MINUTES OF COUNCIL
A regular session of Troy City Council was held Monday, September 21, 2015, at 7:00 p.m. in Council
Chambers.
Members Present:

Clark, Heath, Kendall , Oda, Phillips, Schweser, Snee, Tremblay and Twiss.

INVOCATION: The meeting began with an invocation given by Mr. Twiss, followed by the Pledge of Allegiance.
MINUTES: The Clerk gave a summary of the minutes of the September 8, 2015, meeting of Troy City Council.
There were no corrections or additions to these minutes . A motion was made by Mr. Clark, seconded by Mr.
Twiss, to approve these minutes. Motion passed by unanimous roll call vote.
COMMITTEE REPORTS:
Law & Ordinance Committee: Mr. Schweser, Chairman, reported as follows :
1. Committee recommends Ordinance No. 0 -28-2015 be adopted to approve the rezoning of IL 6517.
2. Committee recommends legislation be prepared approving the vacation of the storm sewer easement
along Corporate Drive that is not needed and has not been used . In that the easement must be vacated
to permit Arc Abrasives to complete the purchase of property for a new facility, Committee supports
emergency legislation .

This Ordinance was given first title reading on August 17, 2015.

COMMENTS OF THE MAYOR:


Mayor Beamish noted that the ABC community connections office has been established on the Public Square
and is open some hours each week. This is part of the America's Best Communities competition , in which Troy
is a quarterfinalist.
COMMENTS OF THE DIRECTOR OF PUBLIC SERVICE AND SAFETY:
Mr. Titterington noted that the new 65 gallon recycling containers will be delivered the week of September 28
and, weather permitting, the first round of leaf collection is scheduled to start October 6.

COMMENTS OF THE PRESIDENT OF COUNCIL:


Mrs. Baker noted that the Meet the Candidate event will be held October 15. She also offered condolences to
Firefighter Shawn McMaken, whose son was killed in an accident over the weekend .

COMMENTS OF MEMBERS OF COUNCIL:


-Mr. Phillips asked for an update on the Villages of Concord. Mr. Titterington responded that the City is trying
to work with the developer to get him to complete the work left undone, the City is monitoring the project, and
will explore options should the developer fail to perform .
-Mr. Phillips commented that the past weekend was one of excellent events with Taste of Troy, the Second
Story Tour, and other events.
-Mr. Twiss stated his appreciation for all the volunteers who worked on the recent Lincoln Funeral Train exhibit.
-Mr. Clark congratulated recently promoted Police Sergeants and Captains, and stated his appreciation for Troy
Main Street sponsoring a farmers market over the summer.
-Mrs. Snee asked if the work on the north side of Streetscape (E . Main Street between Mulberry and Walnut
Streets) will go quicker than the work on the south side. Mr. Titterington commented that the work is somewhat
weather dependent, and it is anticipated that the work may take the same amount of time. He also noted that
access to the businesses is being maintained.

There being no further business, the meeting adjourned at 7:15p.m.

This area is located on the east side of
Experiment Farm Road, and is just south of 1501 Experiment Farm Road.

acres of existing IL 6898 as right-of-way.

DETAILED REPORT:
This Committee met on October 1, 2015 to consider the dedication of 2.451 acres of lnlot 6898 as right-ofway. The meeting was also attended by Council Members Snee and Clark, the City Auditor, members of the
City staff, and a citizen.
The Troy Planning Commission recommended that the dedication of 2.451 acres of right-of-way of lnlot 6898
be accepted. This area is located along the east side of Experiment Farm Road (across the road to the east
of Vectren and the City of Troy Central Service and Maintenance Facility), and is just south of 1501
Experiment Farm Road. The right-of-way dedication is part of a replat that has been approved by the City
Engineer that will combine lots into a single building lot; however, the dedication of right-of-way is a matter
that can only be accepted by Council action. The dedication of the right-of-way was requested by City staff so
that the City has more control related to future road construction.
RECOMMENDATION:
It is the recommendation of this Committee that legislation be prepared accepting the dedication of 2.451
acres of existing IL 6898 as right-of-way.

