COMMITTEE REPORT ON ITEM NO. 1190


BOARD RESOLUTION NO. 001-2015 OF THE FEDERATION OF SENIOR
CITIZENS ASSOCIATIONS OF DAVAO CITY, INC., REQUESTING FOR THE
POSTPONEMENT OF THE 2015 ELECTION OF OFFICERS FOR SENIOR
CITIZENS IN THE CHAPTER, DISTRICT AND FEDERATION LEVELS TO YEAR
2016, IN ORDER TO ALLOW THE APPROVAL OF THE PROPOSED
AMENDMENT OF THE CONSTITUTION AND BY-LAWS OF THE FEDERATION,
ITS RATIFICATION BY DISTRICT AS WELL AS THE APPROVAL OF THE
SECURITIES AND EXCHANGE COMMISSION (SEC), FOR THE APPROPRIATE
ACTION OF THE BODY
BACKGROUND

This pertains to the request (Resolution #001-2015) of the Federation of Senior


Citizens Associations of Davao City, Inc., represented by its President Albina L.
Sarona, for the postponement of the 2015 election of officers in the chapter, district
and federation levels to year 2016.

The reason for the said request is to allow the approval of the proposed amendment
of the Constitution and By-Laws of the federation, its ratification and approval by the
SEC.
HIGHLIGHTS
During the Committee Hearing dated April 23, 2015, Councilor Victorio U.
Advincula Jr., Chairperson, shared inputs on the role of the Committee and its
mandate in accordance with the existing laws and ordinances.
The Chair called a representative, Mr. Ricardo A. Jimenez, Jr., the Vice
President of the Federation of Senior Citizens Associations of Davao City. The latter
entered his appearance and provided a short background regarding the said request.
Mr. Ricardo stated that since the previous officers failed to submit the annual
documentary requirements of the SEC, the incumbent officers, now, seek for a time
to work on such requirements and on the amendments to the Constitution and ByLaws, hence the said request.
However, the City Social Services and Development Office (CSSDO),
represented by Ms. Liwayway Caligdong, is not amenable to the request. The
CSSDO believes that while there is no problem to introduce amendments to the
Constitution and By-Laws of the federation, the federation must abide by the term of
office as provided in Article 7, Section 1 of its Constitution and By-Laws, which states
that the term of the elected officers and members of the Board of the Federation of
Region Senior Citizens Association of Davao City, as well as district and chapter
levels shall be two (2) years subject for only one re-election retroactive January
2010.

After a lengthy discussion regarding the request, the Chairperson


recommends to close Item No. 1190 because the Committee cannot allow the
request.
RECOMMENDATIONS
The Committee recommends to close Item No. 1190 regarding the
postponement of the 2015 election of officers for Senior Citizens.
The Committee appreciates the efforts of the incumbent officers of the
federation to make amendments to their Constitution and By-Laws for the benefit of
the federation and its members. However, the request cannot be granted because it
runs counter to the term of office provided in the Constitution and By-Laws of the
federation.
The Committee cannot find justifiable reason for the requested holdover
capacity for the incumbent officers, as they have ample time to work on the
amendments as the elections is not until November. There are other ways to
introduce amendments without going against the set term of office.

A RESOLUTION TO CLOSE ITEM NO. 1190 REGARDING THE REQUEST OF THE


FEDERATION OF SENIOR CITIZENS ASSOCIATIONS OF DAVAO CITY, INC.,
FOR POSTPONEMENT OF ITS 2015 ELECTION OF OFFICERS TO YEAR 2016
WHEREAS, this pertains to the request (Resolution #001-2015) of the Federation of
Senior Citizens Associations of Davao City, Inc., represented by its President Albina
L. Sarona, for the postponement of the 2015 election of officers in the chapter, district
and federation levels to year 2016, to allow the approval of the proposed amendment
of the Constitution and By-Laws of the federation, its ratification and approval by the
Securities and Exchange Commission;
WHEREAS, during the Committee Hearing dated April 23, 2015, Mr. Ricardo A.
Jimenez, Jr., the Vice President of the Federation, stated that since the previous
officers failed to submit the annual documentary requirements of the SEC, the
incumbent officers, now, seek for a time to work on such requirements and on the
amendments to the Constitution and By-Laws, hence the said request. However, the
City Social Services and Development Office (CSSDO), represented by Ms.

NOW THEREFORE, be it resolved as it is hereby resolved, that the City Council of
Davao recommends to close Item No. 1190 because it runs counter to the term of
office provided in the Constitution and By-Laws of the federation. The Committee
cannot find justifiable reason for the requested holdover capacity for the incumbent
officers, as they have ample time to work on the amendments as the elections is not
until November. There are other ways to introduce amendments without going

RESOLVED FINALLY, that copies of this Resolution be furnished to the Office of the
Secretary of the Sangguniang Panlungsod, City Social Services and Development
Office, Office of the Senior Citizens Affairs, City Legal Office, City Mayors Office, and
all other offices/departments concerned, for their information and guidance.
