On November 13, 2015 the Department received a complaint regarding your
Uniform Construction Code (UCC) enforcement and administrative activities. The
complaint alleged that construction began on a Public Works Garage and a District
Magistrate's Office located at 5975 Locust Lane in Lower Paxton Township, Dauphin
County and that this work was being performed with your knowledge and without a UCC
building permit being issued.
The Department conducted an investigation of the complaint and visited the site.
It was determined, that with the exception of a retaining wall, the work that had been
performed at the site up until the time of our investigation, was work that did not
require a UCC building permit. The retaining wall being constructed was to exceed a
height of 4 feet and when this was discovered, your office took the appropriate action
and issued a stop work order in accordance with Section 403.81 of the UCC, until the
necessary applications and reviews could be completed and a building permit was issued
for this work. Additionally, you reassured the Department's inspector that no additional
construction of the actual buildings will occur until the appropriate plan reviews were
conducted and building permits are issued.
In conclusion, our investigation has found no evidence of misconduct regarding
your UCC enforcement activities as the Building Code Official for Lower Paxton Township
and the Department considers this matter closed. However, I feel that it is necessary to
remind you, that pursuant to Section 7210.105 (b)(2) of the PCCA, your responsibilities
include notifying the Department of inspections being performed on buildings owned by
Lower Paxton Township. The Act requires that your office, give the Department the
opportunity to observe inspections of these buildings as they occur.