7159 as right-of-way. The meeting was also attended by Council Members Snee and Clark, the City
Auditor, members of the City staff, and a representative of the property owner.
The Troy Planning Commission recommended that Council accept the dedication of 0.189 acres of lnlot
8659 and lnlot 7159 as right-of-way. This area is located along the south side of W. Market St/St.Rt.55
and the west side of Barnhart Road, (across from Horizon Court West). The right-of-way dedication is
part of a replat that has been approved by the City Engineer that will combine lots into a single building
lot; however, the dedication of right-of-way is a matter that can only be accepted by Council action. The
dedication of the right-of-way was requested by City staff so that the City has more control related to
future road construction. The property owner, Segna, Inc., is planning a building expansion. As Segna
wishes to commence construction as soon as possible, it was requested that this matter be considered
as an emergency measure to not delay the project.
RECOMMENDATION:
It is the recommendation of this Committee that legislation be prepared accepting the dedication of 0.189
acres of Inlets 8659 and 7159 as right-of-way. We also support emergency legislation so that the
expansion planned by the owner is not delayed.

Committee members Snee and Schweser met on October 1 to consider the recommendation of the
Director of Law that three parcels of City-owned parcels should be annexed to the City. The parcels are
identified in the detailed report.
RECOMMENDATION: (to be read at Council meeting)
It is the recommendation of this Committee that legislation be prepared authorizing the Director of Public
Service and Safety to file petitions with the Board of Commissioners of Miami County, Ohio for the
annexation of the above three parcels, which will commence the annexation process.

Law & Ordinance Committee
DETAILED REPORT:
Committee members Snee and Schweser met on October 1, 2015, to the annexation of three parcels of
City-owned property. The meeting was also attended by Council Member Clark and members of the City
staff.
The Director of Law has recommended that the City proceed annex three parcels of City-owned property,
which are:

4.584 acre parcel located to the north of Treasure Island Park, donated by Hobart Brothers
Company.

0.283 acre parcel located just north of the area donated by Hobart Brothers Company, parcel
donated by Dr. Jason Johnston.

117.278 acre parcel, formerly known as the Huelskamp farm.

RECOMMENDATION:
It is the recommendation of this Committee that legislation be prepared authorizing the Director of Public
Service and Safety to file petitions with the Board of Commissioners of Miami County, Ohio for the
annexation of the above three parcels, which will commence the annexation process.

This Committee met on September 23 to discuss the 2016 funding of the Miami County Health District. Troy's funding is
based on the millage equivalent as paid by 22 of the 24 political subdivisions in the County for public health services .
Troy's payment is funded from the General Fund. The 2015 Miami County Public Health funding would be $335, 767.69,
which is an increase of 1.51 % over the 2015 funding .
RECOMMENDATION: (To be read at Council Meeting)
It is the recommendation of this Committee that legislation be prepared to approve the 2016 funding to the Miami County
Health District for public health services for Troy citizens in the amount of $335,767.69.

Safety & Health Committee
DETAILED REPORT:
This Committee met on September 23, 2015, to discuss the 2016 funding for the Miami County Health District. This
meeting was also attended by Mayor Beamish, the City Auditor, the Director of Public Service and Safety, and members
of the City staff.
Since 2001, funding to the Miami County Health District has been based on the millage equivalent as paid by 22 of the 24
political subdivisions in the County for public health services. Troy's payment is funded from the General Fund. In
November of 2012 Troy placed on the ballot funding the District through taxes, but the ballot issue failed.
Troy's 2016 Miami County Public Health funding would be $335,767.69. based on the equivalency of the .4 outside
millage plus .2 inside millage, the Public Utility Personal Property Taxes (PUPPT), and the Tangible Personal Property
Tax Replacement Fund (TPPTRF). This is an increase of 1.51 % over the 2015 funding.
As was noted during the Committee discussion, funding of public health through Miami County is at a lesser cost than if
the City provided its own Health District.
RECOMMENDATION:
It is the recommendation of this Committee that legislation be prepared to approve the 2016 funding to the Miami County
Health District for public health services for Troy citizens in the amount of $335, 767.69.

