EXTRAJUDICIAL SETTLEMENT OF ESTATE

KNOW ALL MEN BY THESE PRESENTS:
AMALIA RENDAL-TAN and children, JASPER R. TAN, 18 years old,
HANNAH KATRICIA R. TAN, VINCE JEFFERSON R. TAN and OLIVIA ANN R.
TAN, the remaining children being minors and hereto represented by their mother
AMALIA RENDAL-TAN , all residing at 4646 Old Sta. Mesa Street, Sta. Mesa, Manila.
declare:
WITNESSETH: THAT -We are the legal and sole heirs of FERMIN GO TAN, who died intestate on
August 26, 2010, copy of his Death Certificate is hereto attached as Annex "A".
WHEREAS, FERMIN GO TAN left certain real properties situated in Taytay
and Cainta Rizal and more particularly described as follows:
"A parcel of land covered by Transfer Certificate of Title No. 589921
issued by the Register of Deeds for the Province of Rizal registered in the name
of FERMIN G. TAN married to AMALIA RENDAL-TAN consisting of 140
square meters more or less situated in Palmera Homes, Taytay, Rizal; Annex
A
A parcel of land covered by Transfer Certificate of Title No. 589922
issued by the Register of Deeds for the Province of Rizal registered in the name
of FERMIN G. TAN consisting of 70 square meters more or less situated in
Palmera Homes, Taytay, Rizal, Annex B
Co-owner of share in a Condominium Unit with Johny Ngo situated at

Cambridge Village, specifically located at Unit 2-A Cluster 12 Cambridge

Village, Kabisig Road., Brgy.San Andres, Floodway, Cainta, Rizal a nd
covered by a Contract To Buy and Sell , Annex C, between Empire East Land
Holdings, Inc. and co-owners Johnny G. Ngo and Fermin G. Tan married to
Amalia R. Tan with residence and postal address at 4646 Old Sta. Mesa St., Sta.
Mesa, Manila and more particularly described as follows:

WHEREAS, the parties hereto are the sole and only heirs of the decedent entitled
to succeed to his estate, they being his wife and legitimate children respectively, copies of
the marriage contract and birth certificates of the children are hereto attached as Annexes
D , E, F, G & H respectively;
WHEREAS, there are no known debts or obligations due against the estate of said
decedent; and,
WHEREAS, it is to the best interest of the parties hereto to divide, partition and
adjudicate between themselves the entire estate particularly the real properties above
described extra-judicially in the manner and form hereinafter set forth;

NOW, THEREFORE, for and in consideration of the foregoing premises, and
invoking the provision of Section 1, Rule 74 of the Rules of Court, the parties hereto have
agreed as they hereby do so agree to divide, partition and adjudicate the portion of above
estate among themselves.
Subject, however, to contingent liabilities to creditors, heirs or
other persons who might have been deprived of lawful participation in the
estate of the decedent, for a period of two years from and after the
settlement and distribution thereof, in accordance with the provision of
Section 4, Rule 74 of the Rules of Court; and
That in the remote event that any other property of the decedent should ever be
found which is not included herein above, the parties hereto further agree as they do so
agree to settle and distribute the same in like manner and proportion as herein established
and disposed.
IN WITNESS WHEREOF, the parties hereto have hereunto set their hands at the
place first above written.

ACKNOWLEDGMENT

AMALIA R. TAN with her government issued IDs, (Postal Identity Card No. 9552783
expiring on September 03, 2013) known to me and to me know to be the same persons
who executed the foregoing instrument, and acknowledged that the same is their free act
and voluntary deed.
This instrument consisting of two (2) pages, including this whereon the
acknowledgment is written, has been signed by the party and witnesses on each and every
page thereof, and relates to an Extrajudicial Partition of Estate Among Heirs.
