundred and nine of them are already
recognized UNHCR refugees.
All they are asking is that their rights
protected by the Australian and
Indonesian governments – both of which
say that uphold human rights and the
values of the Refugee Convention.

war has continuously brooded in the

strife in Sri Lanka has been the political
meetings and discussions that have
– and continue to – take place at my
home and in my father’s office. Some
advocated dialogue; others, violence;
and still others decided that the ‘old
country’ was no longer worth the trouble.
At times, with my world nurtured by such
interaction, I wondered about the merits
of such discussion. Out of respect for
elders, I restrained the comments I
may have made. I know through my
contact with friends from all walks of life
and ethnic background, that they also
shared similar thoughts and questions
about these issues within themselves.
This is why, despite my own work
load and the new efforts that would
be required, I decided to take over
Uthayam, so there can be a sense of
purpose, direction and vision from our
generation, running parallel with elders
who have brought these issues with
them to the diaspora.
At times a reporter for this newspaper,
I had the opportunity to interact with
journalists covering issues important
to those in the South-East Asian
community. Being associated to
Uthayam has allowed me to hear the call
of our advertisers and readers.
In regards to organizations, clubs and
associations within the community, a
handful appear to have ultimately
played a role only for certain vested
interests, under the cover of Tamil
nationalism, with only a passing glance
to humanitarian work. As a youth
growing up in a western nation, in an
era of unprecedented globalization and
immediate access to mass information
via the internet and the like, hypocrisy,
egocentricity and a bizarre thirst to
control Diaspora opinion has been
evident in the actions of (thankfully, few)
groups.
Nevertheless, the time for such
bickering has to be behind us. The
results of Tamil infighting are palpable
and they are tragic and on a vast scale.
All who would now claim leadership of
the Diaspora must put economic and
political empowerment of the Tamils in
Sri Lanka first, and not any sense of
self-entitlement.

ideal of a political solution that suits their
needs.
I am not sure that what IDP’s really yearn
for at the moment is an election process
in the west advocating the Vaddukoddai
resolution.
However, if those holding these elections
are serious about the responsibility such
activities foist on them, then they will
lead their respective Diaspora groups
by example. If they believe these
world-wide elections are about solidarity
with the Tamils in Sri Lanka, then they
will concede the need to go beyond
mere symbolic gestures like votes and
whole-heartedly push for the upliftment
of Tamils as a whole, with quick and
decisive action for those most in need of
urgent assistance.
As Diaspora Tamil leaders themselves
have been economically and politically
empowered in countries outside of Sri
Lanka, they must emphasize to their
respective organizations the need for
Tamils within the North and East to
achieve similar levels of prosperity.
Anything less would be an indication that,
quite simply, “we don’t really care”.
I have included in this issue a press
release from the Global Tamil Forum. I
have not fully studied the GTF’s goals,
structure or methods. However, the
emphasis appears to be on unity and the
need to work with others. I trust those
behind the GTF understand that unity
also means the right for others to have
their opinions heard, to tolerate dissent
and to place reason and human dignity
above all else.
It is early days and no doubt those within
Sri Lanka place faith that the Global
Tamil Forum is one of many diaspora
organizations that will actively function to
support them and their objectives.
In the past month, I have come to
realize the level of work in running this
newspaper. From such recognition, I
would like to end this, my first editorial,
by acknowledging the tireless work of
Dr. Noel Nadesan and Letchumanan
Murugapoopathy, whose efforts
have allowed Uthayam to come out
continuously for the past thirteen years,
even in the face of occasionally fierce
opposition. My father, Sivanathan and
some of their friends also deserve a
mention for they have taken plenty of
criticism in Uthayam’s defence so as to
allow this publication to exist.