PUBLIC-SERVICE AND SAFETY OF THE CITY OF TROY.
OHIO TO ENTER INTO AN AGREEMENT WITH THE
MIAMI COUNTY GENERAL HEALTH DISTRICT FOR
HEALTH SERVICES

WHEREAS, the City Health Department combined with the Miami County
General Health District in 1993, and

WHEREAS, the fees paid by the City of Troy for Troy residents are to be
approximately equivalent to the basis of fees paid by other County entities,

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Troy, as


follows:

SECTION I: That the Director of Public Service and Safety of the City of Troy,
Ohio is hereby authorized to enter into an agreement with the Miami County General
Health District (dba Miami County Public Health) and that the fee for the City of Troy to
the Health District for 2016 is Three Hundred Thirty-FiveThousand, Seven Hundred
Sixty-seven Dollars and 69/100 ($335 ,767.69).

SECTION II:

That th is Resolution shall be effective at the earliest date allowed

bylaw.

Commission of the City of Troy, Ohio, and

WHEREAS , such plat has been submitted to this Council for approval,
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Troy, as
follows:

ORDINANCE AUTHORIZING THE DIRECTOR OF PUBLIC
SERVICE AND SAFETY OF THE CITY OF TROY, OHIO
TO PETITION THE BOARD OF COMMISSIONERS OF MIAMI
COUNTY, OHIO FOR ANNEXATION OF REAL PROPERTY
TO THE CITY OF TROY

WHEREAS, the City of Troy is the owner of certain real property that is adjacent
to the municipal corporation limits; and
WHEREAS , it is advisable to annex this real property to the City of Troy, so that
municipal ordinances apply to activity on this property.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Troy, Ohio,
as follows :
SECTION I: That the Director of Public Service and Safety of the City of Troy,
Ohio is hereby authorized to file a petition with the Board of Commissioners of Miami
County, Ohio for the annexation of a certain 117.2762 acre tract in Staunton Township
to the City of Troy, the legal description of which tract is attached hereto as Exhibit A
and made a part hereof.
SECTION II: That the Director of Public Service and Safety of the City of Troy,
Ohio is hereby authorized to file a petition with the Board of Commissioners of Miami
County, Ohio for the annexation of a certain 4.594 acre tract in Concord Township to
the City of Troy, the legal description of which tract is attached hereto as Exhibit B and
made a part hereof.
SECTION Ill:

That the Director of Public Service and Safety of the City of Troy,

Ohio is hereby authorized to file a petition with the Board of Commissioners of Miami

We are providing the following for your information:

The bid opening for the Fac;ade Improvements to 121 Public Square is
scheduled to be held on Thursday, October 8. Council authorized $65,000 for
this project, which is from CDBG Funds.

Major Project Update:


o Sidewalk Program 8 - the work has been completed. Quantities are being
finalized in order to send letters to the property owners receiving new
sidewalks through the City's contractor.
o Sewer Lining Project - Miller Pipeline has completed the lining of
manholes in conjunction with the sanitary sewer lining.
o Curbside Recycling Program for FY 2015-2017 was awarded to Rumpke of
Ohio, Inc. The new 65 gallon recycling containers are being delivered to
residents this week so that they can be used starting the week of October
6. Staff members continue to respond to residents who have questions
or concerns related to the new containers.
o McKaig Road Improvement Phase 2 - effective June 15, McKaig Avenue
was closed to through traffic from Monroe Street to Madison Street for the
construction of the McKaig Road Improvement Project Phase 2. This area
will be closed until mid-November, 2015. Access for residents in the
construction area is being maintained. Stormwater main installation is
complete. Curb is scheduled to be poured in the next two weeks.
o Marina Building - interior work progresses as the drywall is now complete
in the fireplace room. Ceiling grids are placed in all but two of the rooms
in which the HVAC duct work is being finalized. Electrical work
continues throughout the building and some of the fixtures are now being
installed. The materials for the front entry have arrived and the framing
is beginning. The concrete in front of the building has been placed and
the paver placement will begin next.
o Treasure Island Park - plantings designed to prevent erosion and
minimize maintenance on the island's slopes will be placed in October.
The month of October is actually the preferred month for this particular
plant to be placed. Base work is complete for the parking areas and bike
trails around the marina building. Paving is scheduled for mid-October
for the first course of asphalt. Support posts are now up for the
amphitheater and the shelter house will begin rising next.

o Streetscape (East Main Street between Walnut and Mulberry Streets) work on the south side of the street is complete except for the delivery
and setting of the traffic signal poles. Work on the north side of East
Main Street is progressing. The contractor and City staff continue to
work with the business/ property owners to provide access during
construction.
o Paving Program - the grinding work and resurfacing is taking place.

