Article I
Name of the Party
The name of the party is Hindustans Atman for Peoples Power in Youth.

Article II
Allegiance to the Constitution of India
Hindustans Atman for Peoples Power in Youth Party shall bear true faith and allegiance to the
Constitution of India as by law established, and to the principles of socialism, secularism and
democracy and would uphold the sovereignty, unity and integrity of India.

Article III
The Founding Principles of H.A.P.P.Y. party
1. A world of communities with the nature of Ubuntu. It is the right and liberty of every individual to
pursue happiness with the wisdom that Sincerity, Integrity, Equality and Justice for all is essential
for a peaceful world.
2. Conservation of our natural habitat. Cleanliness of our environment. Corruption free society.
3. Religion and politics or political activities must remain separate.
4. All individuals are born leaders. There are no exceptions.
5. All members of this party shall abstain from their pictures/portraits being displayed on Billboards
and/or Hoardings/Banners.
6. All membership is voluntary. All service is voluntary.

Article IV
Objectives
1. The party shall seek to enhance the lives of fellow citizens by the participation of members in
social welfare systems and programs that are designed to improve the quality of life for all.
2. The party shall implement measures to strengthen communities and empower citizens.
3. The party shall act as a medium to deliver the promise of the Constitution of India in its true
spirit, by participation of members in the process of democracy.
4. The elected members are in service as representatives of fellow citizens. We are
committed to ensure the practice of this principle, to make sure that all grievances are
addressed and redressal happens in a timely manner.

Hindustans Atman for Peoples Power in Youth Party (H.A.P.P.Y. Party) is steadfast in its
belief that participation in democracy is the fundamental right of every individual in our Democratic
system. The party will fulfil its obligation to the citizens of India through the implementation of our
H.A.P.P.Y. Party application for the legitimate and reasonable needs of our members in every
constituency/region from their elected representatives within the party and be a positive influence
in Nation building.
It is the inalienable right of every citizen to participate in the election process and
functioning of Governance. H.A.P.P.Y. party is founded and tasked to function in accordance with
the Constitution of India. The party will systematically amend its management and administration in
a transparent and democratic way. Improving efficiently its reliability and performance to deliver
happiness and prosperity to fellow citizens.

Article V
Membership

1) All membership is voluntary.


2) A member who fulfils the criteria for representative elections as stipulated under the constitution
of India is eligible as nominee from the party in all representative elections.
3) Participation in the voting for candidates or party administration is essential for the selection of
all candidates among members for local constituency elections along with happy party
administration, details will be elaborated in this following constitution.
4) Any Indian Citizen of 18 years and above may become a member of the party.
5) A member is the Chairperson of the party, hence all party actions are in accordance to the will of
the member.
6) A member with a legitimate, justifiable call for action by the party shall and has the right to call
for a referendum by the party to seek support of the party.
7) The term of membership is 5 years and on completion is subject to renewal.
8) Members shall pledge to safeguard our environment. All Members are custodians of our natural
habitat. Conservation of our planet for future generations is the zeal of this party.
9) There is no membership fee. All donation is voluntary and accepted through a single central
accepted gateway. This account will be transparent and accessible to all members.
10) All members are spokespersons of the party. Any message of sincerity that adheres to the
values of honestly, transparency, equality, respect of individuality, compassion for their fellow
citizens and which lies within the construct of the constitution of this party, is the party statement.
11) The Party will organise events at the Panchayat/Ward level in order to seek advancement of
the party message.
12) All activism must be strictly observed by force as peaceful. Members should adhere to the code
of Non-violence when the matter relates to the party operations or organisations.

13) Members shall observe the party principle of abstaining to display their pictures/portraits on
hoardings/banners/posters at all times.
14) All human beings are born free and equal in dignity and rights". They are the inalienable
entitlements of all people, at all times everywhere, every single day of the year. They are the rights
of people of every colour, from every race and ethnic group; whether or not they have disabilities;
citizens or migrants; no matter their sex, their class, their caste, their creed, their age or sexual
orientation.
All sections of the society must be treated with equality and respect. There should be no
discrimination based on caste, creed, religion, sex, sexual orientation or political affiliations.
15) Members may volunteer or participate in social awareness programs for social development or
join a cause to offer solutions to issues at the panchayat/ward level. The party is founded on a
quest to deliver a transparent and an operationally effective party system, that aspires to enhance
democracy.
The above mentioned, are the guidelines for membership to H.A.P.P.Y. party.

