    Inhumanandunconscionable

    JudicialfinalityneednotnecessarilymeanthatIndiashouldhangYakubMemon.Eveninthissituation,ashislifehangsontheslender
    threadofafreshmercypleatothePresident,istheirreversibleandinhumansentenceofdeaththeonlyrecourseforademocratic
    government?
    Carryingoutthesentencewillonlyhavetheappearanceofajusticethatisretributiveandvengeful,notsubstantialormorallydifferentfrom
    theveryoffencethatgaverisetotheproceedings.Inrecenttimes,wesawthehorrificjudicialmurderofAfzalGuru,whowashangedinsecret
    withoutafinalopportunityforhisfamilytomeethim,markinganunprecedentedabandonmentofmoralityonthepartofthestate.Itwas
    onlyinapparentcognisanceofthisthattheSupremeCourtruledearlylastyearthataformalcommunicationtotheconvictandhisfamily,
    intimationtothelocallegalaidcentreandacleargapof14daysbetweenthecommunicationandtheexecutionwerenecessary.Further,
    thereareboundtobequestionseachtimesomeoneishangedorspared.EvenintheMumbaiblastscase,the10mensentencedtodeathby
    thetrialcourtforplantingtheexplosivesweregivenonlylifetermsbytheSupremeCourtonappeal,whileYakubMemonalonewasawarded
    thedeathpenalty.Suchdistinctionsmayseemarbitrarytothelayman.Asalso,therevelationthattheMemonfamilymayhavebeeninduced
    toreturntoIndiawillcastashadowonthelegitimacyofhangingamanwhocooperatedwithIndianagencies.
    Thedebateontheneedanddesirabilityofretainingthedeathpenaltyhasbeenovershadowedbymuchintellectualexertiononthenatureof
    thecrimeinvolved,itsgravity,itsheinousnessandthefatalitiesitcaused.Thetimehascometoendthisdebateonceandforallbyascending
    toamoralpositionthatthereshallbenodeathpenaltyonthestatutebook,regardlessoftheheinousnessoftheoffence,thecircumstancesor
    thenumberoffatalitiesinvolved.AnyonefollowingcloselytheevolutionofthelawondeathsentencesandtheclemencyjurisdictioninIndia
    willunderstandthattheSupremeCourtismakingitmoreandmoredifficultfortheexecutivetocarryoutdeathsentences.Ithasevolveda
    jurisprudencethatlimitscapitalpunishmenttotherarestofrarecases,allowedapostappealreviewaswellasacurativepetition,andmade
    decisionsonappealsformercyjusticiable.Ithaslaiddownacastironruleagainstunduedelayindisposingofsuchmercypleas,andithas
    humanisedtheprocessbyrepeatedlyinterveninginfavourofcondemnedprisoners,oftenattheverylastminute.Atrulylastingsolutionto
    themoraldilemmathateachinstanceofcapitalpunishmentposeswillbetoabolishitaltogetherandreplaceitwithasentenceof
    imprisonmentfortherestoftheconvictslife.Thequalityofmercyisnotstrained.ThePresident,underArticle72oftheConstitution,hasthe
    powertograntpardon,andtosuspend,remitorcommutesentences.Tonotexercisethisexpansivepowerintheserviceofmercywouldbe
    inhumanandunconscionable.