The annual fall clean-up at Riverside Cemetery is scheduled to start on October


15. Citizens are asked to remove old and faded items from graves, or staff
members may remove and dispose of them. New decorations may be placed
starting November 15.

The first round of leaf collection is scheduled to commence Monday, October 5,


weather permitting. A copy of the news release is attached. This information
and a map are also posted on the web site.

A reminder that Trick or Treat will be on Thursday, October 29, from 6-8 pm.

Street - including Solid Waste - Jerry Mullins, Foreman
Collected and transported 249 tons of residential trash since last report of 268
tons.
Asphalted three water services and two areas marked for repair including seam
repair on S. Dorset from W. Main to McKaig Road.
Dura-patched 53 areas marked for repair including several areas in the cemetery
Collected T-bags and brush. Several letters were sent out for non-compliant
brush piles. We are reminding citizens that brush must be bundled or placed in
T-bags in order for it to be collected by the city. We also are reminding citizens
that the Dye Mill Facility is open, and we encourage them to take their brush to
that facility in lieu of placing it to the curb.
Cleaned the downtown.
Worked on mowing ditches and rights-of-way.
Used over 650 tons of asphalt on street repairs throughout the City.
Continued with our alley trimming operations.
Repaired concrete sidewalk at Fire Station # 1.
Answered 86 phone calls and emails about the new recycling program.
Electrical - Brian Ferree, Foreman
Completed Ohio Utilities Protection Service requests as needed.
Repaired a new street light at Duke Park.
Repaired six outside security lights at Riverside Cemetery.
Repaired two parking lot lights at the Police Department.
Installed temporary electric in the downtown area for the Taste of Troy.
Raised several traffic signals that were found to be below the standard height
requirements.
Installed a new overhead light in a barn at Duke Park, as well as several sports lights at
Duke Park.
Re-lamped the outside lights at City Hall with new lights.
Water Distribution/Sewer Maintenance - Tom Parsons, Foreman
Marked Ohio Utilities Protection Service tickets.
Investigated the high consumption alerts.
Completed a number of work orders for Billing and Collection.
Shut-off non-payment customers and reconnected as payments were made.
Upgraded water services at residences on East Water Street, East Main Street,
and South Union Street.
Installed two 6" Inserta-valves for the McKaig Road Project.
Upgraded all water services in the 100 block of East Main Street for the street
scape project.
Filled and flushed the line at the new Kroger store.

Investigated a sewer backup on Linwood Drive.


Jetted the sewer line on the 400 block of Lake Street to remove a blockage.
Replaced two catch basins and several feet of storm line at Old Newton Pike.