Article VI
Nomination:
Section A
Representative Elections
i)

All members are eligible for nomination.

ii) All members who fulfil the criteria stipulated under the Constitution of India are eligible for
candidature in representative elections.
iii) All nominees must fulfil all the requirements and guidelines specified under the Constitution of
India.
iv) The criterion for election from a particular constituency requires, that the member be residing or
working in aforementioned constituency for which nomination is sought be no less than 2 years.
v) All nominees who have criminal cases pending in court are ineligible for representative elections.
vi) One person one post. Any office bearer seeking nomination for representative elections must
resign party administration post if elected in representative elections.
vii) The election process is conducted within the party application in a transparent manner. The
selection process is using a system that requires members of a constituency for which election is
being conducted by the Election Commission of India, to vote for their preferred nominees. The
algorithmically devised mechanism is the ELO rating system which will determine the outcome by
the participation of members within this selection process. Members will choose among members
to select a candidate who will be the party representative before every election.

viii) Any particular objection to disqualification must be notified to the CEO of the State, which will
consequently be resolved in not more than 30 days from the disqualification having been
announced.
ix) If disqualification is due to background checks conducted by the party committee, the contention
may be raised to the C.E.O. of the state by the nominee deemed for disqualification.
x) In case, a petition of objection co-signed by 1,000 registered local constituency electorate
against the chosen candidate of the party The selected candidate will be ineligible to contest
representative elections from the party without resolution to the objection.
Any dispute arising from the election process will be notified to the CEO of the State and the
basis of objection will be put forth to the members for a 2/3 majority vote. In case, the dispute is in
favour of the candidate the nominee will be reinstated as candidate of the party.
In case, disqualification is upheld the candidate may appeal to the Regional Manager of the
Party. The Regional Manager in council with The President will then put forth the objection to party
members from the constituency/region in question for a referendum which will settle the dispute by
a majority vote in favour or against the objection.
xi) Any member holding the Chair of elected office of Government and in violation or breach of Law
under the Constitution of India shall be disqualified from holding membership of the party after a
vote of confidence in their particular constituency for which a majority of not less than 2/3rd
members have voted to disqualify membership.
xii) In case of demise or resignation, the process of selection of nominees will be conducted as
mentioned in the above steps to select the candidate for the vacant office.

The office-bearers are guardians of the H.A.P.P.Y. party system, the Chairpersons are the authority
and control of the H.A.P.P.Y. party system.

Section B
Code for Office - Bearers
1. All members are eligible as nominee for the office bearer of the party.
2. All members above the age of 18 years are eligible to be an office bearer.
3. The office bearer must be an effective manager of the party, making aware all decisions to
members.
4. The office bearer shall act as a liaison between the party members and their representatives,
5. The office bearers must resolve the difficulties faced by their constituency members wherever
government tasks are involved to ameliorate living standards. This facilitation is the essential duty
of the office bearer.
6. The office bearers shall be transparent regarding any dealings related to the party funding and
functioning.