Diaspora representation
in Sri Lankan parliament

A key electoral pledge of the UPFA
which is canvassing for a 2/3rd majority
in the legislature is seeking a mandate
to amend the representation system in
Sri Lanka. This article focuses on the
need to consider and accommodate
a disapora representation within
the Sri Lankan legislature in any
form of amendment to the electoral
representation.
The theoretical impetus of for this
discourse on diaspora, non resident/
expat representation emerges from
the reality created globally through
the unprecedented levels of peoples
movements. These levels of people
movements and the ability for
communities to extend beyond marked
parameters of states have called for
rethinking of the political representation
of ‘national citizens.’ The liberal notion
of a defined geographic area as a vital
aspect of community is challenged by
these global human flows. The rise
of technologies of transportation, the
technologies of communication and
interaction through the internet has
called for a rethinking of what makes a
political community and the positionality
of the political community.
There exists a dire need for the electoral
representation to change in Sri Lanka
for many reasons, but the changes
should accommodate realities created
in the present and not be based on
mere political ideals. Though there were
diverse trends in out-migration from Sri
Lanka, the two of the most important
strands were modern features. The
massive labour migration in the post
1977 and the exodus following the 1983
pogrom marked the creation of the Sri
Lankan disapora. Though economic
migration was not a category which fell
into the definition of ‘diaspora’, new
‘diaspora studies’ have incorporated
the terms immigrant, expatriate as a
category of analysis into its broader
parameters.
The Sri Lankan Tamil diaspora is a
significant political community which
has had a distinctive influence of
the Sri Lankan state parallel to the
recently concluded ethnic conflict and
the Tamil diaspora still is seen as a
major force that can generate political
impact. The writer’s concern is that
the Tamil diaspora is never engaged
or only a minority in the diaspora is
engaged continuously by the state, this
minimalistic approach has the potential
to effect far reaching repercussions on
the attempts of post conflict development
and positioning Sri Lanka as a economic,
technological, and educational hub.
The Tamil diaspora or the pro LTTE
elements in the Tamil diaspora has
already called for the creation of a
parallel transnational Tamil Eelam to
Sri Lanka. There were some voting
taking place and the Tamil diaspora
organizations have been strategic
enough to get major stake holders on
board. The inputs of David Miliband
have to be understood in this light rather
than developing emotional critiques that
takes us nowhere.  The Tamil diaspora
remittances has been an important
aspect even in the post conflict situation
where the stability of Tamil families
irrespective of their locations has taken
away certain pressures on the state in
looking after the general welfare of the
war affected people.
The Sri Lankanist thinkers and Sri
Lankanists within the state should
understand the formation of new political
spaces globally as these formations are
offshoots of the massive globalization
we have witnessed. These trends extend
beyond traditional knowledge of the
forms of globalization. This is a time of
global assemblages, where collectives
are made out of actors and organization
even the liberal theories of globalization
could not capture comprehensively.
The Sinhala and Tamil communities
which make up the disapora played
a key role in sending in economic
remittances which has been an important
aspect of the stability of Sri Lankan
families and secondly they have been
politically significant in the counter
propaganda campaigns against LTTE
international. In the final phase of the
war the combined diaspora communities
of Sinhala, Tamil and Muslim Sri
Lankan were able to counter many
misinformation campaigns launched by
the LTTE. The creation of the dissident
Tamil diaspora political forces and their
collaborations with Sinhala diaspora
in certain regions were able to shatter
the dominant discourse maintained
by the pro LTTE diaspora Lobby.  The
assemblage of pro LTTE diasporan were
met by an extraordinary assemblage of
dissident Tamils, Sinhalese and Muslim
activists. Even scholarly research
is lacking on the operations of this
combined diaspora activism.
Returning to the argument of exploring
possibilities of diaspora representation
within the Sri Lankan legislation, points
out to two things. The first, by opening
up representation within the Sri Lankan
legislation challenges the pro Tamil
diasporan notion of state inability of
addressing minority grievances. The
state has to reach out to the diaspora,
the mechanism of reaching out needs
to be worked out carefully but the
state should accept creating such a
mechanism as fundamentally important.
Secondly, the state should acknowledge
the hard work of anti LTTE diaspora
operations and the consequences these
communities and individuals had to bear
in their battles against the LTTE.  academic, policy makers to general

families, the diaspora has had a
significant contribution. These activists
participated in anti LTTE rallies, sit-
ins, email campaigns and even aided
the Sri Lankan security operations