Water Treatment Plant - Jeff Monce


An Ohio EPA certification officer conducted a mandatory triennial chemical
survey on September 25. All WTP Operators were tested and approved in
operational chemical procedures. Kenny Morgan, Ralph Walters and Jeff Monce
were approved for Full Chemical Certification renewal. Operations Technician
Jason Tron was tested and approved for his new Full Chemical Certification,
making him authorized for all WTP chemical and bacteriological laboratory
procedures.
New WTP Operator Mark Myers has completed four weeks of training and began
to solo on 3rd shift performing operator duties on September 26 .
Contractor completed annual coating touch-up work on the Train 2 clarifiers.
Coating work will cure for a minimum of 12 days prior to Train 2 being placed in
service for the next 12 months.
Contractor has finished cleaning and restoration of the sludge lagoons. Boy
Scout Joe Pascale of Troy St. Patrick's Church Troop 365 will perform his Eagle
Scout service project by coordinating the placement of approximately 1,500 "No
Dumping" curb markers at the storm sewer basins near Troy's well fields. This
project will be performed during the month of October and is part of the City of
Troy public outreach efforts to safeguard drinking water sources.
Ralph Walters and Jason Tron completed extensive sampling of all Troy
production wells and plant tap on September 24. Additional sampling of 19
monitoring wells was conducted this week on as part of the annual source water
monitoring. All samples undergo analysis for over 37 constituents.
Wastewater Treatment Plant - Tim Snider
Vendor completed the outside lighting upgrade project at the plant site.
Vendor should complete the final clarifier painting project by the end of the week.
South primary clarifier has been taken off line, cleaned and is waiting for the
arrival of repair parts. It is anticipated that we will receive these parts within the
next couple of weeks.
Staff replaced a faulty pump at Heywood lift station. The faulty pump was taken
to our vendor for repair.
Staff cleaned debris from the pad at the back of the plant site. The pad is now
ready for milling and asphalt.
Received the updated one line diagram from our vendor. This completes the Arc
Flash Survey update at the plant site .
Received the annual infrared report which has been turned over to the Electric
Department so that necessary repairs can be scheduled.
Vendor was on site to do inspection and maintenance on the plant heating and
cooling units .
Staff continues to complete required preventive maintenance work orders.

Sensus MOM-software system purchased with the upgraded meter reading system in 2008 requires updating due to
age of server and lack of technical support by Sensus. Sensus proposed an upgrade from the MOM to Analytics.

2015 LEAF COLLECTION SCHEDULE - ROUND ONE

FOR IMMEDIATE RELEASE


On Monday, October 5, the City of Troy street crews will commence the annual leaf collection program . City crews
have been picking up leaves on an unscheduled basis . City crews plan to make a total of three leaf collection
rounds through the City. As in the past, the leaf pick-up will be by zones. A Leaf Collection Map is posted on the
City website www.troyohio.gov which shows the zones and an anticipated collection schedule . A description of the
zones and anticipated collection schedule is provided below.
To help provide efficient collection, residents are asked to assist by:
Keep leaf piles free of routine yard waste, tree limbs, trash, rocks, etc. These items can damage collection
equipment and delaying the collection process . See Yard Waste Collection for appropriate disposal of
routine yard waste other than leaves.

Rake leaves to the street one (1) foot out from the curb. Leaving this space between the curb and the
leaves will allow for drainage of the street when it ra ins.
Do not block catch basins with piles of leaves. This can plug up/reduce the flow of rainwater, causing
flooding issues.
Do not place leaf piles around or between parked cars . Leaf piles between or around parked cars will not
be collected.
Residents can take their leaves to the Dye Mill Road facility in lieu of placing them in the street. The facility remains
open until November 29, 2014. Residents can also place leaves in the City of Troy Yard Waste Bags (T-bags).
Yard Waste Bags can be disposed of two ways - collected weekly on the regular trash collection day at the
resident's curb, or taken to the Dye Mill Road Compost Facility.
This schedule is to be considered tentative, subject to weather and equipment delays. If there are questions on the
leaf collection schedule, please call the City of Troy Central Service & Maintenance Facility at 335-1914 between
the hours of 7:00 am - 3:30 pm, Monday through Friday.
ZONE 1:

The area bound on the east by the Corporation line and Ridge Avenue, on the north and west by
the Corporation line and on the south by West Main Street, south on 1-75 and the Corporation line.
Pick-up scheduled for Monday, Oct. 5 through Thursday, Oct. 8.

ZONE 2:

Area bound by Ridge Ave. and Peters Road on the East, to include Pleasant View and Premwood;
to the South Corporation line and West Corporation line to include Willowcreek. Pick-up scheduled
for Friday, Oct. 9 through Wednesday, Oct. 14.

ZONE 3:

Area between Ridge Ave. on the West, Peters Road on the South, South Market Street, Canal
Street, Monroe Street and Miami River on the East and the Corporation line on the north. Also, the

time period.

the current status of on-going issues. Both open and closed concerns are
listed and are separated by each ward.
As in the past, all costs associated with the removal of trash and elimination
of noxious weeds will be invoiced to the property owner. If the property
owner does not pay the invoice, the cost will be assessed to the property
taxes.
