Dave Yost Auditor of State

Special Investigations
Unit
Investigative Report (IR)

2014-CA09084
Time and Date:

1500 hours I November 25, 2014

Person Contacted:

Margaret Scott
Summit County Chief Criminal Prosecutor
330-643-7853

Remarks;
At listed time and date writer conferred with Scott on the potential filing of charges on
Finance Director Scott Svab over the backdating of an invoice between the city of Macedonia
and the city of Canal Fulton in July of this year. Scott asked how writer had come about
investigating the incident.
Writer went over the letter by Joseph Diemert, the Macedonia Law Director to AOS that
delineated acts of possible criminal activity by Finance Director Scott Svab. Scott revealed to
writer she had received this case about the sale of fishing poles and changing the date on an
invoice before this year from BCI and the OCIC attorney. She went on to point out she'd told
Diemert's assistant, Mark Guidetti, the case didn't rise to the level of a criminal act. The order
by Svab to his subordinate to change the date on an invoice could have been refused by her
and she is the one who could potentially be charged. Writer told Scott he had interviewed the
subordinate, Jonelle Melnichenko, and she advised she was afraid of Svab and reported the
incident to the Mayor's administrative assistant.
Scott asked if any party made a profit from the sale of the fishing poles and writer advised
they had not. Writer further pointed out he'd interviewed representatives from the Ohio
Department of Natural Resources who administered the grant in question, and they had
offered their legal opinion that there were no issues with Macedonia or Canal Fulton for doing
what they did. With that Scott advised her office has dealt with issues going on internally in
Macedonia lately and there is an internal feud between different factions who have accused
one another of potential criminal acts and referred them to different state agencies. She is of
the opinion that this incident does not warrant any further investigation or criminal charges.
She added the city of Macedonia has to work out their internal problems themselves and that
they have the mechanisms to do it.
