Welcome and Introductions


Linda Brennen, President, called the meeting to order at about 11:20 AM, and each attendee
made an introduction.

Approval of Minutes for November 2004


Minutes were not available

Treasurer’s Report
Dave Hojsak noted a typographical edit to the Treasurer’s Report for the period of September 9
to November 18, 2004, previously approved at the November meeting. Bonnie Goldschlag
motioned, Eric Snyder seconded, and the Association approved the corrected Treasurer’s Report
for the September – November period. The Treasurer’s Report for November 19 through
December 3 was not available.

Communications and Correspondence


As approved at the November NJCPA meeting, Linda Brennen had sent a letter commending
former State Planning Commissioner Timothy Touhey.

Christine Marion gave an up-date on Senate Bill 2080, also known as the “big box” bill,
previously discussed at the November meeting. NJAC was requesting comments on this bill. The
bill would allow municipalities to require regional economic impact studies for large scale retail
developments. There was a discussion about the appropriate time for fiscal impact analyses:
upfront during the preparation of the master plan and zoning ordinance when impact analysis

would be speculative or later after investments have been made at the time of site plan and
subdivision review. Bob Bzik questioned whether there were other regulations for fiscal impacts.
Christine Marion motioned, seconded by Eric Snyder that NJCPA members submit their
comments on this bill to John Donnadio, NJAC Legislative Director. It was noted that this bill
provides no new role for counties in development review. The motion passed unanimously.

Executive Committee Reports


End of Year Report - Linda Brennen gave a year end report of the meetings and activities of the
NJCPA. The January 2004 meeting included a presentation by Paul Drake, OSG, on plan
endorsement. The new NJDEP stormwater management regulations were presented at the
February meeting. March dealt with cross-acceptance. May brought State Planning Commission
Chair Timothy Touhey to the NJCPA. The July meeting was held in Burlington City with a
walking tour. Eric Powers, NJDOT, presented the DOT Freight Plan at the September meeting.
In October there was another session on the NJDEP stormwater management program.
November dealt again with cross-acceptance as presented by Acting OSG Director Maura
McManimon and Bill Harris, OSG.

Linda thanked the counties for their support and especially noted the roles of the committee
chairs: Christine Marion – Legislative; Bonnie Goldschlag – Statewide Planning & Smart
Growth; Ray Zabihach – Environment; Bob Bzik – Utilities, Transportation & Infrastructure;
and Tony Agliata – Housing & Community Development. She also thanked the 2004 Executive
Board and the state agency representatives.

Other Reports- Bob Bzik suggested a meeting on wastewaster with NJDEP and the BPU. Linda
volunteered to attend that meeting.

Resolution Commending John Kellogg – The NJCPA acknowledged by resolution the many
years of service that John had provided to the Association. He had recently retired from
Hunterdon County. In accepting the resolution John reflected on the value that he found in the
NJCPA when he started his career in Hunterdon.

Slate of 2005 Officers – For 2005 the President’s position will be assumed by Dave Hojsak,
Treasurer by Robert Brewer, and Eric Snyder was nominated for the position of Secretary.
Donna Orbach motioned, Ray Zabihach seconded, and the officers were approved. Linda
Brennen will serve as President Emeritus.

Resolution of Appreciation to Linda Brennen - On behalf of the NJCPA membership, Dave


Hojsak presented Linda with a resolution of appreciation for her work.

Presentation on COAH Round Three Rules


Lucy Voorhoeve, Executive Director of DCA Council on Affordable Housing made a lunchtime
presentation on the new rules becoming effective on December 20. While the affordable housing
obligations in past rounds were based on projections, the third round obligations are based on
market rate growth with strong links to the State Plan. Growth is measured as residential and
nonresidential development. Every eight market rate residential units triggers an obligation for
one affordable housing unit, and every 25 new jobs also triggers the need for one affordable

housing unit. The municipality hosting the growth determines the strategy for providing the
affordable units, and the generator does not have to be the provider. The units must be on
environmentally suitable sites. There are three, five and eight year reviews. Plan endorsement
requires COAH certification within three years. Certificates of Occupancy and demolitions are
used in determining obligations. TDR creates obligations in the community where the
development is constructed. Employment and nonresidential development is measured by square
footage. Rural areas with no growth have no growth share. Metropolitan Planning Organization
and Department of Labor population numbers are used. Several concerns expressed by county
planners included the following: people living in housing needing rehabilitation are not taken
into account; there is no credit for student and military housing and seasonal migrant housing;
and while group homes are given credit, institutional housing is not.