7. The office bearers shall disclose any financial undertaking within the party or related to the party
function whenever questions are raised. H.A.P.P.Y. party is to remain open to any independent
investigating agency or individual, if related to the party expenditure.
8. It shall be the responsibility of the office bearers to scrupulously conduct checks of candidates
to ensure that the candidate has no criminal history or criminal intimidation prior to candidature.
The Office bearers shall ensure that the candidate be disqualified subject to redressal and a
subsequent re-election of candidate for representative election to be conducted.
9. It shall be the duty of the office bearers to check that the nominated candidate only spend the
stipulated amount on campaign as directed by the Election Commission of India.
10. The office bearers shall ensure that the selected candidate of this party refrain from displaying
their images or portraits on hoardings, banners, posters at all times whether during or after
elections. The party platform shall act as a conduit between the voters/members and their
constituency representatives. Any expenses incurred during campaign should be submitted to their
respective General Manager of their corresponding ward. This is necessary in order to ensure a
fair and transparent campaign. The General Manager shall ensure that poll expenses of the party
candidates be submitted to the Election Commission of India
11. The office bearers shall ensure that the candidate chosen by constituency members,
subsequently goes on to represent their constituency. If by any unforeseen event the candidate
chosen is unable to contest elections either by his own volition, Ill-health or demise. Re-election will
be conducted to re-select a candidate to run for office.
12. The office bearers shall ensure the integrity of the election system devised and developed for
the party functioning.
13. Any grievances of any member shall be immediately resolved by the General Manager.
14. In case of instances resulting from the callousness or misappropriation of government funds by
an elected party member. The same must be notified for legal recourse if any and to the C.E.O. of
the State to disqualify membership from H.A.P.P.Y. party. The President shall act to address the
issue in question and follow up to re-direct the vote of 2/3rd majority party members, if the elected
member is in denial.
15. If are any grievances against the panchayat/ward level office bearers arising from party
inaction, raised by any member with substantial claim. Petitions of a hundred party members can
trigger a formation of a committee, a minimum of ten individuals to be constituted from the local
constituency to investigate the charges and the report submitted to the Regional Manager within no
more than 10 days. This will lead to reprimand, if the grievance is considered resolvable. If the
issue is a major incident as submitted by the committee, the result will be removal from office
following a referendum for disqualification from the office held on the basis of the findings of the
report. Subsequently an election for the vacant office will be held to fill the chair until the end of the
current term of office.
If there is a complaint against State level functionaries and above including the party President.
The complainant must have substantial basis for the grievance. The complaint should be submitted
to the General (Panchayat/Municipal) Manager and a petition raised by 1,000 members will lead to
a committee of not less than 10 members in quorum to authenticate a vote of no confidence. A
2/3rd majority of participated votes will result in removal from office. In the case of State by State
members and in case of Region, Regional members.

In the case of President, Vice-President, General Secretary and Treasurer, a majority vote of 2/3rd
members.

16. Nomination of office bearer not to exceed more than 1/3 of office bearers.

Section B
Party function
1) President
i) The President needs to effect sanction of members for selection of their candidate for
representative elections within the guidelines of the Party Constitution. All selections to the
peoples representative positions is to take place within the framework of the application designed
to elect the representative within a particular constituency, area or region by members of the
constituency. If there is any inconsistency relating to violation of protocol of application process of
the candidate. The president shall cancel only in consultation with the Vice-president and the
General Secretary and subject to redressal by party members approval through a 2/3rd majority
vote. The President must also follow up on any pending complaints against any of the Office
Bearers.
ii) The Chairpersons are the absolute authority within the party. The Presidents duties is to align
with the Ideas of its members so far as it is under the ambit of the Party Constitution who as
Chairpersons act in accordance with the law of the land and promoting the party ideal of a fair and
just entity for all irrespective of Caste, Creed, Sex or Religion.
iii) The President is to duly sanction the election process of party posts, in a timely manner.
iv) In the case of illness the Vice President and General Secretary are given the responsibility of
jointly conducting party functions.
v) The Function of President is open to all members.
vi) In case, Dismissal by popular demand i.e. vote of no confidence, by a majority of 2/3rd
members participating in elections. Re-election to take place within 7 days.
vii) The term of office is 5 years.
viii) A person cannot hold the office of President for more than 2 terms.

2) Vice - President
i) The Vice-President is to assist the President in all party functions.
ii) The Vice-President can sanction orders in the absence of the President of the party, but the
sanction must include the General Secretary as co-signee.
iii) The office of Vice-President is second in charge and holds authority to sanction an investigation
against the President, if the President is involved in any criminal offences. The case must be
substantiated and any frivolous claim will result in reprimand of the Vice-President.
iv) The Vice-President must scrutinise the functioning of the Regional Managers and find any
pending disputes that is held up with them.
v) The post of Vice-President is open to all members.

vi) The CEO of the States must coordinate with the Vice-President. Any misrepresentation by the
candidates of representative elections must be looked into by the Vice-President before a majority
vote.
vii) In the case Dismissal by popular demand i.e. vote of no confidence, by a majority of 2/3rd
members participating in elections. Re-election to take place within 7 days.
viii) The term of office is 5 years.
ix) A person cannot hold the office of Vice-President for more than 2 terms.

3) General Secretary
i) The General Secretary has to harmonise all inner party functions and notify any unresolved
disputes by the Regional level to the President.
ii) The General Secretary must announce dates for all election held by H.A.P.P.Y. party.
iii) The post of General Secretary is open to all members.
iv) In the case of Dismissal by popular demand i.e. vote of no confidence, by a majority of 2/3rd
members participating in elections. Re-election to take place within 7 days.
v) The term of office is 5 years.
vi) A person cannot hold the office of General Secretary for more than 2 terms
vii) The General Secretary can sanction orders in the absence of the President and Vice-President
of the party, but the sanction must include the Treasurer as co-signee.