internationally were selflessly putting
their lives and livelihoods in danger.
There were diaspora activists who
travelled to the war zone and looked into
the welfare of civilians and the soldiers,
there were Sri Lankan diasporans
coordinating with families in the so
called border villages. There were also
diasporans who were involved in track
Two and track Three diplomacy on
behalf of the Sri Lankan state in the
most difficult times where the state
encountered extensive diplomatic
pressures. There were many in the
diaspora community who responded to
President Rajapaksa’s open invitation
to the first expat forum held late last
year and who wish to be engaged in
development activities in Sri Lanka.
Thus there needs to be a mechanism
of keeping this important assemblage
of diasporans connected to Sri Lanka.
The state must understand the realities
and not force them to return, instead can
open the space for ‘diaspora circulation’
to take place. The term diaspora
circulation was first used in the Sri
lankan context by a pro Tamil nationalist
writer R. Cheran. The notion of diaspora
circulation for the Tamil nationalist was
maintained through the hope of the LTTE
but the Sri Lankan state can argue that
by providing the necessary legislative
representation this circulation will have
a meaningful and legitimate importance
in the development of Sri Lanka and its
upgrading of home grown democracy.
The notion of dual citizenship must be
encouraged, this is why in the Mahinda
Chintana, H.E. the President pledged
to reduce the fee applicable for dual
citizenship. The importance now is to
accept the category of external citizen
and also provide the facility of permanent
representation of the Sri Lankan
diaspora within the legislature. Many
states globally have accepted this and
encourage things such as internet based
outside voting. The writer does not
want the state follow suit, because the
others do it. The state must comprehend
the new forms of citizen communities
that may not be within its geographic
parameters.
This is an area where many voices could
contribute from a broader spectrum of
citizens. The concept of a ‘diaspora seat/
seats’ in the Sri Lankan legislature is
not without its limitations and perceived
problems, if a consensus is to be derived
and a mechanism created, it would be
massively important in strengthening
the democratic initiatives and the
development outlook for the country.

The humble eggplant, known in some
parts as aubergine and in South Asia
as brinjal, has enjoyed a rare celebrity
in India over the past few weeks. It
has been the topic of spirited debate
in town hall meetings and on television
talk shows. The brinjal in question is
no ordinary vegetable: it's full name is
Bt brinjal, whose DNA scientists have
fortified with a gene that kills a range
of common pests. Its creators say the
genetically modified vegetable will
increase farm yields and bring a less
pesticide-laden vegetable to Indian
dining tables, where the fiery brinjal-
laden baingan bharta enjoys cult
status.
On Feb. 9, though, India's environment
minister Jairam Ramesh nixed the
introduction of the Bt brinjal. Ramesh,
who has come under huge public
pressure to ban the genetically
modified vegetable, said the scientific
community was not agreed on the
brinjal's safety, that public opinion was
against cultivation of the vegetable,
and that there was "no overriding
urgency or food security argument"
for its introduction. He said further
tests were required on the new variety,
and said India needed to ramp up
its genetic engineering regulatory
mechanism. (See the top 10 food

Ramesh's announcement raised
the decibel level in an already shrill
debate. Many of India's farmers say
they oppose Bt brinjal because the
seeds are expensive and would have
to be purchased every year, rather
than something they could harvest
themselves from the previous year's
crop.
But critics of the decision say it
was taken because the minister is
scared of annoying the powerful
farmers' lobby. BT brinjal backers also
question why Ramesh disregarded
scientific evidence from field trials
that indicated the brinjals are safe.
That evidence had been approved
by the government's Genetic
Engineering Approval Committee.
"This decision is certainly a big
setback for biotechnology and I am
afraid it will thwart further investment
in agri-biotech research," says Kiran
Mazumdar-Shaw, head of Indian
biotech firm Biocon. (See the top 10
scientific discoveries of 2009.)
Advocates of GM crops have also
been quick to point out that China
last year announced it would allow
genetically modified rice. Comparing
India and China is a favorite
pastime of Indian economists and
commentators. The country's attempts
to outdo its northern neighbor are a
national obsession. But in its hurry
to reach double-digit growth, India
is confronting a dilemma that has
entangled China for years: what's
more important, economic growth or
the legislation would disrupt coastal
ecology and the livelihoods of local
fishing communities. India's health
ministry is currently reworking
legislation on human clinical trials to
introduce more stringent punishment
for offences. That follows concerns
that Indian research firms were
cutting corners and risking subjects'
health and lives in their hurry to
attract international drug firms. And
lobby groups and non-governmental
organizations have been pressing the
government to introduce new rules on
electronic waste, ever larger quantities
of which is making its way to India
for recycling, or worse, dumping in
landfills.
The Bt brinjal issue is yet another
reminder of how difficult the
government's balancing act is —
and of the extra pressures that a
democracy like India face compared to
more authoritarian countries.
But could India be going too far?
Yes, say those impatient for double
digit growth. Take agriculture. Prime
Minister Manmohan Singh and many
farmers struggling against debt, rising
expenses and stagnant yields, have
called for a second Green Revolution.
But for this, India will probably need
the help of biotechnology, a discipline
in which India has the potential to be
a world leader. Because India allows
protests and debate, though, pro-
industry rulings are often overturned.

the country's regulatory system lacks
the expertise and autonomy required
to put decisions beyond reproach.

has so far not met with any success. But does its heart

Corporation spent more than Rs 24 lakh
on the inauguration of two flyovers(at
Cenotaph Road and Alandur Road) and
a subway (on Jones Road, Saidapet)
by chief minister M Karunanidhi on
December 11, 2009. According to a
reply to an RTI filed by V Madhav of
Porur, Rs 16.45 lakh was spent on the
inauguration of the Cenotaph Road
flyover while Rs 7.87 lakh was spent for
the Alandur Road flyover and the Jones
Road subway although no stage was
put up and the CM inaugurated it sitting
in his car. “The total amount spent for
the functions is almost equal to the ward
development fund of a councillor, which
is Rs 25 lakh a year. At a time when the
government is short of funds for welfare
schemes, there should not be any
wasteful expenditure,’’ Madhav said.
So, what was 24 lakhs spent on? Rs 8.3
lakh on lighting, mikes and ACs at the
Cenotaph Road flyover inauguration,
Rs 2.5 lakh on the stage arrangements
and toilet facility for Karunanidhi, Rs
1.15 lakh was spent for chairs for VIP,
VVIPs and members of the public, the
fabricated tent and synthetic mat. In
addition, booklets supplied to VIPs,
VVIPs and the public on the two flyovers
cost Rs 4.3 lakh, while Rs 3.53 lakh
was spent on lighting arrangements on
the Alandur Road flyover, the Jones
Road subway and the approach roads.
All this expenditure does not include
the money spent on the CM’s security
and newspaper advertisements. But
Subramaniam’s defence? Spending
Rs 25 lakh for a function in which the
CM participates “cannot be considered
unusual or unnecessary.”

UK calls for constitutional reforms

Global Tamil Forum (GTF) Conference was
formally inaugurated on Wednesday 24
February 2010, by the Foreign Secretary of
State, Rt. Hon. David Miliband MP, joined
by Shadow Foreign Secretary, Rt. Hon.
William Hague MP and an array of national
and international Parliamentarians, civil
leaders and academics, at a momentous
show of support for the Tamil Diaspora
congregation, at The Gladstone Room in
the British Parliament.
In a historic display of cross-party, cross-
border, cross-ethnic representation, the
inauguration was addressed by guest
speakers from across the world to
welcome the global initiative. 40 delegates
representing 14 Tamil Diaspora host
countries, member to the Forum, met for
the formal inauguration ceremony and
general meeting being held over three days
in London.
Members from the delegation were also
invited to meet with the British Prime
Minister Gordon Brown, who read a letter
sent to Sri Lanka ’s President Rajapaksa
only a few days before calling on the
Government of Sri Lanka to investigate
electoral malpractices and to investigate
misuse of government resources. Prime
Minister also stressed the need for
constitutional reform in Sri Lanka and
assured the delegation of his personal
commitment to take the Tamil issue
to the international forum such as the
European Union. Australian delegate
thanked the Prime Minister, on behalf of
Australia and the GTF, for his leadership
in blocking Sri Lanka from hosting the next
Commonwealth Conference and awarding
the opportunity to Australia instead.

during the many years of war in Sri Lanka,
followed by Rev. Father S.J. Emmanuel,
President of GTF, welcoming Foreign
Secretary Rt. Hon. David Miliband MP who

delegates to go to Sri Lanka against all

Tamil Diaspora living around the world
united to form the Global Tamil Forum
(GTF), in response to the large scale
massacre of Tamil civilians and continuing
inhumane treatment of detainees by
the Government of Sri Lanka. Diaspora
organisations from the five continents are
represented in this Forum and this is the
first of its kind.
The Forum called for a worldwide
economic boycott of Sri Lanka , by
avoiding the purchase of Sri Lankan made
products, investment and engagement in
any economic activity that promotes the
Sri Lanka regime against Tamils. It further
renewed its pledge to support the internally
displaced persons including children and
the pursuit to bringing charges against
people who had committed war crimes and
crimes against humanity.
GTF will evolve as an independent,
inclusive, international organisation which
adheres to principles of democracy and
non-violence and derives its strength from
existing grassroots organisations of the
Tamil Diaspora. Working in solidarity with
the Tamils and other communities in the
island of Sri Lanka , this Forum will strive
to restore Tamil People’s right to self-
determination and democratic self rule in
their traditional homeland in the island of
Sri Lanka .