4) Treasurer
i) As the party zeal is transparency, the duty of the Treasurer is to maintain and make available to
all members the expenses of the party.
ii) The treasurer is responsible for duly filing party accounts with the Election Commission of India
within the time stipulated.
iii) The post of Treasurer is open to all members.
iv) In the case of Dismissal by popular demand i.e. vote of no confidence, by a majority of 2/3rd
members participating in elections. Re-election to take place within 7 days.
v) The term of office is 5 years.
vi) A person cannot hold the office of Treasurer for more than 2 terms

5) National Level:

1. Nomination: All members are eligible for the function of the Regional Level.
2. The term of office is five years.
3. The designation of Regional Manager is from the five regions (North, South, East, West and
North-Eastern Region). The election of Finance Manager and Secretary is to assist the function of
the Regional Manager.
4. The members from each region elect their Regional Manager, Finance Manager and Secretary.
5. The Regional Manager, Finance Manager and Secretary are tasked with coordination and
redressal of members along with the Party President, Vice-President, General Secretary and the
Treasurer.

Public Relations and VP of Finance.
5. The Chief Executive Officer (CEO), Vice-President Operations, Vice-President Public Relations
Vice-President of Finance of each State are tasked with coordination between the Panchayat/Ward
level and the Regional Level.

7) The Panchayat/Ward Level:


i) The General Manager
ii) Finance Manager
1. All members are eligible for the function of The Panchayat/Ward Level.
2. The nominee of a Panchayat or Ward are elected by the members of the party from the
Panchayat or Ward level.
3. The designation of General Manager and Finance Manager is elected for the region of Ward or
Gram-Panchayat.
4. The term of office is five years.
5. All members must be residing or working in the Panchayat/Ward, for a minimum of 2 years upto
the time of election of The General Manager & Finance Manager.
6. The General Manager and Finance Manager are tasked with the coordination between members
from Panchayat/Ward of the party.

Section C
Quorums
1. The quorum for a meeting is three.
2. Any decision taken in a quorum should be passed with a 2/3rd majority.

Section D
Code of Discipline
All members must adhere to non-violence and refrain from words or actions that may lead to
indignation, harm or injury be it physical or mental trauma to any person in all events, functions or
a call for a cause that members take part in and are held within the party.

Section E
Notice
A 15 notice period for all general meetings.

Article VIII
Party Funds & Accounts
1) All funds are collected through a single centralised payment gateway, this is to facilitate
transparency of accounts.
2) Funds will be allocated to programs and systems to strengthen civic amenities .i.e
intending to improve the happiness quotient of members.
3) If a salary is to be given to the party Office-bearers. The the disbursement of money for
office-bearer services rendered to the party will be sum payable to the President as it is
to every office-bearers. i.e. all posts that fall within the ambit of the Party
Administration. This is subject to approval by party members in a referendum vote of
more than 2/3rd majority for every Administrative Salary related decision conducted
once every 5 years.
4) Distribution to sub areas for expenses will be in an unbiased, statically efficient and an
on priority allocation to State administration, District administration, Taluk
administration or Panchayat administration with insight and transparency
5) Party funds to be utilised for political activities; Accounts to be maintained Treasurer ;
To be annually audited by the Auditor on the panel of CAG; Audited annual accounts to
be submitted to the ECI within 6 months of the end of the financial year.

Article IX
Amendment procedure
The Constitution may be amended subject to approval of 2/3rd majority members voting after
deliberating on an acceptable change that retains the spirit of the constitution of Hindustan's Atman
for Peoples Power in Youth party.
All Amendment procedure is subject to approval of 2/3rd majority members participating in voting.
Deliberation on innovative Amendments to the constitution every 2 years, the General Secretary is
to notify the time for members to discuss Administrative changes or structural changes to the party
and to move forward Amendment procedure.
The Party Amendment Procedure is subject to a majority vote of 2/3rd members participating in an
approval for amendment having The President, Vice-President, General Secretary and Treasurer
as signatories.

Article X
Mergers
H.A.P.P.Y. party will merge with any party that adopts its Constitution along with the absolute
acceptance of the party's election process, the election of office bearers and the election process
for the selection of the party's candidature from a constituency/ward/panchayat.
